THIS contract ("Contract") is made and entered into by and between the City of Fort
Worth ("City"), whose address is 1000 Throckmorton St., Fort Worth TX 76102, acting by and
through Dale A. Fisseler, its duly authorized acting Assistant City Manager, and United Cerebral
Palsy of Tarrant County, Inc. ("UCP"), whose address is 1555 Merrimac Circle, Suite 102, Fort
Worth, Texas 76107, acting by and through Monica Prather, its duly authorized President/CEO. .
WHEREAS, the City of Fort Worth ("City") has received a grant from the United States
Department of Housing and Urban Development ("HUD") through the Home Investment
Partnerships Program ("HOME"), Program No. M-03-MC-48-0204, Catalog of Federal Domestic
Assistance ("CFDA") No. 14.239, with which the City desires to promote activities that expand
the supply of affordable housing and the development of partnerships among the City, local
governments, local lenders, private industry and neighborhood-based nonprofit housing
organizations;
WHEREAS, the primary purpose of the HOME program ("HOME Program") pursuant to
the HOME Investment Partnerships Act at Title lI of the Cranston Gonzales National Affordable
Housing Act of 1990, as amended, 42 U.S.C. 12701 et seq. ("NAHA") and the HOME
Investment Partnerships Program Final Rule, as amended, 24 CFR Part 92 et seq. (the "HOME
Regulations" or"Regulations") is to benefit low and very-low income citizens by providing them
with affordable housing;
WHEREAS, UCP, a nonprofit corporation managed by a volunteer Board of Directors, is
working to assist low and very low income individuals with disabilities or families with a
member who has disabilities to become homeowners; and
WHEREAS, the citizens of the City and the City Council have determined that the
opportunity to own a safe, decent and affordable home is needed for individuals with disabilities
or families with a member who has disabilities.
NOW, THEREFORE, THIS AGREEMENT FURTHER WITNESSETH:
1. GENERAL PROVISIONS
A. Purpose
The express purpose of this Contract is to provide UCP with HOME funds ("HOME
Funds") not to exceed Two Hundred Five Thousand Nine Hundred Eighty-Eight and No/100
Dollars ($204,988.00) as a continuation of its Home of Your Own program ("HOYO") that
assists individuals with disabilities or families with a member who has disabilities to become
homeowners (the "Program"). Under the Program, UCP will provide outreach to the Eomrpar�tyr
applicant eligibility, housing counseling and homebuyer's down payment/closin cost,assistance.

in accordance with the attached Exhibit A— "Program Summar-".
UCP will be acting as a subrecipient under this Contract to provide closing cost/
downpayment assistance to eligible homebuyers.
The City shall act through its agent, the City Manager, or his or her duly authorized
representative, unless otherwise stated in this Contract. UCP agrees to comply with the HOME
Regulations including but not limited to the Uniform Administrative Requirements, 24 CFR Part
92.505, and Subpart F, the Project Requirements, 24 CFR 92.250 et seq.
B. Duration/Period of Affordability
This term of this Contract begins on the date of execution and terminates twelve (12)
months thereafter. This Contract may be extended for an additional one (1) -year term. UCP
shall request the extension in writing at least sixty(60) days prior to the end of the Contract term.
The request for extension shall include UCP's anticipated budget and goals and objectives for
the extended term. It is specifically understood that it is within the City's sole discretion whether
to approve or deny the request for an additional term. Any such extension must be in writing as
an amendment to this Contract and approved by the City Manager or his or her designee.
The housing assisted under this Contract will remain affordable as required by 24 CFR
Part 92.254 of the Regulations. Housing purchased with HOME Funds must remain affordable
housing for the following minimum time periods: 5 years where the per unit amount of HOME
Funds provided is less than 515,000; 10 years where the per unit amount of HOME Funds
provided is 515,000 ,to 540,000; and 15 years where the per unit amount of HOME Funds
provided is greater than 540,000. UCP must repay the City any HOME Funds attributable to any
unit or units that do not maintain the HOME affordability requirements.
C. Income Eligibility and Use of House as Principal Residence
The targeting requirements for the HOME Program and for projects assisted with HOME
Funds are contained in 92 CFR Part 203(b)(1)(2)(3). Annual income is used to establish
homebuyer eligibility. The definition of annual income to determine homebuyer eligibility under
this Contract shall be the definition contained in 92 CFR Part 203(b)(2) as amended from time to
time. The annual income of the homebuyer, adjusted for family size shall not exceed eighty
percent (80%) of the area median income established by HUD. UCP shall use the most current
HUD Income Guidelines to determine Program eligibility.
UCP shall insure that the homebuyer will use the home purchased under this Program as
his/her principle residence during the period of affordability.
D. Housing Standards
UCP is required to meet the City's minimum acceptable housing standards =and all affier-"'c"

applicable standards under City Codes and ordinances for all housing units acquired.
rehabilitated or resold with HOME Funds.
E. Other Requirements
The sales price of the of the houses purchased under this Contract shall not exceed ninety-
five percent (9$%) of the median purchase price of the type of single family housing for the City_
as determined by HUD.
The sales price of the houses shall not exceed the appraised value of the property as
determined by an independent appraiser.
Homebuyers assisted under this Contract must meet UCP HOYO underwriting
guidelines.
F. Independent Contractor
UCP shall operate hereunder as an independent contractor and not as an officer, agent,
servant or employee of City. UCP shall have exclusive control of, and the exclusive right to
control, the details of the work and services performed hereunder, and all persons performing
same, and shall be solely responsible for the acts and omissions of its officers, members, agents,
servants, employees, subcontractors, program participants, licensees or invitee. The doctrine of
respondeat superior shall not apply as between City and UCP, its officers, members, agents,
servants, employees, subcontractors, program participants, licensees or invitee, and nothing
herein shall be construed as creating a partnership or joint enterprise between City and UCP. It is
expressly understood and agreed that no officer, member, agent, employee, subcontractor,
licensee or invitee of UCP, nor any program participant hereunder, is in the paid service of City
and that City does not have the legal right to control the details of the tasks performed hereunder
by UCP, its officers, members, agents, employees, subcontractors, program participants,
licensees or invitees.
City shall in no way nor under any circumstances be responsible for any property
belonging to UCP, its officers, members, agents, employees, subcontractors, program
participants, licensees or invitees, which may be lost, stolen, destroyed or in any way damaged;
and UCP hereby indemnifies and holds harmless City and its officers, agents, and employees
from and against any and all claims or suits pertaining or connected with such property.
G. Termination
The City may terminate this Contract in the event of UCP's default, inability, or failure
to perform, or otherwise whenever such termination is determined by the City to be in the City's
best interest. Likewise, this Contract may be terminated by UCP if the City does not provide the
HOME Funds set forth in this Contract. The Contract may be terminated for mul aal gQr}ye Qnce=

