V- AN ORDINANCE AMENDING SECTION 37-26A OF THE FORT WORTH CITY CODE (1964) ; ALTERING FRONT FOOTAGE CHARGES FOR SERVICE CONNECTIONS MADE TO CERTAIN WATER MAINS CON- STRUCTED AFTER OCTOBER 1, 1961; ALTERING FRONT FOOTAGE CHARGES FOR CERTAIN SERVICE CONNECTIONS MADE TO SANITARY SEWERS AUTHORIZED FOR CONSTRUCTION AFTER OCTOBER 1, 1964, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PRO- VIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. Chapter Section 37-26A of the Fort Worth City Code (1964) is hereby amended to read as follows: "Sec. 37-26A. Front footage charges for service connections - water - sewer. (a) In addition to other connection charges provided in this chapter a front footage charge shall be paid for all water service connections made from and after the effective date hereof to all water mains constructed after October 1, 1961 except connections to service "single customers" and except connections to on-site mains for which the City has previously received payment from a developer. (b) In addition to other connection charges provided in this chapter a front footage charge shall be paid for all sewer connections made from and after the effective date hereof to sanitary sewers authorized for construc- tion after October 1, 1964, except connections to service "single customers" and except service connections to on-site sanitary sewers for which the City has previously received payment from a developer. (c) The following definitions shall be used in interpret- ing this section: (1) single customer: an existing occupied residen- tial establishment or an existing commercial establishment. (2) developer: any type of new customer other than a "single customer". (3) commercial establishment: any establishment other than a one- or two-unit residence. (4) front footage: the number of lineal feet in that portion of a property boundary abutting a street, alley or easement containing a sanitary sewer or water facility for which front footage charges are collected for connection. In the case of an easement containing a sanitary sewer for which front footage charges are collected for connection, which sewer crosses through the pro- perty served, the "boundary" on which the front footage charge is to be based shall be the length of the sewer within the limits of such property measured along the center line of such sewer. Front footage to be used in application of front footage charges shall be determined as follows: (i) The front footage charge shall apply directly to property platted into the usual rec- tangular lots or tracts of land except that the maximum front footage to be used in determining a charge to be made for the connection of a one-unit or a two-unit residence shall be 100 feet. (ii) Where the property served is irregular in shape, the front footage shall be computed as one-sixth of the perimeter of such property, except that in no case shall the charge for a one-unit or a two-unit residence on such property be based on a front footage in excess of 100 feet. A front footage charge will be due each time a connection is made to a different water or sewer facility from such irregular shaped lot or tract. (iii) On property which is retangular in shape and has more than one boundary abutting a street, alley or easement containing a sanitary sewer or water facility serving the property, only that boundary across which a connection is effected will be used in determining front footage charges, ex- cept as provided under (i) and (ii) above. (iv) Where one or more residences other than "single customers" are located on an unsubdivided tract, each such residence shall be charged for a front footage of 100 feet, with the provision that if the property is later subdivided into lots, each lot requiring additional connection to a sanitary sewer or water facility will be charged for front footage in the usual manner. Commercial property will be charged on the basis of actual front footage as defined above under (i), (ii), and (iii) . 2. (d) The amount of the front footage charge to be made for each service connection to a water main under this section shall be $5.00 per front foot. (e) The amount of the front footage charge to be made for each service connection to a sanitary sewer main under this section shall be $4.50 per front foot. (f) The applicable front footage charges required hereunder for water or sanitary sewer service connections shall be paid before plumbing permit can be issued. SECTION 2. This ordinance shall repeal every prior ordinance and provision of the Fort Worth City Code in conflict herewith but only insofar as the portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3. If any section, part of a section or provision of any section of this ordinance shall be held to be void, ineffective or unconstitutional