HomeMy WebLinkAboutResolution 3466-03-2007A Resoluteon NO 3466-03-2007 ENCOURAGING THE NATIONAL FOOTBALL LEAGUE AND NFL PROPERTIES LLC TO HOLD SUPER BOWL XLV IN THE NORTH TEXAS REGION AND MAKING CERTAIN ASSURANCES RELATED THERETO WHEREAS, the National Football League (the `League") owns, produces and controls the annual professional football championship game known as the `Super Bowl" NFL Properties LLC ("NFLP" or, together with the League, the "NFL') owns, produces and controls the "NFL Experience, and along with other NFL Affiliates owns, produces and controls certain other events associated with the Super Bowl ("Official Events") (Official Events together with North Texas Super Bowl XLV Bidding Commttee, Inc. ("Host Committee") events aze referred to as `Super Bowl Activities"), and WHEREAS, a Super Bowl has never been held in the North Texas Region, and W]FIEREAS, the City of Fort Worth (the `C~"), along with other municipalities and governmental entities in the North Texas Region, desires Super Bowl XLV and its related Super Bowl Activities to be held in the North Texas Region, and WHEREAS, the North Texas Region s hosting of Super Bowl XLV and its related Super Bowl Actrvities will generate goodwill, enhance the renown and prestige of the North Texas Region, including the City and create temporary jobs and substantial beneficial economic and fiscal activity in the North Texas Region, including the City and WHEREAS, the City has within its jurisdiction facilities, access roads, thoroughfares and other areas which may be used for the purposes of organizing, financing, promoting, accommodating, staging and conducting Super Bowl XLV and its related Super Bowl Activities; and WHEREAS, the City's Police Department is officially charged with the responsibility to provide public safety services within the City and WHEREAS, the City's Fire Department is officially charged with the responsibility to provide fire protection and medical emergency services within the City and WHEREAS, the City has the responsibility to license and regulate the use of motor vehicles for compensation within its jurisdiction, and Resolution No 3466-03 2007 WHEREAS, as part of the formal bid of the North Texas Region to the NFL that it designate the North Texas Region as the site for Super Bowl XLV and its related Super Bowl Activities, the City has been requested by the NFL to provide various commitments with respect to the provision of certain governmental services to accommodate, stage and conduct Super Bowl XLV and its related Super Bowl Activities; and WHEREAS, in anticipation of accommodating the NFL, the two participating Teams ("Teams"), the Host Committee and thousands of visitors if the North Texas Region is designated as the site of Super Bowl XLV and its related Super Bowl Activities, the City Council wishes to express its support for Super Bowl XLV and its related Super Bowl Activities and desires the NFL to select the North Texas Region as the site of Super Bowl XLV and its related Super Bowl Activities; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. 1. That the findings contained in the preamble of this Resolution are determined to be true and correct and are hereby adopted as a part of this Resolution. 2. That the City welcomes Super Bowl XLV and its related Super Bowl Activities to its jurisdiction and to that end. declares its full support of the efforts of the Host Committee to have the North Texas Region selected as the site for Super Bowl XLV 3. That, if the North Texas Region is designated as the site for Super Bowl XLV the City intends to provide the following services at no cost, expense or liability to the NFL or the two participating Teams or the Host Committee (whether, recognizing the uniqueness and extraordinary scope of the Super Bowl, such services are below equal to or beyond the normal level and range of public safety services usually provided for events held within the jurisdiction), including all planning, training or deployment activities related to the provision of such services: (a) all law enforcement and public safety services within the corporate limits of the City (including, without lmitation, proper vehicular and pedestrian traffic control, security police escorts from tune to time as requested by the NFL and the Teams, other police services and supplies for the protection of people and property) that the City determines are reasonably necessary to protect and promote the public health, safety and welfare, including the NFL, the Teams, the Host Committee and visitors to Super Bowl XLV and any related Super Bowl Activities within the City (b) all fire and medical emergency services within the corporate limits of the City (including, without limitation, proper fire safety enforcement, emergency dispatch and Resolution No 3466-03-2007 paramedic services and supplies for the protection of people and property) that the City determines are reasonably necessary to protect and promote the public health, safety and welfare, including the NFL, the Teams, the Host Committee and visitors to Super Bowl XLV and any related Super Bowl Activities within the City and (c) other governmental services (including, v~nthout limitation, traffic, and public works/street maintenance services) that the City determines are reasonably necessary to protect and promote the public health, safety and welfare, including the NFL, the Teams, the Host Committee and visitors to Super Bowl XLV and any related Super Bowl Activities within the Crty 4 That during the period commencing two weeks pnor to the game through one week following the game, the Crty's Aviation Department will. (a) pernut the NFL to establish information booths identified by appropriate signage at mutually agreeable locations at Fort Worth