The parties acknowledge that HOME Funds paid hereunder are intended to provide only
partial funding for UCP's general program operations. If funds other than HOME Funds in the
Operating Budget are not forthcoming to UCP during the Contract term, City may terminate this
Contract.
City shall notify the UCP in writing of any breach of this Contract, and specify a
reasonable time within which to cure the particular breach. If UCP fails to cure the breach within
the time stated in the notice, this Contract shall automatically terminate at the expiration of the
stated time allowed for cure.
UCP will return to City any unused HOME Funds previously distributed under this
Contract within thirty (30) days of the effective date of Contract termination. City will have no
responsibility or liability for UCP's expenditures or actions occurring after the effective date of
Contract termination.
H. Venue
Venue for any action, whether real or asserted, at law or in equity, arising out of the
execution, performance, attempted performance or non-performance of this Contract, shall lie in
Tarrant County, Texas.
L Written Instrument is Entire Agreement
All terms of this Contract shall apply to any and all subcontractors of UCP which are in
any way paid with HOME Funds or who perform any work in connection with UCP's Program.
The provisions of this Contract are severable, and, if for any reason a clause, sentence,
paragraph or other part of this Contract shall be determined to be invalid by a court or Federal or
state agency, board or commission having jurisdiction over the subject matter thereof, such
invalidity shall not affect other provisions which can be given effect without the invalid
provision.
The failure of the City to insist upon the performance of any term or provision of this
Contract or to exercise any right herein conferred shall not be construed as a waiver or
relinquishment to any extent of the City's right to assert or rely upon any such term or right on
any future occasion.
This written instrument and the exhibits attached hereto, which are incorporated by
reference and made a part of this Contract for all purposes, constitutes the entire Contract by the
parties hereto concerning the work and services to be performed under this Contract. Any prior
or contemporaneous oral or written agreement, which purports to vary the terms of this Contract,
shall be void. Any amendments to the terms of this Contract must be in writing and must be
approved by each party to this Contract.

Contract and are not intended to define or to limit the scope of any provision of this Contract.
2. DUTIES AND RESPONSIBILITIES OF CITY
A. Disbursement of Funds
The City will furnish HOME Funds for use as stated herein. The City will monitor the
use of such funds to ensure appropriate use. Funds shall be disbursed after execution of this
Contract and compliance with the provisions herein.
Disbursements for Program delivery costs will be on an advance of funds basis to cover
monthly operating expenses and will require completion of: (1) Attachment 1 "Subgrantee's
Request For Funds", (2) Attachment II "Detail Statement of Costs" and (3) Attachment III
"Expenditures Worksheet". UCP may request an advance of one-twelfth (1/12th) of its annual
operating support funds monthly. UCP may request an initial advance for two months of
operating funds to cover start-up expenses. Operating funds will be disbursed monthly
thereafter. UCP may request additional operating funds; if necessary, to meet monthly expenses
that exceed 1/12th of the budgeted amount.
Disbursements of Program funds for acquisition will not be made until actually needed
for payment and a copy of supporting documents, including the property sales contract, appraisal,
notice to seller, homebuyer's homeownership training certificate, environmental review and
property inspection report.
B. Amount of Funds
It is agreed that the total distribution of HOME Funds made available to be paid on behalf
of UCP during the term of this Contract shall not exceed the total sum of Two Hundred Four
Thousand Nine Hundred Eighty-Eight Dollars and No/100 Dollars ($204,988.00) in accordance
with the attached Exhibit B-"Program Budget" as follows:.
One Hundred Seventy-Nine Thousand Nine Hundred Eighty-Eight and No/100 Dollars
($179,988.00) shall be used by UCP to provide deferred payment, forgivable second mortgage
loans for closing cost/downpayment assistance to first-time homebuyers with disabilities, or
whose household includes a family member with a disability.
Twenty Five Thousand Dollars and No/100 Dollars ($25,000.00) shall be available to
UCP for housing counseling and Program operating support costs.
UCP shall be paid on an advance of funds basis for all expenses incurred under this
Contract to pay for the portion of the acquisition costs for the properties 11e
Program. Prior to the release of funds for closing cost/downpayment assistance theppr�gt to
be purchased must pass inspection by the City's Housing Department inspectors , , �.

a completed inspection checklist in accordance with the attached Exhibit E - "City of Fort
Worth Housing Department—Housing Quality Standard Inspection".
3. DUTIES AND RESPONSIBILITIES OF UCP
A. Statement of Work, Budget and Time Line for Goals and Expenditures
UCP will utilize Program funds to provide affordable housing opportunities to persons
with disabilities residing within the City of Fort Worth, Texas.
UCP will insure that homebuyers complete a homeownership training program prior to
paying expenses incurred under this Contract.
UCP will insure that homebuyers assisted under this Contract meet UCP HOYO Program
underwriting guidelines in accordance with the attached Exhibit F — "UCP-HOYO
Underwriting Guidelines".
B. Budget
UCP agrees that the HOME Funds will be expended in accordance with Exhibit B -
"Program Budget".
No change in the Program Budget shall be made without prior written approval of the
City. Under no circumstances shall the total amount of Program funds expended by UCP from
funds paid by the City exceed Two Hundred Four Thousand Nine Hundred Eighty-Eight and
No/100 Dollars ($204,988.00).
The HOME Funds may be spent only to pay actual expenses for the deferred payment
loans and Program delivery costs.
UCP agrees to keep all HOME Funds on hand in interest bearing accounts. All interest
earned shall be reported to the City on a monthly basis, at the same time as submission of the
monthly report following the end of the Contract month during which the interest was earned.
Interest earned in an amount of $25.00 or less per month may be used for authorized Program
expenses. These amounts must be reported on the monthly financial statements filed pursuant to
this Contract. Interest earned in excess of$25.00 per month is subject to remittance to the City
as directed by City.
UCP will not commingle HOME Funds with any other funds in any mariner that would
prevent the City from readily identifying expenditures for operation of the Program.
C. Time Line for Goals and Expenditures
UCP will work in accordance with the schedule set forth in the attach it C -
"Program Implementation Timeline", and ensure that Program goals an epndiT
correspond with the completion of the Program. „

