WHEREAS, The City of Fort Worth ("City") and Perkins+Will, Inc. ("Architect") made
and entered into City Secretary Contract No. 47468 (the Contract) which was
authorized by the City Council by M&C C-27600, the 12th day of January, 2016, for the
design of the Far North Library; and Amendment No. 1 was administratively executed in
the amount of $00.00 (zero) dollars to include the designated Attachment "A" to the
Amendment No. 1; and
WHEREAS, further amendment is necessary to reimburse the Architect as part of the
design services agreement for additional design services to provide reciprocal access
easement exhibits.
NOW THEREFORE, City and Architect, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article I, (6) - Scope of Services, a paragraph shall be added to read as follows:
Provide additional design services by the Architect's Civil Engineering consultant
to complete easement vacation exhibits and create access easement exhibits.
The cost of this additional service is $6,000.00 with no additional reimbursable
expenses. The scope of services is described more fully in Perkin+Will's letter,
Attachment "B" dated February 23, 2017, subject: "Re: Fort Worth Far North
Branch Library, Reciprocal Access Easement Exhibits Additional Service
Request (Rev. 2)".

Article II, (1) - Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "B". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "B". However the total fee paid by the City shall not
exceed a total of $660,900.00 which includes $15,000.00 in reimbursable
expenses unless the City and the Consultant mutually agree upon a fee amount
for additional services and amend this Agreement accordingly."
3.
All other provisions of this Contract which are not expressly amended herein shall
remain in full force and effect.

Reciprocal Access Easement Exhibits Additional Service Request (Rev. 2)
Dear Alfonso,
Per your request, this additional services proposal includes a fee proposal from Pacheco Koch (our
contracted Civil engineer on the project) to complete (2) easement vacation exhibits as well as the
(2) access easement exhibits, for the Far North Branch Library property. The total for this additional
proposed work is $6,000, per the attached proposal from Pacheco Koch.
Please let us know if this is acceptable, and we will begin the documentation.

Access Easement Exhibits
Fort Worth, Tarrant County, Texas
Dear Mr. Strasius:
As you are aware, Pacheco Koch Consulting Engineers, Inc. has been requested to provide
services on the referenced site that we believe are outside the Scope of Work of our revised
proposal dated July 25, 2016 and subsequent additional services proposals as applicable. The
scope is preparation of four survey exhibits for the referenced project. The first exhibit is for
vacation of portions of an existing Reciprocal Access Easement, dedicated by Instrument No.
D216206565. The second exhibit is for vacation of a 15-foot public access easement and a 10' x
10' public open space easement, dedicated by Instrument No. D215133910. The third exhibit is
for dedication of a new Reciprocal Access Easement. The fourth exhibit is for dedication of a new
Access Easement. The subject easements to be vacated and/or dedicated are shown on the
attached Exhibit A. These services are as follows:
EASEMENT VACATION EXHIBITS: Pacheco Koch will prepare standard documents required
for vacating two existing access easements on the referenced. site as necessary.
Included in this item:
■ Survey exhibits and metes and bounds descriptions for each easement being vacated
for the referenced project.
■ If requested, Coordination with City staff for application and approval of said
vacation.
Not included in this item:
■ Coordination with property owners.
■ Monumentation of easement corners.
ACCESS EASEMENT EXHIBITS: Based on a boundary survey of the site prepared by our office,
Pacheco Koch will prepare a separate instrument dedication document for two access
easements required as a part of development of the site.
Included in this item:
■ Dedication statement, survey exhibit and metes and bounds description for the
easements.
■ Coordination with City staff for review and approval of each easement.
Not included in this item:
■ Coordination with property owners.
■ Monumentation of easement corners.

We propose that the fee for our current contract be increased to cover personnel expenses
involved in these changes as follows:
EASEMENT VACATION EXHIBITS (2 @$1,500.00 each) $ 3,000.00*
ACCESS EASEMENT EXHIBITS (2 @$),500.00 eachJ $ 3,000.00*
TOTAL $ 6,000.00
Terms and conditions shall be the same as per our original agreement.
*Please note that boundary surveying and related services are subject to state and local sales tax.
Sales tax is not included in the fees above. It is our understanding that the work described in this
proposal will be performed under a subcontract to a Prime Agreement between Perkins + Will and
City of Fort Worth, a tax-exempt entity. If Perkins + Will provides Pacheco Koch with a"Texas Sales
and Use Tax Exemption Certificate" or a"Texas Sales and Use Tax Resale Certificate" prior to
Pacheco Koch beginning work, then sales tax will not be charged when these services are
invoiced.
Please note that the fees above are based on the assumption that Pacheco Koch will perform
the above services all together for this project. In the event any item is deleted from the scope of
work, Pacheco Koch reserves the right to adjust the fees for other items as appropriate.
If this request is acceptable to you as presented, please sign where indicated below and return
to our office for our mutual agreement. If you have any questions or need any additional
information, please call me at your earliest convenience.
