HomeMy WebLinkAboutResolution 3463-03-2007A Resolution NO 3463-03-2007 A RESOLUTION APPROVING THE EXCHANGE OF 1,195 SQUARE FEET OF PROPERTY AT DALLAS/FORT WORTH INTERNATIONAL AIRPORT FOR 1,195 SQUARE FEET OF THE STATE OF TEXAS PROPERTY, AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED CONVEYING 1,195 SQUARE FEET TO THE STATE AND APPROVING AND ACCEPTING THE APPROPRIATE DEED FROM THE STATE CONVEYING 1,195 SQUARE FEET TO THE CITIES OF FORT WORTH AND DALLAS WHEREAS, on February 3 2005 the Dallas/Fort Worth International Airport Board (Airport Board) approved resolution No 2005-02-060 requesting that the Cities of Fort Worth and Dallas (1) approve an exchange of 1 195 square feet of land for 1 195 square feet (0 0274 acres) of land between the State of Texas and the Cities of Fort Worth and Dallas for the benefit of Da11as1Fort Worth International Airport (Airport), (2) approve and execute the appropriate deed conveying 1 195 square feet (0 0274 acres} of Airport property to the State of Texas, and (3) approve and accept the appropriate deed from the State of Texas conveying 1 195 square feet of State property to the Cities for the benefit of the Airport, as more particularly described m Exhibit A and WHEREAS, the Texas Department of Transportation (TxDOT) desires to acquire approximately 1 195 square feet (0 0274 acres) of Airport land to improve a segment of State Highway Business 114 between State Highway 114 and Dallas Road, and WHEREAS, in exchange for the aforementioned land, the State of Texas will convey approximately 1 195 square feet (0 0274 acres) of land to the Cities of Fort Worth and Dallas for the benefit of the Airport; and WHEREAS, the exchange of land will allow TxDOT to prove additional right of way to improve the safety of citizens uhhzmg the roadway system, and WHEREAS, the 1968 Contract and Agreement between the Cities of Fort Worth and Dallas require that all conveyances and all acquisitions of interests m real property at Dallas/Fort Worth International Airport be authorized and executed by the respective cities, and, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT Section 1 The City Council approves of the exchange of State of Texas property containing approximately 1 195 square feet (0 0274 acres) of land for Dallas/Fort Worth International Airport property contammg approximately 1 195 square feet (0 0274 acres) of land to improve State Highway Business 114 Resolution No 3463-03 2007 Section 2. The Crty Manager is authonzed to execute the appropnate deed to convey 1 195 square feet (0 0274 acres) of land to the State of Texas. Section 3. Authorizes the City Manager to execute the appropriate deed to convey approximately1 195 square feet (0 0274 acres) to the State of Texas to improve a segment of State Highway 114 and 3 Approves and accepts the appropriate deed from the State of Texas conveying 1 195 square feet (0 0274 acres) of State property to the Cities of Fort Worth and Dallas for the benefit of the Airport. DISCUSSION At its meeting on February 3 2005 the Airport Board passed Airport Board Resolution No 2005-02-060 which approved the exchange of 1 195 square feet (0 0274 acres) of Airport property for 1 195 square feet (0 0274 acres) of State of Texas property requested the city councils of the Cities of Fort Worth and Dallas approve and execute the appropriate deed conveying 1 195 square feet (0 0274 acres) of land to the State and approve and accept the conveyance from the State of 1 195 square feet (0 0274 acres) of land for the benefit of the Airport. Both state law and the 1968 Contract and Agreement between the Cities of Fort Worth and Dallas require that all conveyances and all acquisitions of interests in real property at Dallas/Fort Worth International Airport be approved by the Councils of both cities. The Texas Department of Transportation desires to acquire approximately 1 195 square feet (0 0274 acres) of land to improve the right-of-way width of a segment of State Highway Business 114 between State Highway 114 and Dallas. In exchange for this right-of-way the State of Texas will convey approximately 1 195 square feet (0 0274 acres) to the Cities of Fort Worth and Dallas for the benefit of the Airport. The additional right of way required by the Texas Department of Transportation (TxDOT) will provide sufficient land to improve safety for citizens utilizing the access roadway system Presently the road is not sufficient to meet present day traffic demands This exchange of land is exempt from public notice and bidding requirements of Local Government Code Logname 12DFWHWY114 Page 1 of 2 Section 272.001 (a) The State of Texas will stake the new property lines as a result of the exchange and the Airport will retain the perimeter fence and relocate the same to the new property lines. The Airport will receive fair market value for the required right of way as a result of the exchange This action has been submitted for Airport Board and both City Councils approval in advance of the receipt of Federal Aviation Administration (FAA) approval of the land exchange The completion of the transfer of property to TxDOT will not occur until such time as formal request has been sent, reviewed and approved by the FAA.