D. Reversion of Assets and Use of Program Income
UCP agrees to return to the City any HOME Funds and/or HOME Program income
remaining on hand at the end of the Contract. Repayments, interest and other returns on
investment attributable to HOME Funds may be retained by UCP for the operation of the
Program for the duration of the Contract, and must be used by LTCP to assist other low income
homebuyers to purchase homes. If repayments, interest or other returns on investment
attributable to HOME Funds are received after the term of this Contract, they shall be returned to
the City to be deposited in the City's HOME Investment Trust Fund local account.
E. Affirmative Marketing
UCP must adopt affirmative marketing procedures and requirements for all housing
assisted with HOME Funds. The procedures and requirements must include methods for
informing the public, owners and potential homebuyers about fair housing laws and policies so as
to ensure that all individuals, without regard for race, creed, nationality, religion or familial status
are given an equal opportunity to participate in the Program. UCP will be solely responsible for
the effective marketing responsibilities necessary to achieve the UCP's production goals.
F. Recapture Provisions
If the homebuyer retains ownership of the property for the full period of affordability, no
recapture restrictions will apply.
Any sale of the property by the homebuyer during the term of affordability will require
repayment of the deferred payment loan or other subsidy provided in accordance with HOME
Regulations, 24 CFR Part 92.254 (a) (4) (ii).
UCP understands that there are specific property recapture provisions applicable on
properties purchased in whole or in part with HOME Funds, including the requirement that the
property must remain the homebuyer's principal residence during the applicable affordability
period. The recapture provisions will remain in effect on property purchased in whole or in part
with HOME Funds for the specified affordability periods. These requirements will be enforced
through appropriate loan documents to insure compliance.
Any HOME Funds invested in housing that fails to meet the affordability requirements
for the appropriate affordability period must be repaid to the City in accordance with HOME
Regulations.
G. Record Retention and Reports
UCP will keep or cause to be kept an accurate record of all actions take fuds..
expended, with source documents, in the pursuit of the objectives of the perfol mance of this
Contract. Such records shall be kept for five years after the period of affordabilit mandated by

the Regulations terminates.
UCP will obtain and keep on file the following information on each household served by
the Program :in accordance with the attached Attachment IV(a) "Performance Report":.
a. Annual income and size of the household of which the client is a member;
b. Ethnicity and race of the client, using one of the following categories:
Ethnicity: Hispanic/Latino or Non Hispanic/Latino Race: White.
Black/African American, Asian; American Indian/Alaskan Native &
Hawaiian/Other Pacific Islander, American Indian/Alaskan Native & White,
Asian & White, Black/African American & White, American Indian/Alaskan
Native & Black/African American, Other Multi-Racial;
c. Whether the head of the client's household is male or female,
d. Additional statistical information as may be required by HUD regulations and
any amendments thereto:
UCP will keep on file the following information and documentation on each individual
project:
e. Proof that the project meets the applicable property standards;
f. The per unit amount of HOME funds invested;
g. The compliance with the affirmative marketing requirements and existence
of acceptable procedures;
h. Compliance with relocation requirements;
i. Minority and female owned business data, and affirmative fair housing
actions;
J. Compliance with lead based paint requirements; and
k. Compliance with conflict of interest rules.
UCP will keep on file copies of the following loan documentation for each
individual loan:
1. Sales Contract between home seller and homebuyer;
in. Appraisal;
n. Environmental review;
o. Housing Quality Standard Inspection Checklist
p. Closing Settlement Statement (HUD-1);
q. Warranty Deed;
r. First Lien Promissory Note;
S. First Lien Deed of Trust
S. Subordinate Promissory Note;

Z. Notice To Seller
By the 15th day of each month during which the Program is supported by HOME Funds
provided under this Contract (to be construed as including the use of any asset obtained through
the expenditure of HOME Funds), UCP will supply the City with a report detailing:
a. Program reports in accordance with Attachment IV— "Monthly Narrative Report" and
Attachment IV(a) - Performance Report;
b. Expenditure detail in accordance with Attachment I - "Request For Funds",
Attachment II - "Detail Statement of Costs", and Attachment III - "Expenditures
Worksheet".
c. The amount of leveraging generated by this grant, including items that qualify as HOME
match.
Reports shall be submitted in the format specified by City. IF THE REQUIRED
REPORTS ARE NOT RECEIVED BY THE DUE DATE, THE CITY RESERVES THE
RIGHT TO WITHHOLD PAYMENTS REQUESTED UNDER THIS CONTRACT AND
ANY OTHER CONTRACTS WITH UCP.
H. Cost Principles
UCP shall administer the Program in compliance with OMB Circular A-122, "Cost
Principles for Non-Profit Organizations", as amended from time to time and with the following
All non-federal entities that expend $500,000 or more in Federal funds within one year,
regardless of the source of the Federal award, must submit to City an annual audit prepared in
accordance with specific reference to OMB Circular A-133. The audit may cover either UCP's
fiscal year during which this Contract is in force or cover the period of this Contract. The audit
must be prepared by an independent certified public accountant, be completed within twelve (12)
months following the end of the period being audited and be submitted to City within thirty (30)
days of its completion. UCP's audit certification is attached hereto as Exhibit D — "Audit
Certification Form" and "Audit Requirements". The Audit Certification Form must be
submitted to City within sixty (60) days of the end of period being audited (UCP's fiscal year).
Costs of preparation of this audit may be an allowable expenditure of Federal funds in an amount
proportional to that of the Federal funds used in UCP's total agency operating budget. Non-profit
entities that expend less than $500,000 a year in Federal funds are exempt from Federal audit
requirements for that year, but records must be available for review or audit by appropriate
officials of the Federal agency, City, and General Accounting Office.
City reserves the right to perform an audit of UCP's Program operations and finances at
any time during the term of this Contract, if City determines that such audit is necessary for
City's compliance with OMB Circular A-133, and UCP agrees to allow access o,_al1 pcinent
materials as described in Section G. Record Retention and reports. If such Luilit reveals
questioned practice or expenditure, such questions must be resolved within (15) d iys after notice_

