WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated January 27, 2005, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $30,038.00. 2. The additional services are as described below. A detailed breakdown of the proposed fee for these additional services is also attached. LOPEZGARCIA GROUP — ADDITIONAL SERVICES I. Iggroupinc.com 7 Additional Surveying Services A. 30th Street - Columbus Avenue — Angle Avenue 8" Water Line — Per the City's request, the dead end water line which ends in Angle Avenue, approximately one-half block northwest of the Columbus Avenue — Angle Avenue intersection, is to be extended northwest to the Loving Avenue — Long Avenue — Angle Avenue intersection and connected to the 6" water line in Loving Avenue. Also per the City's request, the dead end water line which ends in Columbus Avenue, mid-block south of 31 st Street, is to be extended south to 30th Street and then west in the right-of-way of 30th Street to a connection to the 6" water line in Loving Avenue. Angle Avenue survey extension = 360 LF Columbus Ave. — 30th St. survey extension = 840 LF B. Sanitary Sewer M-111 Relocation — The City has requested that the section of Sanitary Sewer M-111, from Sta. 33+39 to Sta. 36+54, which crosses Crump Street between existing homes north of 36th Street, be relocated to 36th Street. The relocated sanitary sewer will extend approximately 185' north , from a new manhole on existing Sanitary Sewer M-111 at Sta. 29+g'7.50 (in the alley west of Crump Street), to a new manhole in 36th Street (Sta. 32+�2). From this manhole the relocated sanitary sewer extends east along 36th Street, approximately 315' to a new manhole (Sta. 34+g�) in 36th Street, to the alley east of Crump Street. January 27, 2005 Page 2 of 4 Alley west of Crump St - 36th Street - Alley east . of Crump Street survey = 765 LF Because the old alignment for Sanitary Sewer M-111 is being abandoned, the services for three of the four lots adjacent to this section of sewer will require relocation. A lot survey of a portion these three lots showing all improvements is required. C. Sanitary Sewer L-3489 Relocation (Extension of Sanitary Sewer L-4445) - The City has requested that the section of Sanitary Sewer L-3489 which crosses the Diamond Hill-Jarvis High School campus, from 35th Street to Maydell Street, be relocated to 35th Street and Decatur Avenue. The relocated sewer will extend west from a new manhole in 35th Street, at Sta. 8+52 on Sanitary Sewer L-3489, to Decatur Avenue and then south in Decatur Avenue to a new manhole at Sta. 14+02.30 on Sanitary Sewer M-117 at 34th Street. 35th Street — Decatur Avenue survey = 1465 LF Because the old alignment for Sanitary Sewer L-3489 across the Diamond Hill/Jarvis High School campus is being abandoned, two sewer services connections to this section of sewer will require relocation. A survey of the improvements on the northeast portion of the Diamond Hill/Jarvis Public Library site and of a small portion of the school site immediately east of the library will be required. Total Additional LGGROUP Surveys = 3430 LF + Lot Surveys II. The location map and control sheet showing the location for the 8" V��ater Line replacement in Columbus Avenue will be revised to shcw the extension of the water lines at both the north and south ends of the project. 3. 'The location map and control sheet showing the location for the 8" Sanitary Sewer M-111 replacement and the 8" Sanitary Sewer L-4445 replacement will be revised to show the new locations for these sewers C. Additional Coordination with Utility Companies — Utility companies will be contacted again to obtain information about the additional areas included in the water line extension on Columbus Avenue and the relocation of Sanitary Sewers M-111 and L-3489. D. Coordination with Subconsultant — Additional coordination will be required with the subconsultant (EJES, Inc.) to complete the construction plans and specifications. EJES INC. — ADDITIONAL SERVICES 1. Additional Engineering Design Services 1. Sanitary Sewer M-111 Relocation — The City has requested the section of Sanitary Sewer M- 111, from Sta. 33+39 to Sta. 36+54, which crosses Crump Street between existing homes north of 36th Street, be relocated to 36th Street. The relocated sanitary sewer will extend approximately 215' north, from a new manhole on existing Sanitary Sewer M-111 at Sta. 29+g'7,50 (in the alley west of Crump Street), to a new manhole in 36th Street. From this manhole, the relocated sanitary sewer extends approximately 360' east along 36th Street to a new manhole in the alley east of