AN ORDINANCE VACATING AND EXTINGUISHING
NAUTICAL DRIVE, A NAMED EMERGENCY ACCESS
EASEMENT LOCATED IN THE NEWPORT VILLAGE AT
TRINITY ADDITION, AN ADDITION TO THE CITY OF FORT
WORTH, TARItANT COUNTY, TEXAS, AS RECORDED IN
CABINET A, SLIDE 6701 OF THE PLAT RECORDS OF
TAI2RANT COUNTY, TEXAS, CONTAINING APPROXIMATELY
59,103 SQUARE FEET OR 1.357 ACRES OF LAND; PROVIDING
FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT
THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Nautical Drive, a named emergency access easement, located near the
intersection of Trinity Boulevard and FM 157 in the Newport Village at Trinity Addition,
an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Cabinet A,
Slide 6701 of the Plat Records of Tarrant County, Texas, containing approximately
59,103 square feet or 1.357 acres of land, and as more specifically described in Exhibits
"A", "B" and "C" attached hereto and incorporated herein by reference be and the same
is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right of way is
hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easement be shall be retained by the City until such time all
utilities located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a portion of the Final Piat of Newport Village at Trinity, an Addition to the City of Fort
Worth, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 6701, Plat
Records, Tarrant County, Texas, and being mare particularly described by metes and bounds

BEG[NNING at a point in the intersection of the north right-af-way line of Trinity Boulevard with
the southern most comer of Nautical Drive and the beginning of a curve to the left, of which the
radius point lies South 88 degrees 51 minutes 54 seconds West, a radial distance of 20.00 feet;
thence northerly along the arc, through a central angle of 33 degrees 13 minutes 46 seconds, a
distance of 11.60 feet to a point;
THENCE North 35 degrees 09 minutes 12 seconds West, a distance of 7.79 feet to a point and
the beginning of a curare to the left;

Adopt an Ordinance Vacating Nautical Drive, a Named Emergency Access Easement, within
Newport Village at Trinity, Near the Intersection of Trinity Boulevard and FM 157, in the City of Fort
Worth, Tarrant County, Texas, and Waive Purchase Fees
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a named emergency access easement, Nautical Drive, 27 feet wide and
containing approximately 59,103 square feet, located within the Newport Village at Trinity addition, near the
intersection of Trinity Boulevard and FM157, in the City of Fort Worth, Tarrant County, Texas; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624).
DISCUSSION:
ION Design Group, on behalf of Newport Holdings, Inc., has requested to vacate the above referenced
access easement and to replat into the adjoining property. Nautical Drive is being relocated. The City Plan
Commission recommended approval of this request at its meeting on June 25, 2008. An acceptable final
plat (FP-05-005) has been received. Any existing utilities will be relocated at the applicant's expense, or
retained within a designated easement, along with an appropriate plat note that no permanent structures
may be constructed or placed thereon.
The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process.
The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds
have been expended to purchase property or easement rights, collection of the fee value or any portion
thereof is recommended by staff to be waived.
This request is located in COUNCIL DISTRICT 5.