to UCP of such questioned practice or expenditure. if questions are not resolved within this
period, City reserves the right to withhold further funding under this and/or future contract(s)
with UCP.
If as a result of any audit it is determined that UCP has misused, misapplied or
misappropriated all or any part of the HOME Funds, UCP agrees to reimburse the City the
amount of such monies so misused, misapplied or misappropriated, plus the amount of any
sanctions, penalty or other charge levied against City by HUD because of such misuse,
misapplication or misappropriation.
I. Monitor Effectiveness of Services and Work
The City will review the activities and performance of UCP not less than annually as
required by the HOME Regulations, 24 CFR Part 92.504 (e).
UCP agrees to fully cooperate with City in monitoring the effectiveness of the services
and work to be performed by UCP in compliance with the terms of this Contract. City shall have
access at all reasonable hours to offices and records (dealing with the use of the funds that are the
basis of this Contract) of UCP, its officers, directors, agents, employees, and subcontractors for
the purpose of such monitoring.
UCP agrees to likewise monitor the effectiveness of the services and work to be
performed by its subcontractors.
J. Compliance with All Applicable Laws and Regulations
UCP agrees to comply with the following laws and the regulations as they are currently
written or are hereafter amended during performance of this Contract:
(1) Federal
Title VI of Civil Rights Act of 1964 (42 USC 2000d et seq.)
Title VIII of Civil Rights Act of 1968 (42 USC 3601 et seq.)
Executive Orders 11063 and 11246, as amended by Executive Orders 11375 and 12086
and as supplemented by 41 CFR Part 60
The Age Discrimination in Employment Act of 1967 (29 USC et seq.)
The Age Discrimination Act of 1975 (42 USC 6101 et seq.)
Section 504 of the Rehabilitation Act of 1973 (29 USC 794 et seq.) and 24 CFR Part 8
where applicable
National Environmental Policy Act of 1969, as amended, 42 USC 4321 et seq. ("NEPA")
and the related authorities listed 24 CFR Part 58
The Clean Air Act, as amended, (42 USC 7401 et seq.), the Clean Water Act of 1977, as
amended (33 USC 1251 et seq.) and the related EPA regulations at 40 CFR Part 15, as
amended from time to time, and Executive Order 11738. In no event shall y amou

Architectural Barriers Act of 1968, as amended, (42 USC 4151 et seq.), and the
Uniform Federal Accessibility Standards, 24 CFR Part 40, Appendix A
HOME Investment Partnerships Act at Title 11 of the Cranston Gonzales National
Affordable Housing Act of 1990, as amended, 42 U.S.C. 12701 et seq. ("NAHA")
Regulations at 24 CFR Part 87 related to lobbying, including the requirement that
certifications and disclosures be obtained from all covered persons
Executive Order 12549 and 24 CFR Part 5.105 (c) pertaining to restrictions on
participation by ineligible, debarred or suspended persons or entities
Regulations at 24 CFR Part 882.708 (c) pertaining to site and neighborhood standards for
new construction projects
(2) Section 3 of the Housing and Urban Development Act of 1968, as amended, (12 USC
1701 u et seq.) and its related regulations at 24 CFR Part 135
As the work performed under this Contract is on a project assisted under a program
providing direct Federal financial assistance from HUD, Section 3 of 24 CFR 135.38 ("Section
3") requires that the following clause be inserted in all covered contracts ("Section 3 Clause"):
"A. The work to performed under this contract is subject to the requirements of
Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u
(Section 3). The purpose of Section 3 is to ensure that employment and other economic
opportunities generated by HUD assisted or HUD-assisted projects covered by Section 3, shall,
to the greatest extent feasible, be directed to low-and very low-income persons, particularly
persons who are recipients of HUD assistance for housing.
B. The parties to this contract agree to comply with HUD's regulations in 24 CFR
Part 135, which implement Section 3. As evidenced by their execution of this contract, the
parties to this contract certify that they are under no contractual or other impediment that would
prevent them from complying with the Part 135 regulations.
C. The contractor agrees to send to each labor organization or representative of
workers with which it has a collective bargaining agreement or other understanding, if any, a
notice advising the labor organization or workers' representatives of the contractor's
commitments under this Section 3 clause and will post copies of the notice in conspicuous places
at the work site where both employees and applicants for training and employment positions can
see the notice. The notice shall describe the Section 3 preference, shall set forth minimum
number and job titles subject to hire, availability of apprenticeship and training positions, the
qualifications for each; and the name and location of the person(s) taking applications for each of
the positions; and the anticipated date the work shall begin.
D. The contractor agrees that it will include this Section 3 clause in every subcontract
to comply with regulations in 24 CFR Part 135, and agrees to take appropriate action, as
provided in an applicable provision of the subcontract or in this Section 3 Claus
that the subcontractor is in violation of the regulations in 24 CFR Part 135. The

E. The contractor will certify that any vacant employment positions, including
training positions, that are filled (1) after the contractor is selected but before the contract is
executed, and (2) with persons other than those to whom the regulations of 24 CFR Part 135
require employment opportunities to be directed, were not filled to circumvent the contractor's
obligations under 24 CFR Part 135.
F. Noncompliance with HUD's regulations in 24 CFR Part 135 may result in
sanctions, termination of this contract for default, and debarment or suspension from future HUD
assisted contracts.
G. With respect to work performed in connection with Section 3 covered Indian
housing assistance, section 7(b) of the Indian Self-Determination and Education Assistance Act
(25 U.S.C. 450e) also applies to the work to be performed under this contract. Section 7(b)
requires that to the greatest extent feasible (i) preference and opportunities for training and
employment shall be given to Indians, and (ii) preference in the award of contracts and
subcontracts shall be given to Indian organizations and Indian—owned Economic Enterprises.
Parties to this contract that are subject to the provisions of Section 3 and Section 7(b) agree to
comply with Section 3 to the maximum extent feasible, but not in derogation of compliance with
Section 7(b)."
UCP will comply with the provisions of Section 3 and the regulations in 24 CFR Part
135, and all applicable rules and orders issued thereunder. UCP certifies and agrees that it is
under no contractual or other impediment that would prevent it from complying with these
requirements. UCP agrees that it will send to each labor organization or representative of
workers with which it has a collective bargaining agreement or other contract or understanding, if
any, a notice advising the said labor organization or workers' representatives of its commitments
under this Section 3 Clause and shall post copies of the notice in conspicuous places available to
employees and applicants for employment or training.
UCP agrees that it will include the Section 3 Clause in every subcontract for work in
connection with the Program and will, at direction of City, take appropriate action pursuant to
such subcontract upon a finding that any subcontractor is in violation of regulations pertaining to
Section 3. UCP agrees that it will not subcontract with any subcontractor where it has
knowledge that the latter has been found in violation of the regulations under 24 CFR Part 135
and will not let any contract unless the subcontractor has first provided UCP with a preliminary
statement of activity to comply with the requirements of these regulations.
City and UCP understand and agree that compliance with the provisions of Section 3, the
regulations set forth in 24 CFR Part 135, and all applicable rules and orders of HUD shall be a
condition of the Federal financial assistance provided to the Program, binding upon the City and
UCP, and their respective successors, assigns and subcontractors. Failure to fulfill these
requirements shall subject UCP and its subcontractors, and their respective successors and
assigns, to those sanctions specified by the Grant Agreement through which Federal assistance is
provided and to such sanctions as are specified by 24 CFR Part 135.

