. 46 ORDINANCE NO. `C-3-77 AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF ANGLE AVENUE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. ANGLE AVENUE: From 28th Street to Columbus Avenue, known and designated as Unit No. 3, a 7-inch reinforced concrete pavement on a 44-foot roadway. 2. CLIFF AVENUE: From Clinton Avenue to Angle Avenue, known and designated as Unit No. 4, a 7-inch reinforced concrete pavement on a 44-foot roadway. 3. CLINTON AVENUE: From 25th Street to 28th Street, known and designated as Unit No. 5, a 7-inch reinforced concrete pavement on a 44-foot roadway. • • together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with TEXAS BITULITHIC COMPANY ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been ex- amined. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street, avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: ANGLE AVENUE: From 28th Street to Columbus Avenue, known and designated as Unit No. 3. The estimated cost of improvements is $1744$1.25 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 2.12 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $ 9.33 ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 11.45 CLIFF AVENUE: From Clinton Avenue to Angle Avenue, known and designated as Unit No. 4. The estimated cost of improvements is $_98,187.16 - ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 2.12 the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $ 9.33 ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 11.45 CLINTON AVENUE: From 25th Street to 28th Street, known and designated as Unit No. 5. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all own- ing or claiming any property abutting upon said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the-7_—day of June , 19 65 , at 9:30 A.M. , in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses- sion, now benig shown as Article 1105b of Vernon's Texas Civil Statutes. Such notice shall be by advertisement at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions -of said Act. The City Secretary is further directed to give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notices to any owner or other person claiming an interest in the property to be assessed when the addess of such owner or other person claiming an interest in the property to be assessed is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons own- ing or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. APPROVED AS TO FORM AND LEGALITY: City Attorney ATTACHMENT "A" Page 1 of 3 CITY OF FORT WORTH PUBLIC WORKS DEPARTMENT ENGINEERING DIVISION ASSESSMENT PAVING CfFJCII Rt CORD ANGLE - CLIFF - CLINTON PROJECT NO. 094-22000-101 CITY SECRETARY RESUME OF PROJECT ET. rRT7, lEX A Neighborhood Hearing was conducted by the Public Works Department on April 12, 1965, at the M. L. Kirkpatrick Elementary School for the improvement of Angle-Cliff-Clinton from Columbus Street to N.W. 25th Street. The procedures concerning owner participation in the cost of paving, including methods and policies of determining assessments, street construction standards, and method of payment were explained to the 30 persons in attendance. PROJECT DESCRIPTION The improvement of Angle Avenue, Cliff Avenue and Clinton Avenue is included in the 1965 Capital Improvement Program (A-18) . This facility will serve as a connection between the North Main business district and Long Avenue - 33rd Street and will afford improved access to potential industrial and residential development on the north edge of the city. Angle Avenue and Cliff Avenue are now hard surfaced with penetration asphalt pavement which is not to line and grade. Clinton Avenue has been resurfaced in recent years but property owners did not participate in the cost of street improvements . Normal assess- ment procedures for new pavement were used in computing assessments on the entire project. CITIZEN COMMENTS UNIT 3 - ANGLE AVENUE - 28th Street to Columbus Avenue. Mr. Phillip, an attorney representing Mr. R. C. Hanger owner of Lots 10 11 and 12, Block 48, M. G. Ellis Addition, stated that his client was opposed to the paving because he did not feel the property was enhanced in the amount of the assessment. The property is bounded by N. W. 28th Street, Cliff Street, and Angle Avenue and includes a vacant church building. The property, zoned commercial, is subject to assessments for the paving of Cliff Avenue and Angle Avenue. Mr. Phillips inquired whether a uniform assessment rate was used throughout the project to assess commercial property. Mr. Phillips was advised that the assessments are made on a uniform basis, except in cases where the assessment is determined to be greater than the enhancement of property values. The