AN ORDINANCE VACATING AND EXTINGUISHING A
PORTION OF AN ALLEY, LOCATED IN BLOCK 15 OF THE
K.M. VAN ZANDTS 2ND ADDITION, AN ADDITION TO THE
CITY OF FORT WORTH, TAI2R.ANT COUNTY, TEXAS, AS
RECORDED IN VOLUME 388-106, PAGE 117 AND 118 OF THE
PLAT RECORDS OF TAR:[2ANT COUNTY, TEXAS,
CONTAINING APPROXIMATELY 0.184 ACRE OF LAND;
PROVIDING FOR REVERSION OF FEE IN SAID LAND,
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a portion of an alley 500 feet long by 16 feet wide, located in Block 15 of the
K.M. Van Zandts 2"d Addition, an addition to the City of Fort Worth, Tarrant County,
Texas, as recorded in Volume 388-106, Page 117 and 118 of the Plat Records of Tarrant
County, Texas, containing approximately 0.184 acres of land, and as more specifically
described in Exhibits "A" and "B" attached hereto and incorporated herein by reference
be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
A11 existing utility easement be shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Being a 0.184 acre tract ox parcel of land situated and being a portion of Block 1 S, K.M.
Van Zandts 2nd Addition, an Addition to the City of Fort Worth as recorded in Volume
388-106, Page 117 and 118, Plat Records, Tarrant County, Texas and being described
more particularly by metes and bounds as follows:
BEGINNING at the southeast corner of Lot 1 of said Block 15, said point being in the
west right-of-way line of Carroll Street {a 60 foot right-of-way) and being in the north
line of a 1b foot wide alley right-of--way;
THENCE SOUTH with said west right-of--way line, a distance of 16.00 feet for the
northeast corner of Lot 20 of said Block 15 and being in the south Line of said 16 foot
wide alley right-of--way;
THENCE WEST with said south line, a distance of 500.00 feet to the northwest comer of
Lot 11 of said Block 15 and being in the east right-of--way line of Foeh Street (a 60 foot
right-of--way);
THENCE NORTH with said east right-off way line, a distance of 16.00 feet to the
southwest corner of Lot 10 of said Block 15 and being in the north line of said 16 foot
wide alley right-of--way;
TF[ENCE EAST with said south line, a distance of 500.00 feet to the POINT of
BEGINNING and containing 0.1$4 acre, more or less.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating an alley, 500 feet long by 16 feet wide and containing approximately 0.184
acres of land, adjacent to Lots 1-20, Block 15, K.M. Vanzandt 2nd Addition, City of Fort Worth, Tarrant
County, Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624).
DISCUSSION:
Teague Nalt and Perkins, on behalf of Centex Homes and others, has requested to vacate the above
referenced right-of-way and to replat with the adjoining property in order to provide secure private access.
The City Plan Commission recommended approval of this request at its meeting on September 26, 2007.
An acceptable replat (FS-07-248) has been received. Any existing utilities will be relocated at the applicant's
expense, or retained within a designated easement, along with an appropriate plat note that no permanent
structures may be constructed or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This request is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that this action will have no material effect on City funds.