(3) Lead Based Paint Requirements
All houses built prior to 1978 proposed to be rehabilitated with Federal funds shall require
inspection for lead based paint. Inspection and abatement work shall be carried out by
contractors and workers certified and trained under the Texas Department of Health,
Environmental Lead Branch. This includes inspectors, risk assessors, abatement and hazard
reduction contractors.
A written certification must be on file with the City Housing Department that certifies all
firms, abatement supervisors, lead workers, inspectors, and risk assessors performing work on
houses assisted with federal funds that require lead hazard reduction are certified under the laws
and regulations of the Sate of Texas Department of Health, Environmental Lead Branch.
UCP and all of its contractors shall comply with appropriate HUD and EPA regulations
regarding lead-based paint notification, disclosure, or work practices during lead hazard control
activities.
UCP and all contractors shall prohibit the use of open-flame burning, chemical strippers
containing methylene chloride, dry scraping, uncontained hydroblasting or hydrowashing,
uncontained abrasive blasting, machine sanding without HEPA attachments or heat stripping
above 1100°F as work practices at anytime.
UCP and all of its contractors shall dispose of waste resulting from lead hazard control
activities in accordance with the requirements of the appropriate local, State and Federal
regulatory agencies. UCP or subcontractors must handle disposal of wastes from hazard control
activities that contain lead-based paint, but are not classified as hazardous, in accordance with
State or local law or the HUD Guidelines for the Evaluation and Control of Lead-Based Paint
Hazards in Housing.
The City's Housing Department will conduct a final inspection of the work performed.
(4) Other Laws
UCP covenants and agrees that its officers, members, agents, employees, Program
participants and subcontractors shall abide by and comply with all other laws, (Federal, state and
local) relevant to the performance of this Contract, including all ordinances, rules and regulations
of the City of Fort Worth and the HOME Regulations. UCP further promises and agrees that it
has read, and is familiar with, the terms and conditions of the Federal grant under which HOME
Funds are granted and that it will fully comply with them. It is agreed and understood that, if
City calls the attention of UCP to any such violations on the part of UCP or any of its officers,
members, agents, employees, Program participants or subcontractors, then UCP shall
immediately desist from and correct such violation.

UCP, in the execution, performance or attempted performance of this Contract and
agreement, will not discriminate against any person because of sex, race, religion, color, national
origin or familial status, nor will UCP permit its officers, members, agents, employees,
subcontractors or Program participants to engage in such discrimination.
During the performance of this Contract UCP agrees, and will require all its
subcontractors to agree, as follolvs:
UCP will not unlawfully discriminate against any employee or applicants for employment
because of race, color, religion, sex or national origin. UCP will take affirmative action
to ensure that applicants are employed and that employees are treated fairly during
employment without regard to their race, color, religion, sex or national origin. Such
action shall include, but not be limited to, the following: employment, upgrading,
demotion or transfer, recruitment or recruitment advertising, layoff or termination, rates
of pay or other forms of compensation, and selection for training, including
apprenticeship. UCP agrees to post in conspicuous places, available to employees and
applicants for employment, notices setting forth the provisions of this nondiscrimination
clause.
UCP will, in all solicitations or advertisements for employees placed by or on behalf of
UCP, state that all qualified applicants will receive consideration for employment without
regard to race, color, religion, sex or national origin.
UCP covenants that neither it nor any of its officers, members, agents, employees,
program participants or subcontractors, while engaged in performing this Contract, shall,
in connection with the employment, advancement or discharge of employees or in
connection with the terms, conditions or privileges of their employment, discriminate
against persons because of their age or because of any handicap, except on the basis of a
bona fide occupational qualification, retirement plan or statutory requirement.
UCP further covenants that neither it nor its officers, members, agents, employees,
subcontractors, Program participants, or persons acting on their behalf, shall specify, in
solicitations or advertisements for employees to work on this Contract, a maximum age
limit for such employment unless the specified maximum age limit is based upon a bona
fide occupational qualification, retirement plan or statutory requirement.
In accordance with the provisions of the Americans With Disabilities Act of 1990
("ADA"), UCP warrants that it and any of its subcontractors will not unlawfully
discriminate on the basis of disability in the provision of services to the general public,
nor in the availability, terms and/or conditions of employment for applicants for
employment with, or employees of UCP or any of its subcontractors. UCP warrants it
will fully comply with ADA's provisions and any other applicable Federal, state and local
laws concerning disability and will defend, indemnify and hold City harm
claims or allegations asserted by third parties or subcontractors against Ci ansingi.q _;,

concerning disability discrimination in the performance of this Contract.
This Contract is made and entered into with reference specifically to the ordinances
codified at Chapter 17, Article III, Division 3, 'Discrimination in Employment Practices",
of the City Code and UCP hereby covenants and agrees that UCP, its officers, members,
agents, employees and subcontractors, have fully complied with all provisions of same
and that no employee, applicant or Pro,;am participant has been discriminated against by
the terms of such ordinances by either UCP or its officers, members, agents, employees or
subcontractors.
(6) Prohibition Against Interest
No member, officer or employee of City or its designees or agents; no member of the
governing body of the locality in which the Program is situated; and no other public official of
such locality or localities, who exercises any functions or responsibilities with respect to the
program funded hereunder during his tenure or for one year thereafter, shall have any interest,
direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be
performed hereunder. UCP shall incorporate, or cause to be incorporated, like language
prohibiting such interest in all contracts and subcontracts entered into in connection with the
Program.
No officer, employee, member or Program participant of UCP or its subcontractors shall
have a financial interest, direct or indirect, in this Contract or the HOME Funds transferred
hereunder or be financially interested, directly or indirectly, in the sale to UCP of any land,
materials, supplies or services purchased with any funds transferred hereunder, except on behalf
of UCP, as an officer, employee, member or Program participant. Any willful violation of this
paragraph with the knowledge, expressed or implied, of UCP or its subcontractors shall render
this Contract voidable by the City.
No officer, employee, agent, consultant, elected official or appointed official of the City,
UCP or its subcontractors who exercised any functions or responsibilities with respect to
activities assisted with HOME Funds or who are in a position to participate in a decision making
process or gain inside information with regard to these activities, may obtain a financial interest
or benefit from a HOME assisted activity, or have an interest in any contract, subcontract, or
agreement with respect thereto, or the proceeds thereunder, either for themselves or those with
whom they have family or business ties, during their tenure or for one year thereafter.
(7) Minority and Women Business Enterprise Commitment
UCP agrees to abide by the City's policy to involve Minority and Women Business
Enterprises ("M/WBEs") in all phases of its procurement practices and to provide them equal
opportunity to compete for contracts for construction, provision of professFTI purchase of equipment and supplies and provision of other services required by CUCP agrees to incorporate City Ordinance No. 11923, and all amendments or sue