Crump Street. From this point the relocated sanitary sewer will extend north approximately 190' in the alley east of Crump Street to connect to the existing Sanitary Sewer M-111 alignment at a new manhole at Sta. 36+52. This section of the relocated Sanitary Sewer M-111 has been relabeled M-111R. This additional design work will require a totally revised sheet in the construction plans. For the old alignment, approximately 40% of the design was completed (for the Conceptual Phase). Therefore, design services for the new alignment will require additional design effort to bring the engineering design up to the 40% stage of completion. Also, in order to determine if the relocation of Sanitary Sewer M-111 was feasible, the engineer was required to coordinate with SBC to pump out their manholes in 36th Street, so the depth of the SBC conduits could be determined. This coordination effort took more time and effort than is normally required. 2. Sanitary Sewer L-3489 Relocation (Extension of Sanitary Sewer L-4445) - The City has requested that the section of Sanitary Sewer L-3489 which crosses the Diamond Hill-Jarvis High School campus, from 35th Street to Maydell Street, be relocated to 35th Street and Decatur Avenue. January 27, 2005 Page 4 of 4 Sewer L-4445 currently extends north al�ng Decatur Avenue, from the manhole at Sta. 14+02.03 on Sanitary Sewer M-117 to an end of line manhole at Sta. 4+79, which is just south of 35th Street. The newly relocated sanitary sewer in Decatur Avenue and 35th Street is an extension of Sanitary Sewer L-4445 and has been relabeled L-4445R. The additional design work will require the removal of the plan and profile sheet showing the replacement of Sanitary Sewer L-3489 across the high school campus and the addition of two new plan and profile sheets to the construction plans. For the old alignment, approximately 40% of the design was completed on one plan and profile sheet (for the Conceptual Phase). Design services for the new alignment will require additional effort to develop the engineering design to add two completely new plan and profile sheets to the plans. HUGO TREVINO AND ASSOCIATES, INC. — ADDITIONAL SERVICES 1. Additional Reproduction Services The revisions that the City has requested, require two (2) sheets be added to the construction plans. We therefore request a contract amendment to increase the lump sum fee amount by $30,038.4'7. Of this amount, $8,957.68 is the increase in fee amount for engineering design services to be provided by EJES, Inc. and $452.00 is the increase in fee amount for reproduction services to be provided by Hugo Trevino And Associates, Inc. Also, of the $30,038.47 total fee increase for Amendment No. l, $14,547.50 is the increase in fee amount for surveying services to be provided by LOPEZGARCIA GROUP and $6,081.29 is the increase in fee amount for engineering design services to be provided by LOPEZGARCIA GROUP. Authorize the transfer of $30,038.00 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of $8,894.00 and the Sewer Capital Project Fund in the amount of $21,144.00; 2. Adopt appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $8,894.00 and the Sewer Capital Project Fund in the amount of $21,144.00 from available funds; and 3. Authorize the City Manager to execute Amendment No. 1 to City Secretary Contract No. 30321 with LopezGarcia Group, Inc., in the amount of $30,038.00, to provide for additional design and survey services, thereby increasing the contract amount to $154,147.00. DISCUSSION: On July 20, 2004 (M&C C-20158), the City Council authorized the City Manager to execute an engineering agreement with LopezGarcia Group, Inc., in the amount of $124,109.00 for the design of Water and Sanitary Sewer Replacement Contract 2004 STM-B. In order to increase the level of water service delivery to customers, it is necessary to extend and connect (loop) two existing dead end water mains located on Angle Avenue and Columbus Avenue to an existing water main located on Loving Avenue. The amendment will also allow for the relocation of sanitary sewer lateral L-3489 and sewer main M��11 which currently traverse across private property near 35th Street and 36th Street, to be relocated into public right-of-way on the identified roadways. All connecting sewer service lines will be relocated to the new sewer mains. . LopezGarcia Group, Inc., proposes to provide the necessary additional engineering services for a lump sum fee of $30,038.00. Staff considers this. amount to be fair and reasonable. This project is located in COUNCIL DISTRICT 2, Mapsco 48Y, 63A and 77A.
