HomeMy WebLinkAboutOrdinance 5779 ORDINANCE NO. „:5- 77c1 AN ORDINANCE AMENDING ORDINANCE NO. 3011 , BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKrNG AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011 ; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5,00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL. OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-67-46 Lot 4 and the residue of Lot 5, Block 49, M. G. Ellis Addition. (2707 Lincoln Avenue) FROM "B” TO "I" Z-67-47 West 50 feet of Lots 8 through 30, Taylor and McBrayer Addition. (Rear of the 2500-2600 Blocks of Warfield Street west side) FROM "B" TO "I" Z-67-53 Tract 1 , Block 1 , Ridglea Country Club Estates (Southside of Ridglea Country Club Drive, west of the 5200 Block Southwest Loop) FROM "A" TO "C-R" Z-67-54 East portion of Block 6, Ridglea Country Club Estates , lying within Fort Worth City Limits. Thence in an easterly direction along a line 250 feet south and parallel to the south right-of-way line of Charbonneau Road and the south right-of-way line of Jacksboro Highway, and 50 feet south of and parallel to the Fort Worth City Limit Line established by Ordinance No. 3717, to a point being North 48°21 ' West 1163.67 feet from the Southwest corner of Lot 8, Block A, Shady Oaks Manor Addition, and being the N.E. corner of a tract previously zoned "F" Commercial . H. F. spur track to the Trinity Portland Cement Plant; and continuing south- westerly along the present City of Fort Worth City Limit Line to the place of beginning and containing approximately 6.60 square miles. UNZONED TO "AG" Z-67-37 Lots 13 through 24, Block 53; and Lots 1 through 12, Block 54, Ryan and Pruitt Addition. (3300 Block South Jones Street) FROM "B" TO "I" SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general Welfare of the community. They have been designed to lessen congestion in the streets ; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance, SECTION 40 Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys , omits , neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200,00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6.