thereto, into all contracts and subcontracts and will further require all persons or entities with
whom it contracts to comply with said ordinance.
K. Assi �ent
UCP shall not assign all or any part of its rights, privileges, or duties under this Contract
without the prior written approval of City. Any attempted assignment of same without approval
shall be void, and shall constitute a breach of this Contract. It is agreed that the City has the right
to inspect and approve in writing any proposed subcontracts between UCP and any subcontractor
engaged in any activity in conjunction with this HOME funded project prior to any charges being
incurred.
L. Indemnification and Release
UCP COVENANTS AND AGREES TO INDEMNIFY, HOLD HARMLESS AND
DEFEND, AT ITS OWN EXPENSE,CITY AND ITS OFFICERS, AGENTS, SERVANTS
AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS OR SUITS FOR
PROPERTY LOSS OR DAMAGE AND/OR PERSONAL INJURY, INCLUDING
DEATH, TO ANY AND ALL PERSONS, OF WHATSOEVER KIND OR CHARACTER,
WHETHER REAL OR ASSERTED, ARISING OUT OF OR IN CONNECTION WITH
THE EXECUTION, PERFORMANCE, ATTEMPTED PERFORMANCE OR
NONPERFORMANCE OF THIS CONTRACT AND/OR THE OPERATIONS,
ACTIVITIES AND SERVICES OF THE PROGRAM DESCRIBED HEREIN,
WHETHER OR NOT CAUSED IN WHOLE OR IN PART, BY ALLEGED
NEGLIGENCE OF OFFICERS, AGENTS, SERVANTS, EMPLOYEES,
CONTRACTORS OR SUBCONTRACTORS OF CITY; AND UCP HEREBY ASSUMES
ALL LIABILITY AND RESPONSIBILITY OF CITY AND ITS OFFICERS, AGENTS,
SERVANTS, AND EMPLOYEES FOR ANY AND ALL CLAIMS OR SUITS FOR
PROPERTY LOSS OR DAMAGE AND/OR PERSONAL INJURY, INCLUDING
DEATH, TO ANY AND ALL PERSONS, OF WHATSOEVER KINDS OR
CHARACTER, WHETHER REAL OR ASSERTED, ARISING OUT OF OR IN
CONNECTION WITH THE EXECUTION, PERFORMANCE, ATTEMPTED
PERFORMANCE OR NONPERFORMANCE OF THIS CONTRACT AND
AGREEMENT AND/OR THE OPERATIONS, ACTIVITIES AND SERVICES OF THE
PROGRAMS DESCRIBED HEREIN, WHETHER OR NOT CAUSED IN WHOLE OR
IN PART, BY ALLEGED NEGLIGENCE OF OFFICERS, AGENTS, SERVANTS,
EMPLOYEES, CONTRACTORS OR SUBCONTRACTORS OF CITY. UCP LIKEWISE
COVENANTS AND AGREES TO AND DOES HEREBY INDEMNIFY AND HOLD
HARMLESS CITY FROM AND AGAINST ANY AND ALL INJURY, DAMAGE OR
DESTRUCTION OF PROPERTY OF CITY, ARISING OUT OF OR IN CONNECTION
WITH ALL ACTS OR OMISSIONS OF UCP, ITS OFFICERS, MEMBERS, AGENTS,
EMPLOYEES, SUBCONTRACTORS, INVITEES, LICENSEES, OR PROGRAM
PARTICIPANTS, OR CAUSED, IN WHOLE OR IN PART, BY ALLEGED
NEGLIGENCE OF OFFICERS, AGENTS, SERVANTS, E:�PLOYEES,

IT IS THE EXPRESS INTENTION OF THE PARTIES, BOTH UCP AND CITY.
THAT THE INDEMNITY PROVIDED FOR THIS SECTION INCLUDES INDEMNITY
BY UCP TO INDEMNIFY AND PROTECT CITY FROM THE CONSEQUENCES OF
CITY'S OWN NEGLIGENCE, WHETHER THAT NEGLIGENCE IS ALLEDGED TO
BE THE SOLE OR CONCURRING CAUSE OF THE INJURY, DAMAGE OR DEATH.
UCP AGREES TO AND SHALL RELEASE CITY, ITS AGENTS. EMPLOYEES,
OFFICERS AND LEGAL REPRESENTATIVES FROM ALL LIABILITY FOR INJURY,
DEATH, DAMAGE OR LOSS TO PERSONS OR PROPERTY SUSTAINED IN
CONNECTION WITH OR INCIDENTIAL TO PERFORMANCE UNDER THIS
CONTRACT, EVEN IF THE INJURY, DEATH, DAMAGE OR LOSS IS CAUSED BY
THE CITY'S SOLE OR CONCURRENT NEGLIGENCE.
UCP SHALL REQUIRE ALL OF ITS SUBCONTRACTORS TO INCLUDE IN
THEIR SUBCONTRACTS A RELEASE AND INDEMNITY IN FAVOR OF THE CITY
IN SUBSTANTIALLY THE SAME FORM AS ABOVE.
M. Waiver of Immunity
If UCP, as a charitable or nonprofit organization, has or claims an immunity or exemption
(statutory or otherwise) from and against liability for damages or injury, including death, to
persons or property, UCP hereby expressly waives its rights to plead defensively such immunity
or exemption as against City. This section shall not be construed to affect a governmental
entity's immunities under constitutional, statutory or common law.
N. Insurance and Bonding
UCP will maintain blanket fidelity coverage in the form of insurance or bond in the
amount of $30,000, to insure against loss from the fraud, theft or dishonesty of any of UCP's
officers, agents, trustees, directors or employees. The proceeds of such bond shall be used to
reimburse City for any and all loss of HOME Funds occasioned by such misconduct. To
effectuate such reimbursement, such bond shall include a rider stating that reimbursement for any
loss or losses thereunder shall be made directly to City for the use and benefit of UCP.
UCP shall furnish to City, in a timely manner, certificates of insurance as proof that it has
secured and paid for policies of commercial insurance as specified herein. Such insurance shall
cover all insurable risks incident to or in connection with the execution, performance, attempted
performance or nonperformance of this Contract. UCP shall maintain the following coverages
and limits thereof:

if or when in the course of UCP's business as contracted herein.

