COUNTY OF TARRANT $
WHEREAS, the City of Fort Worth (City) and Kimley-Horn and
Associates, Inc. , (Engineer) made and entered into City Secretary
Contract No. 29706, (the Contract) which was authorized by the City
Council by M&C C-20000 on the 23th day of March 2004; and
WHEREAS, the Contract involves engineering services for the
following project:
Sanitary Sewer Rehabilitation Contract LXX (70)
WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to 'include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Article I, of the Contract is amended to include the addition-
al engineering services specified in M&C C-20334, adopted by the
City Council on 12th day of October 2004, and further amplified in
a proposal letter dated August 16, 2004, copies of which are both
attached hereto and incorporated herein. The cost to City for the
additional services to be performed by Engineer total $62,629.50.
2.
Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $471,079.50.
ORIGINAL.

All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

Amendment No. 1 to the Engineering Agreement with Kimley-Hom and Associates, Inc. for Sanitary
Sewer Rehabilitation Contract LXX (70)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to City
Secretary Contract No. 29706 with Kimley-Hom and Associates, Inc. in the amount of$62,629.50 to provide
for additional design and survey services, thereby increasing the contract amount to $471,079.50.
DISCUSSION:
On March 23, 2004 (M&C C-20000), the City Council authorized the City Manager to execute an
engineering agreement with Kimley-Hom and Associates, Inc., in the amount of$408,450.00 for the design
of sanitary sewer rehabilitation contract LXX (70).
Union Pacific Railroad recently informed the City of its plans to add two additional tracks to its centennial
rail yard facility. The proposed tracks will impact an existing 30-inch sanitary sewer main (M-134R) located
within the rail yard. In addition, the bridge pier layout for the segment of the proposed State Highway 121
located within the rail yard conflicts with the location of the existing M-134R. It is therefore necessary to
relocate the 30-inch sewer main.
Since the existing agreement with Kimley-Hom and Associates, Inc. includes the design for the
rehabilitation of a segment of M-134R located immediately downstream of the 30-inch sewer main in
question, staff recommends that the firm be allowed to provide the necessary design services to relocate
the sewer main via an amendment to City Secretary Contract No. 29706.
Kimley-Hom and Associates, Inc. proposes to provide the necessary additional engineering services to be
provided for a lump sum fee of$62,629.50. Staff considers this amount to be fair and reasonable.
Kimley-Hom and Associates, Inc. is in compliance with the City's M/WBE Ordinance by committing to 20%
M/WBE participation on this amendment. The City's goal on this amendment is 15%.
This project is located in COUNCIL DISTRICT 7, Mapsco 75R and 76N.
FISCAL INFORMATIONXERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Sewer Capital Project Fund.

Dear Liam:
Union Pacific Railroad is planning to add two additional tracks to their Fort
Worth Centennial Rail Yard facility. The proposed rails will impact the existing
30-inch sanitary sewer(M-134R*), and a 48-inch water transmission pipeline
located on the west side of the Hulen Street bridge. Union Pacific's construction
schedule anticipates that construction will begin in July 2004 and will be
completed in early 2005-. 'During the process of our investigation of the Union
Pacific rail yard we learned that the proposed NTTA/Highway 121 improvements
are also planned to cross the Union Pacific Rail yard in this same location. We
have found that the pier layout for the proposed NT-fA/Highway 121 conflicts
with the location of the existing M-134R near the crossing of the railroad, and
that the proposed Hulen Street Bridge relocation is in conflict with the existing
48-inch water transmission line. Since Kimley-Horn was already under contract
(Contract 70)to design and rehabilitate M-134R just downstream of the proposed
relocation,the City instructed Kimley-Horn to investigate these conflicts,provide
a recommendation to alleviate the conflicts, and provide design services as
instructed by the City.
We, therefore,respectfully request an amendment to our contract to provide
services related to resolving these conflicts as outlined in the following tasks.
The scope of services for this amendment is divided into the following tasks:
• Task 1 -Field investigation and master planning of water and wastewater
utility relocations for the proposed expansion of the Union Pacific Rail
yard as shown in Exhibit E1 and E2.
• Task 2 -Determination of possible water and wastewater utility conflicts
associated with the proposed NTTA/Highway 121 improvements in the
University Drive area.

