WHEREAS there are vanous matters concerning employment benefits staff would like to receive
advice and guidance m responding to and.
WHEREAS, because of the extraordinary importance of the issues raised, and because the City seeks to
avoid any conflicts of interest, rt is necessary to retain outside legal counsel to represent
the City m this case, and
WHEREAS James Griffin of the law firm Jackson Walker possesses the required knowledge and
expertise m the labor and employment benefit issues and has agreed to represent the Crty•
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXA5

That James Gnffin, pursuant to Section 3 Chapter VI of the Crty Charter is employed to
represent the City of Fort Worth m the labor and employment issues and to advise the City Attorney in
matters relating thereto
2.
That, as far as pract~crable, the compensation to be paid to James Gnffin for lus services is hereby
fixed m an amount not tosexceed $25 000

SUBJECT.
Adopt Resolution Authorizing Employment of Outside Counsel to Assist the City in Certain Labor
Issues S01 Employment Benefit Issues and the Tax Status Issues of the Employees Retirement
Fund and Adopt Appropriation Ordinance
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to retain James Griffin of the law firm of Jackson Walker as outside counsel
pursuant to Chapter VI Section 3 of the City Charter to assist the City Attorney in representing the City in
regard to the tax status of the Employees Retirement Fund S01 employee issues and certain other labor
issues;
2. Adopt the attached resolution fixing in advance as far as practicable, the amount to be paid to James
Griffin in an amount not to exceed $25 000' and
3 Adopt the attached supplemental appropriation ordinance increasing appropriations in the General Fund
by $25 000 00 and decreasing the unreserved designated fund balance by the same amount.
DISCUSSION
There are legal issues concerning S01 employees and the tax status of the Employees Retirement Fund
as to which staff needs direction from an attorney with tax expertise
Because of the extraordinary importance of the issues raised it is the opinion of the City Attorney that
outside legal counsel with knowledge and expertise in matters involving labor and employment issues be
retained to assist the City Attorney in representing the City
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations and the adoption of the
attached supplemental appropriation ordinance funds will be available in the current operating budget as
appropriated of the General Fund Upon approval, the unaudited unreserved undesignated General Fund
