S O AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL THOSE CERTAIN UTILITY EASEMENTS LOCATED WITHIN BLOCK 1, SOUTHLAND TERRACE ADDITION, BETWEEN COLE STREET AND LOT 1-D, BLOCK 1, SOUTHLAND TERRACE, AN ADDITION TO THE CITY OF FORT WORTH, AS SHOWN ON PLAT OF RECORD IN VOLUME 388G, PAGE 56, PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1. That all those certain utility easements located within Block 1, Southland Terrace Addition, between Cole Street and Lot 1-D, Block 1, Southland Terrace, an Addition to the City of Fort Worth, as shown on Plat of Record in Volume 388G, Page 56, Plat Records of Tarrant County, Texas, be and the same are hereby vacated, abandoned and permanently closed as utility easements . SECTION 2. That the fee to the land in the above described utility easements is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved for all existing utilities including a natural gas line presently located therein. SECTION 3 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Simon W. Henderson, III, and S. M. Page, owners of a residual portion of Block 1, Southland Terrace Addition, being that property located between Lots 1-D, Block 1, Southland Terrace Addition on the west and Cole Street on the east, have requested that the City vacate the following utility easements in the said residue of Block 1: an 8' utility easement located approximately 138' north of Seminary Drive and extending 345' eastward from the east line of said Lot 1-D to Cole Street; an 8' utility easement located approximately 329' west of Cole Street extending from Seminary Drive north 139' to the aforementioned east/west easement; and, a 6' utility easement located approximately 217' west of Cole Street extending from Seminary Drive north 196' . The subject easements were dedicated by a plat recorded in Volume 388G, Page 56, Plat Records of Tarrant County, Texas, and are illustrated by the attached map. The subject easements, acquired by dedication, contain no utilities or other public improvements. City departments and private utility companies have re- viewed this request and have no objection to the proposed vacation. Recommendation It is recommended that an ordinance be adopted vacating, abandoning and closing all those certain utility easements located within Block 1, Southland Terrace Addition, between Cole Street and Lot 1-D, Block 1, Southland Terrace Addition.
