HomeMy WebLinkAboutOrdinance 5771 ORDINANCE NO. � �__� AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF Texas Street AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO TU OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort.Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fart Worth, Tera, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. Texas Street, North Side: From the Bast line of Henderson Street to 1001 Fast of the East line of Taylor Street, known and designated as Unit 1, Sec. la, Project No. 104-35000-301, sidewalks and driveway approaches. 2. Texas Street, Bouth Side: From the West line of Monroe Street to 501 Bast of the East line of Taylor Street, known and designated as Unit 1, Sec. lb, Project No. 104-35000-301, sidewalks and driveway approaches. 3. Taylor Street, East Side: From the South line of 13th Street to the North line of Lancaster Avenue, known and designated as Unit 1, Sec. 3d, Project No. 104--35000-301, sidewalks and driveway approaches. Together with combined concrete curbs and gutters on proper grade and line where same are not alreedy so constructed, to'-ether with storm sewers and drains and other necessary in- cidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and. entered into with Grimes Construction Company and WHEREAS, the City Council of the City of Fort Worth has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof for the construction and reconstruction of curbs and gutters and estimates of the amounts per square foot proposed to be assessed against abutting property owners thereof for the constJ7uction and reconstruction of sidewalks and driveway approaches and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and anp roved. II. After having fully considered the cost of improvements on each portion of highway ordered improved, the nature of such improvements, the nature of the existing improve- ments, the special benefits in enhanced value to be received by the parcels of property which abut the portion of the street or sidewalks being improved, the equities of the owners of such parcels of property, and the adjustment of the apportionment and assess- ment of the costs of the improvements so as to produce substantial equality of benefits received and burdens imposed,- the City Council hereby finds as provided in Article 1105b, Section, 7, of the Revised Civil Statutes of Texas that in the construction and reconstruc- tion of sidewalks and driveway approaches the application of the front foot plan or rule would result in injustices and inequalities to the parcels of property and the owners thereof which abut the portion of the streets, sidewalks and/or driveway approaches being improved; the City Council further finds that the method of computing and apportioning the assessment of the cost of construction and reconstruction of sidewalks and driveway approaches which will produce the greatest justice and equality, as between the parcels of abutting property and the owners thereof, is the square foot basis in which the costs are assessed against the parcels of abutting property in the proportion which the number of square feet of sidewalk or driveway approach to be constructed or reconstructed in the portion of the street abutting each such parcel bears to the total number of square feet of sidewalks or driveway approaches to be constructed or reconstructed in the unit. The City Council further finds that the application of the front foot plan rule will produce justice and equality of assessments in cases where curb and gutter is being constructed and reconstructed. TEXAS STRE10, NORTH SIDE: From the East line of Henderson Street to 1001 East of the East line of Taylor Street, known and designated as Unit 1, Sec. la, Project No. 101-35000-301. The estimated cost of improvements is $ 12,265.25 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 2.12 ; the estimated amount per sq. ft. of driveway approach to be assessed against abutting property and the owners thereof is $ .60 ; the estimated amount per square foot of sidewalk to be assessed against abutting property and the owners thereof is $ .59 III. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all own- ing or claiming any property abutting upon said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the�.�day of 19_T, at 9:30 a.m. , in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses- sion, now benig shown as Article 1105b of Vernon's Texas Civil Statutes. Such notice shall be by advertisement at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act. The City Secretary is further directed to'give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notices to any owner or other person claiming an interest in the property to be assessed when the addess of such owner or other person claiming an interest in the property to,be assessed is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those persons own- ing or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been, given by newspaper advertisement as first hereinabove provided. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records of this City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Contract Award - Sidewalk, Curb PAGE NUMBER and Gutter Improvement Program on Texas, 1 of 3 4/17/67 C-933 Tenth and Taylor Streets (CIP A-238) Council action on the project described below is requested: Proiect Description Nature of work: The improvement of deteriorated or missing sidewalk, curb, and gutter on Texas, Tenth and Taylor Streets in the Downtown area was authorized by the City Council on January 24, 1966 (M&C G-886), in response to requests for initiation of an orderly program to im- prove hazardous and unsightly sidewalk, curb and gutter in the down- town area. Under the plan authorized by the City Council, the City would pay for replacement of all deteriorated curb and gutter, and adjacent property owners would pay for replacement of deteriorated sidewalk, and missing sidewalk, curb and gutter. Cooperation of pub- lic and private utilities has been obtained to place overhead wires underground on these streets, and vaults in the sidewalks will be built at City cost for planting trees on the streets by the Park and Recreation Department.