by a court of competent jurisdiction, the holding of such section, part of a section or provision of any section to be void, ineffective or unconstitutional for any cause whatsoever shall in no way affect the validity of the remaining sections and provisions of this ordinance, which shall remain in full force and effect. The City Council would not have passed any sections, parts of sections or pro- visions of any section of this ordinance that were unconstitutional, void or ineffective if it had known that they were unconstitutional void or ineffective at the time of adopting this ordinance. SECTION 4. The violation of any provision of this ordinance or of any provision of 3. the Fort Worth City Code relating to water or sewer service connection charges shall be deemed an offense and shall be punishable by a fine not exceeding Two Hundred Dollars ($200) , and each violation thereof and each day that there is a failure to comply with the terms of this ordinance shall be and is hereby deemed to be a distinct and separate offense and punishable as such. SECTION 5. The effective date of this ordinance shall be October 1, 1974. These charges are intended to recover eighty percent of the costs of con- structing these extensions (except for the initial 100 feet for extensions to single customers) . In addition, front foot charges at current rates are inadequate to equitably refund excess payments by developers from subsequent connections, as intended by the policy provisions. The current front foot charges are: For Water Mains: $2.50/front foot For Sanitary Sewers: 2.00/front foot In an attempt to simplify water and sanitary sewer extension policies, matte them more similar in application, and bring single customer and developer cost participation more in line with current cost trends, examinations were made of extension costs under developer-let contracts and extension costs on projects constructed by City forces. Analyses of the results of those examinations follow. Historical Costs: 1971-74 and 1973-74 Under Contracts Let By Developers: Under developer-let contracts for the period beginning December 10, 1970, and extending through May 20, 1974, the study indicated that, while the cost per connection served to the developer for water service ranged from a low DATE REFERENCE SUBJECT: Proposed New Water and PAGE NUMBER Sanitary Sewer Extensions Charges 2 & 5 9/16/74 G-2507 of -$156 to a high of $703, the average developer expenditure per connection, served was $304. This analysis further indicated that the developer was paying approximately seventy-eight percent of the cost of providing water mains to serve his development, while the City was paying approximately twenty-two percent of such cost, including over-size mains. Analysis of information relating only to projects completed in 1973-74 revealed that while relative cost percentages did not change, the developer's average cost per connection rose to $326. per connection. In the case of sanitary sewers constructed under developer contracts let in the same period of time, it was found that the cost per connection to the developer for sanitary sewers to serve his development ranged from a low of $103 to a high of $875, and the average developer expenditure per connection for sanitary sewer main service was $267 per connection. This expenditure represented approximately seventy-nine percent of the cost of providing such sewer facilities, while the City paid twenty-one percent of such cost in- cluding over-size mains., Analysis of information relating only to projects completed in 1973-74 revealed that while relative cost percentages did not change, the developer's average cost per connection rose to $282 per con- nection. Analysis of typical lot frontages on 1191 of the 2205 connections included in the review of developer-let contracts indicated an average front footage of 71 feet. On this basis, the average front foot cost to the developer in the most recent (73-74) period for water main extensions was $4.59 per front foot, and $3.97 per front foot for sanitary sewer extensions. Extensions Constructed by City Forces: 197174 and 1973-74: During the entire period only 5 water projects were completed using 4-inch pipe, with an overall average cost per foot of $7.58. As is, indicated by these statistics, the 4-inch main size is used only in isolated instances, such as in short cul-de-sacs with not more than 6 potential connections. Basically, the 6-inch water main is the standard minimum size. Therefore, only 6-inch and 8-inch main extensions costs can be considered as fairly representative of actual costs of main extensions constructed by City forces to serve new developments. For these reasons, 4-inch main costs were not included in the actual costs analyses from which recommendations were