SUPPORTING THE INTRODUCTION AND PASSAGE OF LEGISLATION AND
CONSTITUTIONAL AMENDMENT THAT ALLOWS THE CITY OF FORT WORTH TO
CALL FOR AN ELECTION TO DETERMINE WHETHER THE SALE OF ALCOHOLIC
BEVERAGES SHOULD BE ALLOWED
WITHIN A SPECIFIED AREA WITHIN THE CITY AND/OR THE CITY'S
EXTRATERRITORIAL JURSIDICTION
WHEREAS, the City of Fort Worth has grown in land mass over the years through
annexation
WHEREAS, in several of the annexations the new areas added have come into the
City designated as dry" or areas where the sale of alcoholic beverages are prohibited or
restricted
WHEREAS, the different status of these newly annexed areas which come into the
City dry" creates confusion for consumers and creates economic inequities for
businesses like restaurants and grocery stores that locate in these newly annexed areas
because they are prohibited from selling alcoholic beverages or restricted in the sale of
these products
WHEREAS, state law provides for procedures to make an area `wet or a designation
where alcoholic beverage can be sold, however the election procedures including the
petition requirements to call an election are unreasonable and generally unattainable for a
mayor city like Fort Worth
WHEREAS, legislation is needed that will afford the City greater flexibility in the
calling and holding of an election or elections approving the sale of alcoholic beverages
within a specified area of the City and/or its extraterritorial ~unsdiction and defining the
geographic boundary of the area m question and
WHEREAS, the appropriate method for effectuating the needed flexibility is to seek
introduction and passage of legislation that amends the Texas Alcoholic Beverage Code
and possibly a constitutional amendment to specifically address the needs and concerns of
the City of Fort Worth
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS
Supports legislation amending the Texas Alcoholic Beverage Code and where
necessary a constitutional amendment to allow a City the size and characteristics of Fort
Worth to call for an election to determine whether the sale of alcoholic beverages should
be allowed within a specified area within the City and/or its extraterritorial jurisdiction
and
That the City Council directs City staff to work with the Tarrant County State
Delegation and the Texas Legislature to seek passage of the appropriate legislation
