HomeMy WebLinkAboutResolution 3321-03-2006A Resolution NO 3321 -03 -2006 AUTHORIZING THE CLOSURE OF THE A PORTION OF THE 1100 BLOCK OF NORTH COMMERCE STREET AT THE FORT WORTH AND WESTERN RAILROAD CROSSING WHEREAS, The City of Fort Worth desires to physically close the 1100 Block of North Commerce Street in the North Fort Worth Addition, from a point 150 feet south of Northeast 11th Street to a point 40 feet north of Northeast 10th Street being approximately 380 feet long, 75 feet wide and containing 28,500 square feet, more or less, WHEREAS, the Plan Commission of the City of Fort Worth has reviewed this request and recommends that the request be approved, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the existing street, a portion of the 1100 Block of North Commerce Street at the Fort Worth & Western Railroad crossing (DOT No 672 932B railroad milepost 736 68), and as more specifically described in Exhibit A, attached hereto and incorporated herein, be physically closed with a barricade, with the City of Fort Worth to retain title to the public right -of way in said street, retaining any and all easements for existing and prospective utilities, and retaining the right of access at all times for the purpose of maintaining existing and prospective utility facilities located in the aforesaid portions of said street. The City reserves the right, at the sole discretion of the City Council, to reopen by resolution the aforesaid street right -of way to public travel at any time by directing the removal of the aforesaid barricade, reconstruction of the roadway and the installation of appropriate railroad traffic control devices. i , 2006 r t APPROVE['° 4 CITY COWI MAR 2 1 1.No city Secretar", City of Fort y Y; City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 3/21/2006 Resolution No 3321 -03 -2006 DATE Tuesday March 21 2006 LOG NAME 20FWWR COMMERCE REFERENCE NO * *G -15113 SUBJECT Adopt a Resolution to Close a Portion of North Commerce Street to Remove the Railroad Crossing RECOMMENDATION It is recommended that the City Council adopt the attached resolution closing a 75 -foot wide by 380 -foot long portion of the 1100 block of North Commerce Street, between Northeast 10th Street and Northeast 11th Street, within the North Fort Worth Addition Fort Worth Texas. Actual physical closure is recommended adjacent to both sides of the Fort Worth & Western Railroad company (FWWR) crossing DISCUSSION As a result of a February 2005 settlement between the City of Fort Worth and the FWWR, the City is obligated to close two railroad crossings by March 31 2006 This FWWR railroad grade crossing on North Commerce Street was evaluated by TPW for traffic access and for emergency vehicle access. TPW recommended closing the road to promote safety by eliminating the railroad crossing The request to close this portion of North Commerce Street was recommended for approval by the City Plan Commission on February 22 2006 Reviewing City departments have no objection to this request.