Note: Such insurance shall cover employees performing work on any and all projects
including but not limited to construction, demolition, and rehabilitation. UCP or its
subcontractors shall maintain coverages. In the event the respective subcontractors do not
maintain coverage, the UCP shall maintain the coverage on such subcontractor for each
applicable subcontract.
Directors and Officers Insurance
Optional (Highly Recommended)
Note: This insurance shall cover the UCP and any associated Board of Directors
members.
Additional Requirements
Such insurance amounts shall be revised upward at City's option and that UCP shall
revise such amounts within thirty(30) days following notice to UCP of such requirements.
UCP will submit to City documentation that it has obtained insurance coverage and
has executed bonds as required in this Contract prior to payment of any monies provided
hereunder.
Each insurance policy shall be endorsed to provide City with a minimum sixty(60) days
notice of cancellation, non-renewal, and/or material change in policy terms or coverage.
Insurance policies required herein shall be endorsed to include City as an additional
insured as its interest may appear. Additional insured parties shall include employees, officers,
agents, and volunteers of the City.
The Workers' Compensation Insurance policy shall be endorsed to include a waiver of
subrogation, also referred to as a waiver of rights of recovery, in favor of City.

.Anv failure on part of the City to request certificate(sl of insurance shall not be construed
as a waiver of such requirement or as a waiver of the insurance requirements themselves.
Insurers of UCP's insurance policies shall be licensed to do business in the state of Texas
by the Department of Insurance or be otherwise eligible and authorized to do business in the state
of Texas. Insurers shall be acceptable to the City insofar as their financial strength and solvency
and each such company shall have a current minimum A.M. Best Key Rating Guide rating of A:
VII or other equivalent insurance industry standard rating otherwise approved by the City of Fort
Worth.
Deductible limits on insurance policies shall not exceed 55,000 per occurrence unless
otherwise approved by City.
In the event there are any local, federal or other regulatory insurance or bonding
requirements for the Program, and such requirements exceed those specified herein, the former
shall prevail.
UCP shall require its subcontractors to maintain applicable insurance coverages, limits,
and other requirements as those specified herein; and, UCP shall require its subcontractors to
provide UCP with certificate(s) of insurance documenting such coverage. Also, UCP shall
require its subcontractors to have City and UCP endorsed as additional insureds (as their interest
may appear) on their respective insurance policies.
UCP shall require its subcontractors to maintain builders risk insurance at the limit
of applicable project(s) costs when the value of materials involved exceeds $10,000 or at a
different limit value as specified by the City of Fort Worth.
O. Certification Regarding Lobbing
The undersigned representative of UCP hereby certifies, to the best of his or her
knowledge and belief, that:
No Federal appropriated funds have been paid or will be paid, by or on behalf of
UCP, to any person for influencing or attempting to influence an officer or employee of
any agency, a member of Congress, an officer or employee of Congress in connection
with the awarding of any Federal contract, the making of any Federal grant, the making of
any Federal loan, the entering into of any cooperative agreement and the extension,
continuation, renewal, amendment, or modification of any Federal contract, grant, loan or
cooperative agreement.
If any funds other than federally appropriated funds have been paid or will be paid
to any person for influencing or attempting to influence an officer or employee of any
agency, member of Congress in connection with this Federal contract, grant oan of

This certification is a material representation of fact upon which reliance was
placed when this Contract was made or entered into. Submission of this certificate is a
prerequisite for making or entering into this Contract imposed by 31 USC Section 1352.
Any person who fails to file the required certification shall be subject to a civil penalty of
not less than S 10,000.00 and not more than S 100,000.00 for each such failure.
The UCP shall require that the language of this certification be included in all
subcontracts or agreements involving the expenditure of Federal funds.
P. MISCELLANEOUS PROVISIONS
All terms of this Contract shall apply to any and all subcontractors of UCP who are in
any way paid with HOME Funds or who perform any work in connection with UCP's
program.
All notices required or permitted by this Contract must be in writing and are deemed
delivered on the earlier date of the date actually received or the third day following (i) deposit
in a Untied States Postal Service post office or receptacle; (ii) with proper postage, certified
mail return receipt requested; and (iii) addressed to the other party at the address set out in the
preamble of this Contract or at such other address as the receiving party designates by proper
notice to the sending party.

United Cerebral Palsy of Tarrant County(UCP)will provide funds for deferred payment,forgiveable, second mortgage loans for

AUDIT REQUIREMENTS
Organizations expending $300,000 or more in federal awards (from City of Fort
Worth and other funding sources) during their fiscal years shall obtain either an
annual single audit or a program specific audit. Organizations may have a
program specific audit in accordance with OMB Circular A-133 if they
expended funds for only one federal program as listed in the Catalog of
Federal Domestic Assistance (CFDA). If funds are spent for more than one
federal program, a single audit is required. The audited time period is the
organization's fiscal year, and not the City of Fort Worth's funding period.
The audit shall be conducted by a certified public accountant (CPA) that is
licensed at the time of the audit by the appropriate regulatory body. The CPA
shall meet all of the general standards concerning qualifications,
independence, due professional care and quality control as required by
Government Auditing Standards, including the requirements for continuing
professional education and external peer reviews. Auditor selection must
adhere to federal/City procurement requirements.
A separate supplementary schedule of revenues, expenditures and
changes in fund balance for each City of Fort Worth contract is no longer
required. The Schedule of Expenditures of Federal Awards should list City of
Fort Worth 's contract numbers, the total expended for each individual
federal program, and the CFDA number (OMB A-133 § .310).
The independent auditor's report should include all of the relevant items
listed on the "Audit Report Checklist." Additional guidance on the conduct and
reporting of these audits is contained in the latest issuance of the following
publications:

All organizations that receive a Cit}, of Fort 1/Vorth award must submit the
provided Audit Certification Form which certifies whether you are subject to a
single/program audit. Organizations receiving federal awards from the City of
Fort Worth who are not required to have an audit shall certify in writing to the
agency. The organizations Chief Executive Officer or Chief Financial Officer
shall make the certification within 60 days of the end of the organization's
fiscal year.
The following items should be submitted to the City of Fort Worth Housing
Department within the required timeframe:
Due 60 days after organization's fiscal year end: (required for all subrecipients)
• Completed Audit Certification Form
Due within the earlier of 30 days after receipt of the auditor's report or nine months
after the end of the audit period.
• Two copies of the entire audit report issued by the CPA
• Two copies of any management letter issued by the CPA in
conjunction with the audit report
• Two copies of management's comments on all findings,
recommendations, & questioned costs contained in the audit
report and management letter, including a detailed corrective
action plan
Failure to submit any of these items by the required due date may result in
holds on current draw requests, suspension of the organization's contract(s)
and eligibility for future funding.
If the organization does not meet the- requirements of having a
single/program audit conducted, records must still be kept available for review
or audit by City of Fort Worth staff (OMB A-133 Subpart B Sec 200(d).

