HomeMy WebLinkAboutResolution 3437-12-2006A Resolution NO 343712-2006 A RESOLUTION APPROVING THE RELOCATION OF AN EXISTING STATE OF TEXAS DRAINAGE EASEMENT AT DALLAS/FORT WORTH INTERNATIONAL AIRPORT, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONVEYANCE OF A NEW DRAINAGE EASEMENT TO THE STATE AND APPROVING AND ACCEPTING THE RELEASE FROM THE STATE VACATING THE ORIGINAL DRAINAGE EASEMENT WHEREAS, on July 6 2006 the Dallas/Fort Worth International Airport Board (Airport Board) approved resolution No 2006-07 239 requesting that the Cities of Fort Worth and Dallas (1) approve the relocation of an existing State of Texas Drainage Easement containing approximately 88,427 square feet (2 03 acres) to another tract of land located on Dallas/Fort Worth International Airport (Airport) property (2) approve and execute the appropriate easement to the State of Texas conveying approximately 88,427 square feet (2.03 acres) for use as a drainage easement; and (3) approve and accept the appropriate release from the State vacating and abandoning the original drainage easement to the Cities for the benefit of the Airport; and WHEREAS, future development m the Airport's International Commerce Park requires that an existing drainage easement of the State of Texas be relocated to a new location on Airport property as more particularly described m Exhibit A and WHEREAS, the State of Texas, through the Texas Department of Transportation has agreed to the relocation of the drainage easement; and WHEREAS, the relocation of the drainage easement along the northerly side of State HWY 114 will remove an obstacle to existing development m International Commerce Park and will provide an improved drainage area to handle additional runoff from future development; and WHEREAS, the 1968 Contract and Agreement between the Cities of Fort Worth and Dallas require that all conveyances and all acquisitions of interests m real property at Dallas/Fort Worth International Airport be authorized and executed by the respective cities, and, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT Section 1 The Crty Council approves of the relocation of an existing State of Texas drainage easement containing approximately 88 427 square feet (2.03 acres) of land be relocated to a new location on Dallas/Fort Worth International Airport property containing approximately 88 427 square feet of land. The City Manager is authorized to execute the appropriate drainage easement to convey 88 427 square feet (2.03 acres) of land to the State of Texas for use as a drainage easement. Section 3. Description: • Development in International Commerce Park requires that an existing Drainage Easement of the State of Texas be relocated to a new location on Airport property The original Drainage Easement as conveyed by the City of Dallas and the City of Fort Worth will be relocated along the northerly side of State HWY 114 so as not to interfere with future development within International Commerce Park. The Texas Department of Transportation has agreed to the relocation of the Drainage Easement. This will be an equal value exchange of easement areas on a square foot foi'"square foot basis. Justification: • The relocation of the Drainage Easement along the northerly side of State HWY 114 will remove an obstacle to existing development in International Gommerce Park and will provide an improved drainage area to handle additional water runoff from future development. Additional Information: o This is an even exchange of fair market value on a square foot for square foot basis. • This action will not result in any change in the Airport's land mass. • This is an exchange of one easement area of Airport property for another The land for each of the easement areas was not acquired under any Federal Aviation Administration AIP Grant. • This action does not fall under the requirements of FAA Order 5190.bA as it does not alter and does not allow for any construction, modification, or improvement that is inconsistent with either the Airport Layout Plan or the Airport Property Map. • Strategic Plan Benefits: Approval of this action is consistent with Airport Board policies regarding growing the business and in optimizing the use of Board resources. DISCUSSION At its meeting on July 6 2006 the Dallas/Fort Worth Airport Board (Airport Board) approved a resolution approving the relocation of a drainage easement granted to the State of Texas on October 13 1980 to another tract of land on Dallas/Fort Worth International Airport (Airport) property and requested that the City Councils of Fort Worth and Dallas approve the relocation of the drainage easement, approve and execute the appropriate drainage easement conveying the approximate 88 427 square feet (2 03 acres) to the State of Texas and approve and accept the appropriate release vacating and abandoning the original drainage easement to the Cities for the benefit of the Airport. Both state law and the 1968 Contract and Agreement between the Cities of Fort Worth and Dallas require that all conveyances and acquisitions of interest in real property at Dallas/Fort Worth International Airport be approved by the Councils of both cities. Future industrial warehouse development at the Airport's International Commerce Park requires that an existing drainage easement containing approximately 88 427 square feet of land be relocated to a new location on Airport property The State of Texas has agreed to the relocation of the drainage easement. This will be an equal value exchange of easement areas of a square foot for square foot basis. This action will not result in any change in the Airport's land mass.
