DISCUSSION: On September 9, 2003, (M&C P-9850), the City Council authorized the purchase of software assurance maintenance for certain Microsoft licenses to allow individual users to access enterprise wide functions. The City uses a product called Backoffice/Core Client Access License (CAL) for each individual City computer user to access the Exchange, SQL, CFW Domain and SMS servers. Without the CAL licenses, users would not be able to access email, network servers and databases. The software assurance for the Core CAL will expire and it is necessary to purchase the maintenance or City users cannot legally access the various infrastructure servers. Software assurance allows the City to upgrade software licenses as necessary during the term of the agreement. Microsoft has determined that a three-year term is necessary to purchase software assurance. The estimated cost of the CAL licenses is $556,500. The terms of the agreement allow for three annual payments. The Texas Department of Information Resources has established purchase contracts with vendors for technology hardware, software and services. DIR has a contract with SHI-Government Solutions for Microsoft products. The contract was first established in 1999 and was renewed by DIR on September 1, 2003. The SHI-Government Solutions contract pricing for Microsoft software is the most competitive a governmental agency can acquire. On September 2, 2003, the City Council approved M&C P-9845 that authorizes the City of Fort Worth to use the State of Texas DIR procurement process. DIR is authorized to offer competitive purchasing programs to state agencies, public institutions of higher leaming, public school districts and local govemments. DIR has negotiated contracts with Catalog Information Systems Vendors (CISV), ensuring the aforementioned agencies receive a competitive price for procurements. Section 271.083(b) of The Texas Local Government Code, indicates a local government that purchases an item under a state contract or under a reverse auction procedure, as defined by Section 2155.062(d), Government Code, sponsored by the commission satisfies any state law requiring the local government to seek competitive bids for the purchase of the item.