• Task 3 -Design, bidding and construction phase services for the
proposed utility improvements as instructed by the City of Fort Worth.
The scope of services associated with each task is as follows:
• Task 1 -Field investigation and master planning of water and wastewater
utility relocations for the proposed expansion of the Union Pacific Rail
yard as well as the proposed improvements associated with the
NTTA/Highway 121 includes:
o Document research of record drawings of City of Fort Worth
Utilities near the location of the Union Pacific Rail yard and the
NTTA/Highway 121 and Hulen Street Bridge Improvements
o Meeting with Union Pacific Railroad design engineer to discuss
the limits of their project and the anticipated schedule. Receive
electronic files from Union Pacific Railroad of proposed railroad
improvements.
o Meeting with Carter and Burgess to review route and impacts of
the proposed NTTA/Highway 121. Receive electronic files of
proposed NTTA/highway improvements near the Union Pacific
Rail Yard.
o Field investigation to locate above ground utility structures with
Fort Worth field crews.
o Have surveyor set control and determine locations of existing
utilities from Vickery Boulevard across the Union Pacific Rail
yard, the proposed NTTA/Highway 121 crossing,the Clear Fork
of the Trinity River Crossing, and the relocation of Hulen Drive.
o Convert Union Pacific and NTTA/Highway 121 electronic files
to a standard format and prepare exhibit of existing conditions on
an aerial photo back ground.
o Meeting with Chang Patel and Yerby to discuss possible tie in
point for proposed water improvements that were anticipated to
connect to the existing 48-inch transmission pipeline in this area.
o Prepare and conduct meeting with the City of Fort Worth and
Carter and Burgess to discuss NTTA project scheduling and
potential impacts to Fort Worth utilities.
o Prepare recommendations for proposed water and sewer utility
relocations for the 30-inch sanitary sewer M134R and the 48-
inch water transmission pipeline. Prepare an exhibit(shown in
Exhibit Eland E2),an opinion of probable construction cost
and schedule for design,bidding, award and construction of the
improvements. Recommendations include approximately 3201f
of 30-inch sanitary sewer crossing the two proposed tracts of the
Union Pacific Railroad and approximately 1,5001f of 48 inch

transmission pipeline crossing the Clear Fork of the Trinity
River.
o Two meetings in the field with the Water Department Field
Services to have the approximate location of the end of the
casing of the existing 48-inch water transmission pipeline staked
for exaction for field verification. Survey services for this task
include staking the approximate location of the end of the
existing casing and then once the top of casing is excavated
survey will return to site and determine the actual pipe line and
casing location. This task also includes coordination with the
Union Pacific Rail Yard for access.
o Conduct a meeting with the City of Fort Worth and
representatives of the Union Pacific Railroad to present the
limits of the 30-inch sanitary sewer relocation, and schedule.
• Task 2 -Determination of possible water and wastewater utility conflicts
associated with the proposed NTTA/Highway 121 improvements in the
University Dr. area includes:
o Document research of record drawings of City of Fort Worth
Utilities near the location of the Union Pacific Rail yard and the
NTTA/Highway 121 and Hulen Improvements
o Meeting with Carter and Burgess to review route and impacts of
the proposed NTTA/Highway 121. Receive electronic files of
proposed NTTA/highway improvements near University Drive
area
o Conduct a meeting with the City to discuss results. No water
and wastewater conflicts were found with the proposed
NTTA/Highway 121 improvements in the area of University
Drive.
• Task 3 -Design, Bidding and construction phase services for the
proposed utility improvements as instructed by the City of Fort Worth.
o The City has instructed KimIey-Horn to prepare bidding and
construction contract documents for approximately 320 if of
relocation of 30-inch sanitary sewer crossing the proposed Union
Pacific Railroad Improvements.Bidding and contract documents
will be prepared in accordance with the current scope of services
for Contract 70 with the City of Fort Worth with the exception of
survey.
o The design survey limits and requirement is anticipated to
exceed what is normally required for standard design survey for
the City of Fort Worth. The survey will need to extend across
the rail yard to Vickery Boulevard to the north of the proposed
improvements and to the existing sanitary sewer manhole located
near the Hulen Street Bridge to the south of the improvements.

Survey crews will be required to comply with Union Pacific Rail
yard requirements for performing work on Union Pacific
Property.

documents for the revised contract. Other items should remain unchanged in

We recommend that the City increase the budget by$62,629.50 for these
additional services. The following table summarizes our recommended budget

Kimley-Horn will subcontract a portion of these services to S.A.M., Inc, GM
Enterprises, and Alphagraphics#83, all M/WBE subconsultants. The amount we
will be subcontracting is$12,210. This represents an M/WBE participation
percentage of 19.5% for these additional services. With these Additional
Services, our revised contract amount will be$470,994. This will revise our total
contract M/WBE participation from$116,600 (28.5%)to 128,810 (27.3%).
