HomeMy WebLinkAboutOrdinance 4859 6^ ORDINANCE N0. 4Va r,— pFF1CIAl RECORD AN ORDINANCE AMENDING SECTION 126 OF CHAPTER CITY SECRETARY 14 OF THE CODE CF THE CITY OF FORT WORTH, 1950, BEING A PROVISION PROHIBITING THE OPERATION IN CERTAIN AREAS OF VEHICLES DESIGNED OR USED FT. WORTH, TEX. TO TRANSPORT LIQUEFIED PETROLEUM GAS; PROVIDING A SAVINGS CLAUSE; MAKING THIS ORDINANCE CUMU- LATIVE CF OTHER ORDINANCES WITH RESPECT TO THE TRANSPORTING OR STORAGE OF LIQUEFIED PETROLEUM GAS; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; PROVIDING A PENALTY; AND NAMING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 126 of Chapter 14 of the Code of the City of Fort Worth, 1950, be amended, and, after being so amended, it shall read as follows: Sec. 126. Vehicles Designed or Used to Transport Gas Not to Be Driven in Specified Areas Without Permit; Areas Described. No person shall operate a vehicle designed or used for hauling liquefied pertroleum gas in the areas herein- after set forth without having first secured a permit from the Fire Marshal to operate such vehicle in said areas. Each permit issued hereunder shall be effective for a period of time not to exceed seven (7) days from the date of its issuance. No such permit shall be issued until all tanks and containers used for the transporting or storage of liquefied petroleum gas have been emptied and purged by filing with water. The areas referred to are as follows: Area No. 1 The area bounded by the main line of the G. C. & S.F. R.R. on the east; by the north line of Vickery Boulevard on the south; by the east line of Henderson Street on the west; and by the south line of Belknap Street on the north. Area No. 2 The area bounded by Ellis Avenue on the west, 20th Street on the south; Packers Avenue and Packers Avenue projected from 20th Street to 28th Street or Highway 183 on the east; and 28th Street or Highway 183 on the north. r ' SECTION 2. Should any part, section, subsection, paragraph, sentence, clause or phrase contained in this ordinance be held to be unconstitutional, such holding shall not affect the validity of the remaining portion thereof, but in all respects said remaining portion ehall be and remain in full force and effect; and the City Council hereby declares that it would not have passed the unconstitutional part had it known it was invalid and that it would have passed the remaining part that is not invalid. SECTION 3. That this ordinance shall be cumlative of all provisions of the Code of the City of Fort Worth, 1950, with respect to liquefied petroleum gas except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code, in which' instances said conflicting provisions of such Code are hereby repealed. SECTION 4. Any person, firm or corporation violating any of the provisions of this ordinance shall be fined in any sum not to exceed Two Hundred Dollars ($200.00), and each day's violation thereof shall constitute a separate offense. SECTION 5. That this ordinance shall become effective and be in full force and effect from and after its passage and publication as required by law. APPROVED AS TO FORM AND LEGALITY: City Attorney eke r -nib City of Fort Worth, Texas Mayor and Council Communication DATE NUMBER CE suB�Ecr:LIQUIFIED PETROLEUM GAS IN NORTH PAGE 3-18-63 G-442 FORT WORTH BUSINESS & STOCKYARD AREA Iof _ I Section 126, Chapter 14, of the City Code prohibits vehicles equipped for hauling or transporting liquified petroleum gas from being driven into either th® downtown area or the North Fort Worth business and stockyard area unless a permit has- been issued by the Fire Marshal and the trucks' tanks and con- tainers have been emptied and purged by filling with water. This restriction, in' effect, prohibits the use of liquified petroleum gas in these two areas because the only way that the gas can be transported into the areas is by trucks. The restriction was adopted in ordinance form in 1945 because of the explosive and flammable nature of liquified petroleum gas and the potential hazards to life and property connected with its transportation into congested business and mercantile areas., A request has been received from a meat packing firm located in a restricted zone °for permission to install liquified petroleum gas facilities in its plant in North Fort Worth. This request has been studied by the Fire Marshal in connection with a City-wide survey of the need for liquid petroleum gas re- stricted zones currently being made. The Fire Marshal has recently com- ple+ed the survey of the North Fort Worth business and stockyard area and recommends that the restricted area In this locale be reduced. The present restricted area is that bounded by. Ellis Avenue on the west; 20th Street, and 20th Street projected east to the Gulf, Colorado and Sante Fe Railroad on the south; the Gulf, Colorado and Santa Fe Railroad on the east; and 28th Street or Highway No. 183 on the north. The Fire Marshal recommends that the re- striction be reduced to the area bounded by Ellis Avenue on the west; 20th Street on the south; Packers Avenue, and Packers Avenue projected, from 20th_ Street to 28th Street or Highway 183 on the east; and 28th Street or Highway 183 on the north. The trend of City development makes possible the reduc- tion in size of the restricted area. The attached proposed ordinance reduces the restricted area in North Fort Worth as described in the preceeding paragraph. , Further, the ordinance establishes a 7-day period of validity for' permits to drive purged trucks into restricted areas. The ,number of days for which a permit is valid is not presently set by the City Code, and a maximum is needed for effective regulation. It is recommended that the ordinance be adopted.
