AN ORDINANCE VACATING AND EXTINGUISHING A AN
ALLEY, LOCATED IN BLOCK 15 OF THE SEMINARY HILL
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 310,
PAGE 45 OF THE PLAT RECORDS OF TAP;RANT COUNTY,
TEXAS, BEING 15 FEET WIDE BY 600 FEET LONG;
CONTAINING APPROXIMATELY 9,000 SQUARE FEET OF
LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND,
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That an alley 15 feet wide by 600 feet long, located in Block 15 of the Seminary
Hill Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded
in Volume 310, Page 45 of the Plat Records of Tarrant County, Texas, containing
approximately 9,000 square feet of land, and as more specifically described in Exhibits
"A" and "B" attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

VACATION OF A 15' WIDE
PUBLIC ALLEY R.O.W.
BEING a 15-foot wide public alley right-of-way within Block 15, Seminary Hill Addition
to the City of Fort Worth, Texas according to the plat recorded in Volume 310, Page 45 of
the Plat Records of Tarrant County, Texas and more particularly described by metes and
bounds as follows:
BEGINNING at a 5/8-inch iron and found at the Northwest corner of said alley right of-
waybeingthe most Easterly Northeast corner of Lot A, Block 14-R, Seminary Hill
Addition to the City of Fort Worth, Texas according to the plat recorded in Volume 388-
116, Page 30 of the Plat Retards of Tarrant County, Texas and lying. in the South right-of-
way line of Spurgeon Street;
'1T~NCE EAST, 15.00 feet along the said South right-off way line of Spurgeon Street to a
1/x-inch iron rod set at its intersection with the East right-of way line..of.said..alley bein.g_th~
Northwest corner of Lot 24, aforesaid said Block 15;
TI~NCE SOUTH, 600.00 feet along the East right-of , line of said alley to a 1/2-inch
ixon rod found at its intersection with the North right-af-way line of lc Avenue, being
the Southwest corner of Lot 13, said Block 15;
THENCE WEST, 15.00 feet along the said North rightof--way line of said Fuller Street to
a %2-inch iron rod set at its intersection with the West right-af--way line of aforesaid alley;
THENCE NORTH, 600.04 feet along the Westright-of-way line of said alley to the
PLACE OF BEGINNING, containing 9,000 square feet of land.

Adopt Ordinance Vacating an Alley, 600 Feet Long by 15 Feet Wide, Containing Approximately
9,000 Square Feet, Located within Block 15, Seminary Hill Addition, from Spurgeon Street to Fuller
Avenue in the City of Fort Worth, Tarrant County, Texas, and Waive Purchase Fees
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating an alley, 600 feet long by 15 feet wide, containing approximately 9,000
square feet, located within Block 15, Seminary Hill Addition, from Spurgeon Street to Fuller Avenue in the
City of Fort Worth, Tarrant County, Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624).
DISCUSSION:
Coombs Land Surveying, on behalf of the Southwestern Baptist Theology Seminary, has requested to
vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property. The
applicant. plans to use the area for a new parking lot for the Seminary campus. The City Plan Commission
recommended approval of this request at its meeting on May 28, 2008. An acceptable replat (FS-08-105)
has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a
designated easement, along with an appropriate plat note that no permanent structures may be constructed
or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This right-of-way is located in COUNCIL DISTRICT 9.

The Finance Director certifies that this action will have no material effect on City funds.
