AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN TRANSPORTATION IMPACT FEE FUND IN THE
AMOUNT OF $650,000.00,FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
FUNDING THE CONSTRUCTION OF WEST BAILEY BOSWELL ROAD FROM
WIND RIVER DRIVE TO OLD DECATUR ROAD.; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH;AND PROVIDING AN EFFECTIVE DATE.
BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Transportation Impact Fee Fund in the amount of$650,000.00, from available funds, for the purpose of
funding the construction of West Bailey Boswell Road from Wind River Drive to Old Decatur Road.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 22394-09-2016 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Execution of Amendment No. 1 to City Secretary Contract No. 48582, a Community Facilities
Agreement with Bailey Boswell Marketplace LP, in the Amount of$968,393.60 Which Includes Additional
City Participation in an Amount Not to Exceed $554,813.51, to Construct West Bailey Boswell Road from
Wind River Drive to Old Decatur Road, and Adopt Appropriation Ordinance (Transportation Impact Fee
Funds) (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Transportation Impact Fee Fund in the amount of$650,000.00 from available funds; and
2. Authorize the execution of Amendment No. 1 to City Secretary Contract No. 48582, a Community
Facilities Agreement with Bailey Boswell Marketplace LP, in the amount of$968,393.60 which includes
additional City participation in an amount not to exceed $554,813.51 to construct West Bailey Boswell
Road from Wind River Drive to Old Decatur Road.
DISCUSSION:
On September 29, 2015, the City Council authorized the execution of a Community Facilities Agreement
(CFA) with Bailey Boswell Marketplace LP, with City participation in an amount of up to $1,342,556.38 for
the oversizing of West Bailey Boswell Road (M&C C-27494). The amount of the City's participation was
based on the engineer's estimate of construction costs, including a 10 percent contingency. The project
was publicly bid and the final bid amount was $968,393.60 over the engineer's estimate. Amendment No.
1 to the CFA will increase the total CFA amount and City participation to reflect the actual bid
amount. This amendment provides for additional City participation up to $554,813.51, of which
$484,196.80 is for construction costs and $70,616.71 is for engineering services. The Developer is
providing the initial funding for the construction and the City is reimbursing its share of the construction
costs through periodic draws.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon the approval of the above recommendation and the adoption of
the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated,
of the Transportation Impact Legacy Fund.
