Regarding Changes in the Housing Tax Credit Program Qualified Allocation Plan and Rules with
Amendments
WHEREAS, the Texas Municipal League (TML) will hold its annual conference on October 25-27
2006, in Austin, Texas, and will consider resolutions supported. by TML members and affiliates in
anticipation of the 2007 state Legislative session; and
WHEREAS, recent trends continue to indicate that mixed income properties, that is properties whom
combine market rate housing units with a portion of units available for families earning Less than 60% of
a geographic area s median income, are needed and desired in many city neighborhoods; and
WHEREAS, Texas cities, in response to the urgent need of quality affordable housing, are requesting
changes to Housing Tax Credit Program Qualified Allocation Plan and Rules with Amendments (QAP)
administered by the Texas Department of Housing and Community Affairs(TDHCA}, and
WHEREAS, the current QAP as administered by TDHCA provides the maximum number of points
only for projects that have 100% of units dedicated to families earning less than 60% of area median
income, and proposals for mined income tax credit projects are therefore at a significant disadvantage;
and
WHEREAS, the current scoring process does not provide for additional points for Local jurisdiction
approval of development applications; and
WHEREAS, the federal Low Income Housing Tax Credit (LIHTC) requirement authorizes flexibility
regarding mixed income properties by authorizing tax credits for properties that have either 40% of units
affordable at 60% of Area Median Gross Income (AMGI} or 20% of units affordable at 50% of AMGI,
however, the TDHCA has elected not to ut7ize this flexibility and
WHEREAS, Texas cities are requesting that the QAP be modified to provide the maximum points
available to applicants whose development proposals meet the minimum federal LIHTC requirement of
either 40% of units affordable at 60% of AMGI or 20% of units affordable at 50% of AMGI, thereby
placing truly mixed income housing properties on an even, competitive footvng with other project
proposals.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FORT WORTH
HEREBY RESOLVES:

1 To request that the Texas Municipal League seek introduction of or support legislation that
would authorize the Texas Department of Housing and Community Affairs to modify the
Housing Tax Credit Program Qualified Allocation Plan and Rules with Amendments to
authorize preferences in scoring for mixed income properties and to authorize additional
scoring for properties with proof of local jurisdictional approval.
2. That the City Manager is authorized to forward a copy of this resolution to Mr Frank Sturzl,
Executive Dtrector of the Texas Municipal League.