United Cerebral Palsy of Fort Worth and Tarrant County (UCP-TC) has
adopted the following underwriting guidelines and criteria for their
"Home Of Your Own" program (HOYO).
A HOYO "Participant' is any individual who has received a letter from UCP-TC
approving their HOYO application and their eligibility for participation in the
HOYO program.
HOYO Adopted Policies
HOYO Participant Eligibility Policy:
1. The applicant must be a person with a disability or includes a family
member with a disability as defined by the American with
Disabilities Act (ADA)
2. The disability must be documented with a Physician Disability
Certification or other acceptable medical documentation
3. Applicant(s) must be a US Citizen or legal resident alien
4. Applicant(s) must complete a HOYO orientation and agree in
writing to abide by the policies and requirements of the HOYO
program
5. Applicant(s) must complete a HUD certified homeownership
training class and provide UCP with a copy of the certificate
6. Applicant(s) must provide a minimum investment of$500.00 of their
own funds
7. Applicant(s) income may not exceed 80% of Area Median Income
8. Applicant(s) income will be calculated on the present and future
projections for the next 12-month period.
9. Applicant(s) must disclose all sources of household income.(Some
households may include persons who are not counted as family
members for the purpose of income limits and whose income, if
any, is not considered when calculating annual income. Do not
count the following household members when determining family
size for income limit purposes; foster children, live-in aides, and
children of live-in aides, unborn children and children being pursued
for legal custody or adoption who are not currently living with the
household. A child who is subject to a shared-custody agreement
in which the child resides with the household at least fifty percent of
the time can be counted. )

UCP-TC HOYO Project Program Guidelines:
1. Applicant(s) may select any loan product or services they qualify for.
2. Applicant(s) must choose an approved lender from a designated lender
list.
3. Applicant(s) must have acceptable credit (as per Fannie Mae/FHA
guidelines) and be willing to resolve credit problems. Judgments must
be released and documentation provided to UCP. Bankruptcy must be
discharged for one year or more. If a client has no credit scores,
counseling will be provided to establish a credit bureau file by using
non-traditional lines of credit.
4. Applicant(s) must pay all upfront cost such as required education,
property inspections, earnest money, appraisal, credit reports, moving
expenses, etc. (Some of these funds maybe reimbursed with closing
cost assistance)
5. Homebuyer assistance funds maybe used to for down payment and
closing cost. Applicants must qualify according to the acceptable
program guidelines. Assistance programs that charge the buyer for
the assistance are not acceptable, ie., Nehemiah or Genesis.
6. The minimum assistance is $3,000 and the maximum assistance is
14,999 citywide.
7. Blended resources may not exceed $ 20,000. Blended resources may
include City HAP funds, FHLB or etc.
8. Gifted funds will be calculated as per Fannie Mae/FHA requirements.
9. The qualifying ratios for persons with disabilities are up to 50% housing
and 50% housing and debt. (As per Fannie Mae/HOYO)
10.Fannie Mae requires that these loans be manually underwritten.
11.First lien loans must be fully amortized at a fixed rate up to 30 years
and no less than 5 years.
12.Applicant(s) may select any loan product or services they qualify for.
However, adjustable rate mortgages (ARM) are not allowed.
13.Interest rate not to exceed Dallas Prime market rate by more than
1.25%.
14.Properties must be located in within the city limits of Fort Worth to
qualify for down payment and closing cost assistance with the City of
Fort Worth.
15.The sales price of the home cannot exceed $ 116,800.00.
16.Funds may be used to purchase a single-family home only. This
includes condominiums and a single side of duplex.
17.All properties must be inspected and meet City of Fort Worth Housing
Quality Standards (HQS), Texas Minimum Construction
standards and/or local building codes. No federal funds may be
expended for down payment and closing cost assistance prior to the
receipt of an approved HQS.
18. All properties must meet criteria set forth in the Environmental Review.
No federal funds may be expended for down payment and closing cost
assistance prior to the receipt of the completed environmental review.
Catastrophic Clause: If a catastrophic event occurs the Borrower is
not subject to foreclosure by subordinate lien holders.

SUBJECT:
Reallocation of Home Investment Partnerships Program Funds for United Cerebral Palsy of Tarrant
County to Provide Funding for Counseling and Financial Assistance in Home Purchases by
Individuals with Disabilities
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the reallocation and use of $205,938 in HOME Investment Partnerships Program (HOME)
funds to United Cerebral Palsy of Tarrant County (UCP-TC)for homebuyers assistance, housing counseling
and program operating support; and
2. Authorize the City Manager to execute a contract with UCP-TC, not to exceed a total of $205,938;
and
3. Authorize the contract performance period to begin on the date of contract execution and end twelve
(12) months thereafter; and
4. Authorize extension or renewal of the contract in writing for up to an additional twelve (12) months, if
UCP-TC requests an extension; and
5. Authorize the City Manager to amend the contract, if necessary, to achieve project goals provided that
the amendment is within the scope of the original project and in compliance with applicable laws and
regulations.
DISCUSSION:
The HOME Investment Partnerships Program is intended to be a partnership between federal, state and
local governments, and non-profit and for-profit agencies who build, own, manage, finance and support low
income housing initiatives. HOME Participating Jurisdictions (PJs), such as the City of Fort Worth, are
particularly encouraged to work with existing community-based, non-profit housing organizations, such as
UCP-TC.
A Notice of Funding Availability (NOFA) was issued for HOME Affordable Housing Development Fund
(AHDF) funding. UCP-TC submitted a proposal in response to the NOFA.
UCP-TC is proposing a continuation of their Home of Your Own (HOYO) program, a partnership with
Fannie Mae, participating lenders (e.g., Texas Bank and Colonial Savings) and the City of Fort
Worth. Through this program, UCP-TC assists individuals with disabilities or families with a member who
has disabilities to become homeowners. UCP-TC undertakes outreach, determines applicant eligibility, and
provides housing counseling and homebuyer's down payment/closing cost assistance. It has assisted 20
households through the HOYO program and proposes to assist twelve (12) more with this funding request.
