HomeMy WebLinkAboutOrdinance 18192-07-2008Ordinance No. 18192-07-2008 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $135,848 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH CONATSER CONSTRUCTION TX, L. P. FOR STORM DRAINAGE IMPROVEMENTS AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON KELLIS-MAY DRAINAGE IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $135,848 from available funds, for the purpose of executing a contract with Conatser Construction TX, L.P. for storm drainage improvements and water and sanitary sewer main replacement on Kellis-May Drainage Improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute a contract with Conatser Construction TX, LP, in the amount of $468,708.00 for storm drainage improvements and water and sanitary sewer main replacement on Kellis- May Drainage Improvements (Hemphill Street to the Union Pacific Railroad Crossing); 2. Authorize the transfer of funds in the amount of $135,848.00 from the Water Operating Fund to Water Capital Projects Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $135,848.00 from the available funds. DISCUSSION: In 2001 and 2002, storms caused severe flooding to homes, churches and roadways located on or near Kellis Street and May Street due to an undersized storm drain system. The storm drain improvements are necessary to prevent flooding to these areas in the future. The Kellis-May Drainage Improvements are funded by the 2004 Capital Improvement Program and Storm Water Utility Fund. Additionally a sanitary sewer main will be relocated in order to construct the proposed storm drainage improvements.and the severely deteriorated water lines will be replaced prior to street reconstruction. The project was advertised for bid on February 28, 2008, and March 6, 2008, in the Fort Worth Star- Telegram. On April 3, 2008, the following bids were received: . Bidders Conaster Construction TX, LP Valles Underground Utilities, Ltd. J.T. Dersner, Inc. Time of Completion: 60 Working Days. Amount $468,708.00 $493,711.00 $580,812.00 Funding in the amount of $10,888.00 is included for associated water construction survey, project management, pre-construction, material testing, and inspection. The contingency funds to cover change orders total $6,000.00. Funding in the amount of $28,812.00 is required for associated paving and drainage construction survey, Logname: 30KELLIS-MAY89 Page 1 of 2 project management, pre-construction, material testing, inspection and project close out. Contingency funds for storm drainage improvements is $17,487.00. M/WBE -Conatser Construction TX, LP, is in compliance with the City's M/WBE Ordinance by committing to 15 percent M/WBE participation and documenting good faith effort on this combined project. Conatser Construction TX, LP, identified several subcontracting opportunities. However, the M/WBE's contacted in the areas identified did not respond or did not submit the lowest bids. The City's goal on this combined project is 22 percent. This project is located in COUNCIL DISTRICT 9, Mapsco 91J. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, in the Water Capital Projects Fund, the Street Improvements Fund and the Storm Water Capital Projects 2007 Revenue Bond Fund.
