HomeMy WebLinkAboutOrdinance 4659 ORDINANCE NO. 17 4 AN ORDINANCE AMENDING ORDINANCE NO. 4581 BY ESTABLISH- ING AND DEFINING A CLASSIFICATION FOR WATER AND SEWERAGE RATE PURPOSES APPLICABLE TO PUBLIC QUARTERS LOCATED ON MILITARY INSTALLATIONS ADJACENT TO THE CORPORATE BOUND- ARIES OF THE CITY OF FORT WORTH; PROVIDING THAT THE CHARGES FOR WATER AND SEWERAGE SERVICE APPLICABLE TO SUCH CLASSIFICATION SHALL BE THE SAME AS THE RATES ES- TABLISHED FOR CONSUMERS LOCATED WITHIN THE CORPORATE LIMITS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND MAKING THIS ORDINANCE CUMULATIVE OF ALL EXISTING OR- DINANCES REGULATING CHARGES FOR WATER AND SEWERAGE SERV- ICE; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EF- FECTIVE DATE. WHEREAS, a substantial portion of Carswell Air Force Base is adjacent to the corporate boundaries of the City of Fort Worth; and, WHEREAS, certain facilities owned by the United States of America housing personnel and dependents of said Carswell Air Force Base are outside the corporate boundaries of the City of Fort Worth; and, WHEREAS, water and sewerage service charges should be as- sessed upon a rate basis as if such facilities were situated with- in the corporate boundaries of the City of Fort Worth, and charges upon such basis are reasonable and proper by reason of equipment and distribution facilities owned by the United States of America which reduce the cost of providing water and sewer- age service to such quarters; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: OFFICIAL RECORD CITY SECRETARY FT. WORTH, TEX. SECTION 1 . The term "public quarters located on military installa- tions adjacent to the corporate boundaries of the City of Fort Worth" shall mean all housing units or projects located upon land owned by the United States of America and operated by the United States Air Force as places of residence for personnel stationed at Carswell Air Force Base, a portion of such Base being with- in or adjacent to the corporate boundaries of the City of Fort Worth. SECTION 2 . From and after the effective date of this ordinance, charges for water and/or sewerage services rendered to public quarters located on military installations adjacent to the cor- porate boundaries of the City of Fort Worth, whether such public quarters are within or without the corporate limits of the City, shall be and are hereby declared to be the same as the rates established or hereafter established for consumers located within the corporate limits of the City, and the minimum charge for such services shall be that applicable to the size of the meter through which water is furnished without regard to the number of living or other units served through such meters. SECTION 3 . This ordinance shall repeal every prior ordinance regu- lating rates for water and sewerage service in conflict herewith, but only insofar as the portion of such prior ordinance shall be in conflict, and as to all other sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. Should any section, clause or provision of this ordinance be declared by a court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be invalid. SECTION 5 . This ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law, and it is so ordained. SUBJECT , Ordinance Prescribing Water and Sewage Rates ------_ for Carswell Air Force Base, Texas TO : Honorable Mayor and Members of the City Council City of Fort Worth Fort Worth, Texas Mrs. McKnight and Gentlemen: 1. My position in asking for the passage of the attached ordinance is based solely on the following facts. a. The entire water distribution system, including all meters, is owned, operated and maintained by Carswell Air Force Base. The only expense incurred by the City of Fort Worth is the reading of our five master meters. b. There are no fire service costs to the city whatso- ever in that all of the fire plugs and other equipment are maintained by Carswell Air Force Base. c. This housing area is located on Federal property which is adjacent to and is an integral part of Carswell Air Force Base. d. This amending ordinance is drawn so restrictively that the city would lose only a small amount of revenue, since we are speaking of Federal Property, Carswell Air Force Base Housing only, and no other privately-owned housing areas. 2. I am attaching a map of our Carswell Housing area so that you can more graphically see the location of the five meters which the city reads, and the wide span of the in- ternal water distribution system which the Federal Govern- ment owns, maintains, and operates at its own expense. 3.