property was assessed $1,097.92 for improvements on Angle Avenue and $1,490.69 for improvements on Cliff Avenue, making a total assessment of $2,588.61. Standard credits in the amount of $1,508.35 for shallow lot, converging lot and for narrow pavement on Angle Avenue were given to this property. It is the opinion of the Public Works Department that the property is enhanced in value in an amount equal to or greater than the assessment. UNIT 4 - CLIFF AVENUE - Clinton Avenue to Angle Avenue. Mr. Willard Thomas 3029 Race Street Lots 10 and 11 Block 36 M. G. Ellis Addition asked if the City planned to purchase any of his property for right-of-way purposes and questioned the authenticity of the property line established by the City. Mr. Thomas was informed that the City did not require any of his property for right-of-way. ATTACHMENT "A" Page 2 of 3 Mrs. Theodore Thompson, 2237 Ridgeview, Lot 5, Block 47, M. G. Ellis Addition, requested information why she was not notified when the zoning was designated commercial. Research of zoning records indicates that the property was zoned commercial in the initial zoning ordinance, effective October 1, 1940. Notice of zoning designated at that time was by publication of the zoning ordinance 2082 in pamphlet form. Mrs. L. D. Stewart, 721 Cliff Avenue, Lot 6, Block 47, M. G. Ellis Addition, requested information whether she would be reimbursed for removal of trees in front of her property. Mrs. Stewart was advised it is City policy not to pay property owners for trees removed from the dedicated right-of-way. Mr. Joel Rosen, 312 N.W. 25th Street, east 45' of Lots 23 and 24, Block 45, M. G. Ellis Addition, whose property fronts on 27th Street, stated he did not understand why he was being assessed for paving on Cliff Avenue. It was explained to Mr. Rosen that the paving of Cliff Avenue extended onto 27th Street for a short distance and that new paving was being constructed on 27th Street adjacent to his property. Mr. Rosen also inquired about the purpose of the Neighborhood Hearing and said the property owners would have no voice in determining whether the street should not be paved. He also stated his opinion that the cost was too high and the paving not necessary. Mr. Rosen was provided information that the street improvements were authorized by Voters in the 1958 bond election and that the sentiments of the property owners, as reflected in the poll card survey, would be presented to the City Council at the Benefit Hearing. It was also explained that the purpose of the Neighborhood Hearing was to explain the City's procedures for street im- provements and assessments to interested property owners , and' too answer aa133 ,questions'. raised, 'rather' than decide whether the street should be paved. Mr. James Early, 2800 Lincoln, Lot 30, Block 53, M. G. Ellis Addition, did not understand why he was being assessed on the Cliff Avenue paving project when his property fronted on Lincoln Avenue. Information was provided to Mr. Early that the part of Lincoln Avenue adjacent to his property was being paved in conjunction with the paving of Cliff Avenue. Mr. 0. E. Hardeman 3002 Lee Lots 17 and 18 Block 37 . M. G. Ellis Addition.. inquired what the City planned to do about Lots 11 and 12, Block 48, M. G. Ellis Addition. Mr. Hardeman was informed that the City planned to purchase this property for right-of-way and he was advised to contact the City Land Agent about negotiations for the sale of the property. Mr. Hardeman has subsequently met with a City Land Agent and negotiations for the acquisition of the property are nearly complete. UNIT 5 - CLINCON AVENUE - N.W. 25th Street to N.W. 28th Street Mr. E. Rosen, 312 N.W. 25th Street, Lot 24, Block 23, M. G. Ellis Addition, asked if fifty-one percent or more of the front footage had to be petitioned by property owners be- fore the street would be paved. It was explained that specific streets authorized by the City Council are not considered on a petition basis and there is no requirement for a majority of the property owners to be in favor of the improvements . Mr. Rosen also stated that Clinton Avenue from Cliff Avenue to N.W. 25th Street was paved several years ago. Re- cords of the Public Works Department indicate the street was resurfaced with 1z-inch hot-mix asphaltic paving under a contract with Texas Bitulithic Company as part of the City's pro- gram to resurface existing streets ; was accepted on July 2, 1962, and that no assessments were levied for the resurfacing. Only residentially zoned side lots were appraised. Clinton Avenue also will be widened to 60 feet at the Cliff Avenue intersection. The project was authorized by voters in the 1958 bond improvement election (CIP A-18) .
