Home My WebLink AboutOrdinance 22585-01-2017 ORDINANCE NO.22585-01-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL FUND IN THE AMOUNT OF $80,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE CONSTRUCTION OF PRECINCT LINE ROAD FROM STATE HIGHWAY 10 TO CONCHO TRAIL; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water Capital Fund in the amount of$80,000.00, from available funds, for the purpose of funding the construction of Precinct Line Road from State Highway 10 to Concho Trail. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 1/31/2017 - Ordinance No. 22585-01-2017 DATE: Tuesday, January 31, 2017 REFERENCE NO.: **C-28093 LOG NAME: 20PRECINCT LINE ROAD CHANGE ORDER NO 12 - 00147 TXDOT SUBJECT: Authorize Approval of Appropriation Ordinance in the Amount of$80,000.00 for Increased Project Management Costs and to Fund Change Order No. 12 to City Secretary Contract No. 44743, a Local Transportation Project Advance Funding Agreement, with the Texas Department of Transportation, for the Water Main Improvements in Precinct Line Road from State Highway 10 to Concho Trail (COUNCIL DISTRICT 5) RECOMMENDATION: It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Fund in the amount of$80,000.00 from available funds for the construction of Precinct Line Road from State Highway 10 to Concho Trail. (CPN 00147) DISCUSSION: This project widens Precinct Line Road from two-lanes to four-lanes including intersection and traffic signal improvements at Trinity Boulevard, reconstructed travel lanes, left and right turn lanes, storm drainage improvements, sidewalks, railroad crossing, and waterline improvements. Change Order No. 12 in the amount of$70,000.00 provides funds for an additional 100 linear feet of 24- inch casing pipe in order to span the proposed channel gabion improvements at Walker Branch at Precinct Line Road. This change order was delayed to allow time for funding to be procured by the Water Department and the change order to be reviewed by the Texas Department of Transportation. In addition to the change order amount $10,000.00 is required for project management. Construction of the Precinct Line Road Project has components of the overall project that include design, construction, project management, easements, and right-of-way acquisition, construction administration, material testing, inspection, and contingencies. The overall City project budget is $3,832,283.78 for Precinct Line Road and $1,292,000.45 for the Walker Branch Bridge. Construction is anticipated to be substantially completed in February 2017. This project will have no impact on the Water Department's operating budget. Previous the City Council actions for this project include the following: On March 19, 2013, Mayor and Council Communication, (M&C C-26154) the City Council authorized execution of Amendment Number 1 to the Funding Agreement with TXDOT in the amount of$10,665,534.00 for construction of the Precinct Line Road project. On August 2, 2016, (M&C C-27830), the City Council authorized the execution of Change Order Nos. 18, 19, 20, 22, and 23 with TXDOT in the collective amount of$164,785.78 for the construction of the Precinct Line Road Project. On August 30, 2016, (M&C C-27891), the City Council authorized the execution of Change Order No. 27 with TXDOT in the amount of$491,237.85 for the Logname: 20PRECINCT LINE ROAD CHANGE ORDER NO 12 - 00147 TXDOT Pagel of 3 construction of the Precinct Line Road Project. The project is located in COUNCIL DISTRICT 5, Mapsco 52Z, 53W, 66D and 67A. This contract will be with a governmental entity, state agency or public institution of higher education: TXDOT. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Fund. The Fiscal Year 2017 Water Operating Fund budget includes appropriations of $21,060,000.00 for the purpose of providing Pay-As-You-Go funding for water capital projects.
