HomeMy WebLinkAboutResolution 3623-06-2008Resolution No. 3623-06-2008 AMENDING THE CITY OF FORT WORTH'S ANNEXATION PLAN TO REMOVE AN APPROXIMATELY 68-ACRE TRACT OF LAND LOCATED SOUTH OF TIMBERLAND BOULEVARD AND EAST OF OLD DENTON ROAD WHEREAS on December 14 1999 the City Council approved Resolution No 2598 adopting an annexation plan for the Crty of Fort Worth m accordance with Section 43 052 of the Local Government Code; WHEREAS on November 27 2007 the Crty Council approved Resolution No 3558-11 2007 adopting the twentieth amendment to the Cry's annexation plan identifying approximately 489 acres referred to as Area 12 WHEREAS American Residential Commumties, owner of 68 1 acres of land m the Francisco Cuella Survey Abstract 266, Tarrant County south of Timberland Boulevard and east of Old Denton Road, has petitioned for full-purpose annexation of the property by the Crty of Fort Worth, WHEREAS the 68 1-acre parcel owned by American Residential Commumties was included m the twentieth amendment to the City's annexation plan, WHEREAS American Residential Communities has requested that the City remove the 68 1 acre parcel from the City's annexation plan so that the area can be annexed on June 3 2008 or as soon thereafter as practical as an owner imtiated annexation petition, defined m Section 43 052(h) of the Texas Local Government Code and WHEREAS Section 43 052(e) provides that a mumcipahty may amend its annexation plan at any time to remove an area proposed for annexation, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH. l That the City's annexation plan, approved on December 14 1999 by the adoption of Resolution No 2598 is hereby amended to remove approximately 68 acres out of the F Cuella Survey A 266 Tarrant County Texas, as shown on Exhibit A and described m Exhibit B and 2. Further that the area so described may be annexed for full purposes effective on the date of this plan amendment. Begmmng at a point m the east line of the Old Denton Road (a 45 ROW) said point also being the Northwest corner of a tract of land belonging to Messer & Messer Builders, Inc as recorded m Vol. 7114 on Pg. 670 Deed Records, Tarrant County an iron rod for a corner Thence N 00 degrees 11 minutes 12 seconds East along the East line of Old Denton Road a distance of 1481.26 feet to an iron fence post for corner Thence S 89 degrees 56 minutes 50 seconds East a distance of 1999 15 feet to an iron rod for corner Thence S 00 degrees 10 minutes East a distance of 1481 66 feet to an iron rod for corner m the North line of the said Messer & Messer Builders tract; Thence N 89 degrees 56 minutes 09 seconds West along the said North line a distance of 2008.28 feet to the place of Begmmng, and contaimng some 68 145 acres of land, more or less. No 3623-06-2008 DATE Tuesday June 03 2008 LOG NAME 06AMEND08004 REFERENCE NO PZ 2784 SUBJECT Adopt Resolution Amending the City of Fort Worth's Annexation Plan to Remove an Approximately 68 1 Acre Tract of Land Located South of Timberland Boulevard and East of Old Denton Road Located in the Francisco Cuella Survey Abstract No 266 Tarrant County Texas from the Plan RECOMMENDATION It is recommended that the City Council approve the attached resolution amending the City's annexation plan to remove an approximately 68 1 acre tract of land located in the Francisco Cuella Survey Abstract No 266 Tarrant County Texas from the plan DISCUSSION On November 27 2007 (M&C PZ 2761) the City Council adopted the twentieth amendment to the City's annexation plan to add approximately 489 acres in far north Fort Worth referred to as Area 12. Under state law the City Council can annex Area 12 for full purposes beginning on November 27 2010 This resolution addresses a portion of Area 12 (AX-08-004) generally located south of Timberland Boulevard and east of Old Denton Road in Tarrant County Texas The property owner American Residential Communities has requested that the 68 1 acre parcel be removed from the City's annexation plan so that the parcel may be annexed with an owner-initiated annexation petition defined in Section 43 052(h) of the Texas Local Government Code Immediately following on the City Council agenda is a Mayor and Council Communication for adoption of the full purpose annexation of this 68 1 acre tract of land to be presented if the City Council approves this annexation plan amendment. The property is contiguous to COUNCIL DISTRICT 2 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