formulated. DATE REFERENCE SUBJECT: Proposed New Water and PAGE NUMBER 9/16/74 NUMBER Sanitary Sewer Extensions Charges 3 _ ,f _ Based on developers paying eighty percent of actual construction costs plus design engineering costs, as developers pay on water and sewer extensions constructed by contract, developers costs in the most recent (1973-74) period would have averaged: For Water Mains: $11.08 X' 1.1* X 0.80 = $ 9.75/ft. For Sanitary Sewers: $8.50 X 1.1* X 0.80 = $ 7.48/ft. *Design engineering allo�ance of ten percent of construction cost. Since the short extensions made by City forces are virtually all constructed in streets subject to connectionfrom either side, front footage benefitted is essentially twice the length of the extension. Therefore, the developers front foot costs would have been: For Water Mains: $ 4.88/front foot For Sanitary Sewers: $ 3.74/front foot (The foregoing computation assumes the developer owns all the bene- fitted front footage. If not, his costs per front foot of his pro- perty would be higher, subject to receipt of front foot refund pay- ments by others for future connections) . (2) A ten percent engineering charge is included in these costs as computed, but no paving repair or boring costs are included. Proposed Revised Front Foot Charges Since there are no major differences between City forces extension costs and contract extension costs, and. the contract extension costs represent a much broader base of construction footage and size range, it is proposed to establish front foot charges based on developer costs for construction by contract as a means of a more reasonable assurance of a return of a devel- oper's off-site water main cost. Therefore, allowing a' ten percent anti- cipated escalation figure, and rounding to the nearest one-half dollar, the proposed new front foot charges would be: For Water: $ 5.00 For Sanitary Sewer: $ 4.50 Proposed Revised Single Customer and Developer Extension Charges Since, as mentioned before, City forces water and sewer extension casts per foot are essentially double front foot costs, proposed charges to developers I DATE REFERENCE SUBJECT: Proposed New Water and PAGE NUMBER Sanitary Sewer Extensions Charges 4 of - 5 9/16/74 G-2507 and "single customers" for water and sewer extensions, exclusive of paving repairs and boring costs, would be: Developer Extension Single Customer Cost Facility Cost Per Foot Per Excess Foot Water $10.00 $10.00 Sanitary Sewer 9.00 9.00 In the case of "single customers", the indicated costs would apply to all footages over 100 feet per customer served by the extension, and no other extension costs would be charged. In the case of developers, eighty per- cent of the costs of boring and/or paving repairs would be charged in addi- tion to the indicated per foot charges. Summary of Proposed Changes Single Customer Extensions: It is proposed to increase the front foot charges for water to $5.00 and for sanitary sewer to $4.50 per front foot, increase the excess footage costs for water and sewer extensions to $10.00 per excess foot for water and $9.00 per excess foot for sewer, and leave the single customer extension policy otherwise unchanged. Developer Extensions: It is proposed to establish charges of $10.00 per foot for water main ex- tensions by City forces and $9.00 per foot for sanitary sewer extensions by City forces. Such charges would apply without respect to size through 8-inch water or sanitary sewer facilities. Developers would be charged eighty percent of City staff estimates for construction of larger facilities, plus a ten percent engineering charge. Eighty percent of the estimated cost of street repairs and/or boring costs would be added to the computed devel- oper cost share in all cases. The developer extension policy would remain unchanged otherwise. Recommendations It is recommended that: 1) The Water and Sanitary Sewer Installation Policy be amended to provide charges of $10.00 per foot for water main extensions by City forces to serve new developments; $9.00 per foot for sani- tary sewer extensions by City forces to serve new developments; $10.00 per excess foot for single customer water extensions, and $9.00 per excess foot for single customer sanitary sewer extensions, effective October 1, 1974, on all projects on which community facility agreements or arrangements are approved after that date; and f DATE REFE ERCE SUBJECT: Proposed New Water and PAGE NUM 9/16/74 G-2507 Sanitary Sewer Extensions Charges 5 of 5 2) The ordinance prepared by the staff establishing front foot charges of $500 per front foot for water service connections and $4.50 per front foot for sanitary sewer service connections, be approved, appropriately amending Chapter 37-26A of the Fort Worth City Code, such amendment to take effect as of October 1, 1974.
