NO 3492-05-2007
WHEREAS on July 26 2005 City Council approved M&C G-14872 which adopted a
resolution retaining Whitaker Chalk, Swindle & Sawyer L.L.P to aid the
City in the property acquisition process and to secure temporary right of
entries that are required for design work as a part of the Alliance Airport
Runway Extension Project.
WHEREAS to date the cost of legal services by Whitaker Chalk, Swindle & Sawyer
L.L.P in this project has been in the amount of $75 000 and
WHEREAS the relocation of State Highway 156 is a part of the Alliance Airport
Runway Extension Project is ongoing and it is estimated that an additional
amount of approximately $40 000 will be needed for the legal services
necessary to complete this project; and
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH TEXAS
That the compensation authorized to be paid to Whitaker Chalk, Swindle & Sawyer
L.L.P for legal services associated with land acquisition and temporary right of entries for the
State Highway 156 relocation phase of the Alliance Airport Runway Expansion project be
increased by $40 000
That the compensation authorized to be paid to Whitaker Chalk, Swindle & Sawyer
L.L.P for these~serrvices shall not exceed $115 000 00

Adopt a Resolution Authorizing Increasing the Maximum Amount to be Paid to Whitaker Chalk,
Swindle & Sawyer L.L.P to Assist the City of Fort Worth in the Land Acquisitions and
Condemnation Work for the Relocation of FM 156
RECOMMENDATION
It is recommended that the City Council adopt the attached resolution authorizing up to an additional
$40 000 to be paid to Whitaker Chalk, Swindle & Sawyer L.L.P to aid the City in the land acquisitions
including condemnation work for the relocation of FM 156 for a total not to exceed $115 000
DISCUSSION
By adoption of M&C G-14872 the City Council approved Whitaker Chalk, Swindle & Sawyer L.L.P as
legal counsel to aid the City of Fort Worth in the land acquisitions including condemnation work for the
relocation of FM 156 and authorized payment to Whitaker Chalk, Swindle & Sawyer L.L.P for their
services in an amount not to exceed $15 000
On November 15 2005 (M&C G-15004) the City Council authorized an additional sum of $15 000
increasing the amount authorized to be paid to Whitaker Chalk, Swindle & Sawyer L.L.P for its services
not to exceed $30 000
On June 13 2006 (M8~C G-15227) the City Council authorized an additional sum of $15 000 increasing the
amount authorized to be paid to Whitaker Chalk, Swindle & Sawyer L.L.P for its services not to exceed
$45 000
On January 9 2007 (M&C G-15551) the City Council authorized an additional sum of $30 000 increasing
the amount authorized to be paid to Whitaker Chalk, Swindle & Sawyer L.L.P for its services not to
exceed $75 000
It is anticipated that an additional sum of $40 000 will be needed for this project. Accordingly it is
recommended by the City Attorney and the Finance Division that the total amount authorized to be paid to
Whitaker Chalk, Swindle & Sawyer L.L.P for its services be increased to $115 000 FAA grant money will
be used for the legal expenses related to property acquisition
This project is located in COUNCIL DISTRICT 2.

The Finance Director certifies that funds are available in the current capital budget, as appropriated of the
Airport Grants Fund
