HomeMy WebLinkAboutResolution 3351-05-2006RESOLUTION NO. 3351-OS-2006 CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL CITY OF FORT WORTH ELECTION HELD ON MAY 13, 200b, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, FOR ADOPTION OR REJECTION, PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF FORT WORTH WHEREAS, on January 24 2006, the City Council of the City of Fort Worth adopted Ordinance No 16797-O1 2006, later amended by 16824-02 2006, 16842-03-2006 and 16873-03-2006, ordering an election to be held on Saturday May 13 2006 for the adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth and authorizing the City Council to designate the places at which said election is to be held, and WHEREAS, on May 13 2006, an election was held at which the qualified voters of the City had the opportunity to vote for the purpose of adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth; and WHEREAS, pursuant to Chapter 67 ofthe Texas Election Code, the City Council of the City of Fort Worth is required to hold a special election and canvass the returns and declare the results of the election, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1. That the findings contained in the preamble of this Resolution are hereby found to be true and correct; and shall be made a part hereof. SECTION 2. That the City Council hereby finds a special election regarding the adoption or rejection ofproposed amendments to the existing charter of the City of Fort Worth was held on May 13 2006, at which election qualified voters were given the opportunity to vote for the purpose of adoption ar rejectian of proposed amendments to the existing charter of the City of Fort Worth. SECTION 3. That the City Council further finds that the returns for such elections are as follows: PROPOSITION 1 An amendment of the City Charter, Chapter III, Section 3 to be effective October 1 2006 to FOR 9 003 increase the compensation paid to each City Council member to $25,000.00 per year and AGAINST 5,850 $29 000 00 per year for the Mayor 1~IC"1~'"~d° ilr+~` ~"~~~' ''I11A'~~l~''~ PROPOSITION 2 An amendment to the City Charter Chapter III, Section 5 to reduce the number of required meetings of the City Council from 48 to 44 per year to include both regular and special meetings in the minimum number of meetings, and to delete the minimum number of council meetings per month and maximum number of meetings per week. FOR 10;571 AGAINST 4,133 PROPOSITION 3 An amendment to the City Charter Chapter III, Section 4 and Chapter IV Section 2, providing that all general, special and run off elections be conducted on a date specified by state law PROPOSITION 4 An amendment to the Crty Charter Chapter III, Section 5 to provide that the swearing in of newly elected council. members will occur at the first City Council meeting after canvassing the election results. FOR 12,952 AGAINST 1661 FOR 13,232 AGAINST 1,263 PROPOSITION 5 An amendment to Chapter III, Section 8 ofthe Crty Charter to provide that if a City Council member shall become a candidate for nomination or election to any other public office, the member shall forfeit his or her council office but shall continue to hold the office until a successor is duly qualified, if the holding over in office is required by state law FOR 12,508 AGAINST 2,084 ~'"~"~ ~ ~1~E'~ `GMA'T' 2 PROPOSITION 6 An .amendment to the City Charter Chapter IV FOR 13 727 Section 1 and Chapter IV Section 3 to provide that in addition to complying with state law AGAINST 1 066 residence requirements, a candidate for Mayor or City Council must have continuously lived in the Council District for which he or she seeks election for 6 full months before the first allowed filing date for the election. PROPOSITION 7 An amendment to the City Charter Chapter V FOR 7,980 Section 4 to delete the requirement that the City Manager post a bond. AGAINST 6,185 PROPOSITION 8 An amendment to Chapter XXI, Section 5 of the City Charter to revise the publication and referendum requirements for the sale of Crty- FOR 8,711 owned property to increase the value of the property covered by the publication requirement AGAINST 5 150 from $25 000 to $125 000 and to increase the number of required signatures for a referendum on the sale from 500 to ten percent (10%) of the number of voters who voted in the most recent mayoral election. PROPOSITION 9 An amendment to the City Charter Chapter FOR 11 198 XXII, Section 5 to provide that bids will be filed and opened by the City Manager or his or her AGAINST 2,817 designee. 3 Resolution No. 3351-OS-2006 PROPOSITION 10 An amendment to the City Charter Chapter FOR 11,550 ~XII, Section 6, to provide that Improvement Contracts shall be signed by the City Manager or AGAINST 2,510 his or her designee. PROPOSITION 11 An amendment to delete obsolete provisions in FOR 10,683 Chapter XXIV Section 3 and Chapter XXIV Section 14 of the City Charter regarding the AGAINST 3,326 collection of school taxes and the inclusion of school taxes in the calculation of a maximum tax rate. PROPOSITION 12 An amendment to Chapter XXV Section 2 of FOR 10 442 the Crty Charter to allow the publishing of a summary ofthe ordinance granting a franchise or AGAINST 3 485 easement across or upon streets or public places instead of the entire ordinance. PROPOSITION 13 An amendment to the City Charter to delete FOR 9,379 Chapter XXVII, Section 6 to conform with federal law prohibiting the city from giving AGAINST 4 840 preference to Fort Worth citizens when huing department heads and assistant department heads. PROPOSITION 14 FOR 9,982 An amendment to the Crty Charter to delete Chapter XXVII, Section 8 requirement to add AGAINST 3 946 standardized wage rate language in city contracts. 4 Resolution No. 3351-OS-2006 PROPOSITION 15 An amendment to Chapter XXVII, Section 16 of FOR 11 847 the City Charter to provide that an officer or an employee of a bank that serves as the Crty's AGAINST 2,500 depository bank shall be deemed not to have a financial interest m a city contract. SECTION 4. That the City Council further finds that such returns are correct, and adopts them as the returns of the special election held on May 13 2006, a copy of the Official Cumulative Report is attached hereto as Exhibit A and incorporated herein, an Official Precinct Report is on file with the Fort Worth City Secretary's Office. SECTION 5. That the above fisted Propositions be declared adopted by the City of Fort Worth and the Fort Worth Charter shall be amended to reflect the above adopted Propositions. SECTION 6. That the meeting of the Fort Worth City Council, at which this Resolution was adopted, was open to the public and that public notice of the tune, place and purpose of said meeting and given, as required by Chapter 551 of the Texas Government Code.