Meacham International Airport or Fort Worth Alliance Airport, as determined by the City at no cost, expense or liability to the NFL, the Teams or the Host Committee, it being acknowledged that the consideration for such space is the increase in revenue to the City's Aviation Department due to the increase in passenger traffic that Super Bowl XLV will bung to the designated airport; (b) furnish to the NFL a room or other enclosed area of approximately 1200 square feet at a mutually agreeable location at the designated airport to be used by the NFL and the Teams at no cost, expense or liability to the NFL, the Teams or the Host Committee, it being acknowledged that the consideration for such space is the increase in revenue to the City's Aviation Department due to the increase in passenger traffic that Super Bowl XLV will bring to the designated airport; and (c) cooperate with those needing special services in connection v~th the Super Bowl, including arrival/departure of team charters, pnvate planes, special fan charters, and other flights. 5. That the City will not authorize any sponsorships of the City commencing two weeks prior to the game through one week following the game; provided, however, that in no event shall this provision in any way affect then-existing sponsorships of the City 6. That to the best of its knowledge and to the extent permitted by law the City does not believe that there are any local payroll (unemployment and withholding} or local income taxes unposed by the City applicable to NFL or any of rts a~hates (including, without limtation, the thu-ty-two member clubs of the NFL ("Member Clubs"), NFL Ventures, L.P NFL Ventures, Inc., NFL Properties LLC, NFL Enterpnses LLC, NFL International LLC, PLP Ventures Inc. or NFL Productions LLC m the conduct of Super Bowl Activities. 7 That the City recognizes that the NFL will require numerous buses, vans and automobiles ("Official Vehicles") to transport teams, referees, members of the media and other members of the NFL delegation and guests during Super Bowl XLV and its related Super Bowl Activities, many of which will likely be furnished on a temporary basis by official sponsors of the event. If the North Texas Region is designated as the site for Super Bowl XLV during a penod beginning 60 days before and Resolution No 3466-03-2007 ending 30 days after Super Bowl XLV the City shall exempt all Official Vehicles of the NFL from any City licensing requirements and fees. 8. That upon designation of the North Texas Region as the site for Super Bowl XLV the City shall request and use reasonable efforts to have the Department of Homeland Security provide temporary flight restrictions ("TFRs") including without limitation the restriction of sightseeing, media, advertising and other aircraft over and around the stadium selected for the Super Bowl (the `Stadium') within the North Texas Region. The TFRs should be in effect within a 10 nautical mile radius of the Stadium at and below 18,000 feet Mean Sea Level and should be in effect from four (4) hours prior to starting time until two (2) hours after the conclusion of Super Bowl XLV all at no cost, expense or liability to the NFL or the Teams or the Host Committee. 9 That upon designation of the North Texas Region as the site for Super Bowl XLV the City recognizing the unique and temporary status of construction related to the Super Bowl and its Super Bowl Activities, will work with the NFL to facilitate the expedient construction of such temporary structures at all venues throughout the City of Fort Worth related to the Super Bowl and its related Super Bowl Activities. 10. That upon designation of the North Texas Region as the site for Super Bowl XLV the City will use best efforts to coordinate all governmental services wrthm the City with those from other jurisdictions in the North Texas Region, the State of Texas and other appropriate governmental authorities and organizations, and will work cooperatively with the Host Committee to ensure that the North Texas Region is the best possible host of Super Bowl XLV and rts related Super Bowl Activities. 11. That neither the NFL, the Teams, the Host Committee, nor any director, shareholder, officer, agent, employee or other representative of the NFL or the Teams or the Host Committee shall be held accountable for or incur any financial responsibility or liability of any kind or nature whatsoever in connection with the governmental services planned andlor provided by the City and relating to Super Bowl XLV and its related Super Bowl Activities (including without lunrtation law enforcement and public safety services, fire and emergency medical services, construction and permitting services, and coordination with other governmental authorities}. 12. That notvv~thstandmg any provision above that may be construed to the contrary nothing in this Resolution shall be deemed to constitute a financial commitment by the City rt being understood that any and all services or other support to be provided by the City in connection with Super Bowl XLV and related Super Bowl Activities shall be subject to the appropriation of sufficient funds therefore by the City Council, either through the budget for the fiscal year m which such services or support are to be provided or otherwise. 13. That notwithstanding any provision above that may be construed to the contrary nothing in this Resolution shall be deemed to constitute a contractual or other legally binding obligation of the City Resolution No 3466-03-2007 14. That nothing in this Resolution shall be deemed to abrogate, nullify or otherwise affect any existing contractual or legal obligations of the City 15. That this Resolution shall take effect immediately from and after its adoption. AND IT IS SO RESOLVED.
