HomeMy WebLinkAboutResolution 3669-10-2008A RESOLUTION NO 3669-10-2008 RECOGNIZING AN ASSOCIATION SELECTED BY A MAJORITY OF THE FIRE FIGHTERS OF THE FORT WORTH FIRE DEPARTMENT AS THE EXCLUSIVE BARGAINING AGENT FOR FORT WORTH FIRE FIGHTERS IN ACCORDANCE WITH CHAPTER 174 OF THE TEXAS LOCAL GOVERNMENT CODE AND AUTHORIZING THE CITY MANAGER TO DESIGNATE A NEGOTIATING TEAM FOR THE CITY WHEREAS, the Texas Legislature has enacted the Fire and Police Employee Relations Act to allow collective bargaining process for certain employees of certain qualified municipalnties, and, WHEREAS, m November 2007, a majority of the votes cast m an election under Section 174 O51 of the Texas Local Government Code adopted the state law applicable to fire fighters that establishes collective bargaining, preserves the prohibition against strikes and lockouts, and provides penalties for strikes and lockouts, and, WHEREAS, collective bargaining negotiations shall be between the City Manager's designated bargaining agents, and an association selected by a ma~onty of the fire fighters of the City's fire department as the exclusive bargaining agent for City fire fighters, and, WHEREAS, under Chapter 174 the role of the City Council is to approve or disapprove any written agreement that may be proposed by the respective bargaining agents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT 1 The Crty Council recognizes Local 440 of the International Association of Fire Fighters as the exclusive bargaining agent for Fort Worth fire fighters. 2. The Cnty Council authorizes the City Manager to designate a negotiation team to bargain on behalf of the Crty of Fort Worth and the Crty Council resolves that its members will not engage m individual or group discussions with the fire fighters' bargaining agents regarding wages, hours of employment, or any other items and conditions of employment.
