HomeMy WebLinkAboutOrdinance 5871 F ORDINANCE NO. `' 7 AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF Long Avenue Extension AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO TIS OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit: 1. Long Avenue Extension: From the East Line of Deen Road to the East line of N. E. 33rd. Street, known and desig- nated as Unit 9, Project No. 104-23000-104, Contract 7, a 7 inch reinforced concrete pavement with lime treated sub-grade on a 64 foot roadway. 2. Long Avenue Extension: From the East Line of N.E. 33rd. Street to the West line of Sylvania Avenue, known and desig- nated as Unit 10, Project No. 104-23000-104, Contract 7, a 7 inch reinforced concrete pave- ment with lime treated sub-grade on a 64 foot road- way. 3. N E. 36th. Street: From the East line of Long Avenue Extension to the West line of Sylvania Avenue, known and designated as Unit 10A, Project No. 104-23000- 104, Contract 7, a 7 inch reinforced concrete pavement with lime treated sub-grade on a 40 foot roadway 4. Sylvania Avenue: From the North line of N.E. 36th. Street to 863 feet north, known and designated as Unit 10B, Project No. 104-23000-104, Contract 7, a 7-inch reinforced concrete pavement with lime treated sub-grade on a 52 foot roadway. together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with J. L. Bertram Coastruction & Engineering ; and WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public Works Director to prepare and file estimates of the cost of such improvements and estimates of the amounts per front foot proposed to be assessed against abutting property and the owners thereof, and such estimates have been ex- amined. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approved. II. It is hereby found and determined that the cost of improvements on each portion of street, avenue and public place hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, are as follows, to-wit: Long Avenue Extension: From the East Line of Deen Road to the East line of N. E. 33rd. Street, known and designated as Unit 9, Project No. 104-23000-104, Contract 7. The estimated cost of improvements is $ 187,720.49 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 1-80 ; the estimated amount per front foot to be assessed of 3Qst abutting property and the owners thereof for improvements exclusive of curb and gutter is $ ; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 11.10 Long Avenue Extension: From East line of N.E. 33rd. The estimated cost of improvements is $ 170,472.81 the estimated amount per front foot to be assessed against abutting property and the owners thereof for combined concrete curb and gutter is $ 1.80 ; the estimated amount per front foot to be assessed against abutting property and the owners thereof for improvements exclusive of curb and gutter is $ 9.30 __; the total estimated amount per front foot to be assessed against abutting property and the owners thereof is $ 11.10 together with combined concrete curbs and gutters on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said improvements to be constructed as and where shown on the Plans and in strict accordance with the Plans and Specifications therefor; and contract therefor has been made and entered into with J. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all own- ing or claiming any property abutting upon said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 6th. day of November 19 67 , of 9:30 A.M. , in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses- sion, now benig shown as Article 1105b of Vernon's Texas Civil Statutes. Such notice shall be by advertisement at least three times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least ten days before the date of said hearing. Said notice shall comply with and be in accordance with the terms and provisions of said Act. The City Secretary is further directed to*give personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be given by the City Secretary mailing said notice postage prepaid, to the respective owners of record of the properties to be assessed, and to any person owning or claiming any interest in said properties, to the last known address of said owner or persons. It shall not be necessary for the City Secretary to mail said notices to any owner or other person claiming an interest in the property to be assessed when the addess of such owner or other person claiming an interest in the property to be assessed is unknown to the City Secretary and cannot be determined by the City Secretary after reasonable investigation. In this connection the City Secretary shall prepare and file with these proceedings a list of the properties to be assessed, the names of those Dersons own- ing or claiming any interest in said properties to whom the notice was mailed, together with the last known address of the respective owners and those persons owning or claiming any interest in said property. The.City Secretary shall certify that each of the parties named in said list whose address was known to him, was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed. A copy of the notice shall be attached to such certificate. The certificate of the City Secretary will be conclusive evidence of the facts therein recited. Failure of the City Secretary to give notice of hearing by mail as herein provided for, or failure of the owners or other persons interested to receive said notice, shall in nowise invalidate said hearing or any assessments levied pursuant to said hearing, but notice of hearing shall be sufficient, valid and binding upon all owning or claiming such abutting property or any interest therein when same shall have been given by newspaper advertisement as first hereinabove provided. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council and by filing the complete ordinance in the appropriate Ordinance Records,of this City. Revisions in the alignment had been requested by property owners in the vicinity of the proposed roadway improvements. The original alignment on 36th Street was in- cluded in the contract awarded to J. L. Bertram Construction and Engineering Company on June 5, 1967 (M&C C-972). Negotiations have been completed with the project contractor, and necessary legal instruments have been prepared to initiate assessment paving pro- cedures based on the new alignment. Detailed plans and specifications for con- struction and right-of-way acquisition have also been prepared and are ready for processing by the Land Division upon approval of the proposed change order. Cost of Chance Order Based upon original unit prices bid by the contractor on April 18, 1967, the first alignment of Long Avenue over 36th Street was $299,548.08. The net in- crease in the cost of Long Avenue in the new alignment approximately 500 feet north of 36th Street and the narrowing of 36th Street from 60 to 40 foot wide paving is approximately $120,000, including additional drainage for Long Avenue in its new location and channelization and widening of Sylvania 500 feet north and south of its intersection with Long Avenue. Right-of-way needed for the realignment will cost $28,500 and engineering for the additional work will cost $7,000. Listed below is a detailed schedule of the contract cost as a result of the proposed change order. The change order and related costs can be financed by a trAhs#ifi;KoPtuture bond sales for the City's portion of the added cost of the long A,irenue contract cost, right-of-way and engineering, and from the revolving fund for the property owner's portion of the costs. There are sufficient funds in Project Account No. 094-22000-138 "Sylvania Avenue" to finance the City's portion of t of Sylvania Avenue paving and channelization. oFE�c�, a� C1�y S�Ca DATE RVIER[NCE susiscr:Change Order - Realignment of PAW NUMe[R 10/9/67 0-1083 Long Avenue from Deen Road to y of 2 Sylvania Avenue (CIP A-71) Construction Schedule Long Avenue is now under contract for construction between Deen Road and Syl- vania and work has begun on the portion that would not be involved in the proposed realignment. The benefit hearing for Long Avenue at its original alignment was held on June 19, 1967; therefore, it will be necessary that an- other benefit hearing be held for the Long Avenue Extension, based on the new alignment. The new assessment rolls can be prepared and ready for the benefit hearing proposed for November 6, 1967. The normal procedure for assessment paving is to hold a Neighborhood Meeting, conduct a postcard survey, and hold the benefit hearing before issuing a work order or change order. Because of the work order already issued for Units IX and X on Long Avenue Extension, and because of the inter-relationship with the other portions of the project, it is proposed that the contract be amended and change order issued immediately. State Statutespermit construction proceed ahead of the benefit hearing, providing the hearing be held before the project is completed and accepted by the City Council. It is estimated that completion of the new alignment of Long Avenue Extension, Units IX and X, will require an additional 70 working days.
