WI~12>EAS, the zoning ordinance establishes regulations for off street parking
and loading including the amount of parking allowed, location, maneuvering and other
development standards; and
WHEREAS, these regulations provide uniform development of off-street parking
and loading throughout the City which minimize any detrimental effects on adjacent
properties and on the environment; and
WHEREAS, the City Council finds that the regulations in Article 2 "Off-Street
Parking and Loading" should be applicable to both the minimum required parking to be
provided and any parking provided in excess of the minimum; and
WHEREAS, the City Council finds that in order to lessen the detrimental effects
ofoff-street parking on the environment the installation of pervious parking surfaces
should be permitted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS AS FOLLOWS:
SECTION 1.
Section 6.200.A. "General Requirements" of Article 2, "Off-Street Parking and Loading"
of Chapter 6, "Development Standards" of Ordinance Number 13896, the Zoning
Ordinance of the City of Fort Worth, is amended to require the parking regulations in
Article 2 apply to the minimum required parking and any additional parking provided,
and to read as follows:
Sec. 6.200 General Requirements
A. The regulations in this Article shall apply to required parking spaces and non-
required parking spaces with the exception of public parks. Nothing in this
Article shall require additional parking spaces to be furnished for an existing
building that is repaired, altered, maintained, or modernized, where no structural
alterations have been made and the size of the building is not increased.
SECTION 2.
Section 6.202.E, "Parking Surfaces" of Article 2, "Off-Street Parking and Loading" of
Chapter 6, "Development Standards" of Ordinance Number 13896, the Zoning Ordinance
of the City of Fort Worth, is amended to require all drives and parking spaces to be hard
surfaced and dust free, with some exceptions, to read as follows:
Sec. 6.202. E. Parking Surface
1. Minimum required parking spaces must be hard-surfaced and dust free, except in
instances where the adjacent street is unpaved, in which case the drives and
parking spaces shall be hard-surfaced within one year after all adjacent streets are
paved. Fire lanes and ADA spaces may not be constructed with porous surfaces.
4. Hard surface parking is not required for:
a. non-passenger vehicles and tractor trailers for industrial uses, and
b. motor vehicle inventory for sale.
All parking must be, at a minimum, on a compacted gravel base.
SECTION 3.
Chapter 9 "Definitions" of Ordinance No. 13896, the Zoning Ordinance of the
City of Fort Worth is hereby amended to add defmitions for "Hard Surface (Parking)",
"Porous Surface (Parking)", and "Driveway" to read as follows:
HARD-SURFACE (PARKING): Any porous or non porous surface suitable for
the function of driving and parking of vehicles; non porous surfaces are typically asphalt
and concrete.
POROUS SURFACE (PARKING): A parking surface constructed of materials
that permit water to enter the ground by virtue of their nature or by large spaces in the
material, such as pre-cast and mold in-place concrete blocks, concrete grids, interlocking
bricks, and plastic mats with hollow rings, hexagonal cells or porous concrete.
DI7IVEWA~': Any hard surface parking area that provides access to private
property from the right-of--way to the required off site parking behind the building line.
A residential driveway may consist of compacted gravel base confined by a border.
SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code are hereby
repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 6.
Any person, firm, or corporation, who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the provisions of this
ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each
offense. Each day that a violation exists shall constitute a separate offense.
SECTION 7.
All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to
any and all violations of the provisions of Ordinances No. 3011, 13896 and any other
ordinances affecting zoning which have accrued at the time of the effective date of this
ordinance, and, as to such accrued violations and all pending litigation, both civil and
criminal, whether pending in court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 8.
The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish
the caption, penalty clause and effective date of this ordinance for two (2) days in the
official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013,
Texas Local Government Code.
SECTION 9.
This ordinance shall take effect upon adoption and publication as required by law.
