ANDERSON SURVEY, ABSTRACT NO. 21, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 0.188 AND 0.023 ACRES OF LAND RESPECTIVELY, AS RECORDED IN VOLUME 63, PAGE 27-28 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS,PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following alley and street described below: 1. Being that portion of Schadt Avenue, a 60 foot wide right-of-way, situated in the A. Anderson Survey, Abstract No. 21, located between Block 4 and Block 6, Dixie Wagon Manufacturing Co's Addition, an addition to the City of Fort Worth, Tarrant County Texas; as shown on the plat as recorded in Volume 63, Page 27-28 of the Plat Records of Tarrant County, Texas, containing 8,178 square feet(0.188 acre) of land more or less; 2. Being that portion of a 16 foot wide alley situated in the A. Anderson Survey, Abstract No. 21, located in Block 6, Dixie Wagon Manufacturing Co's Addition,an addition to the City of Fort Worth,Tarrant County Texas;as shown on the plat as recorded in Volume 63,Page 27-28 of the Plat Records of Tarrant County, Texas, containing 1,000 square feet(0.023 acre) of land more or less; and as more specifically described in Exhibits "A-B" attached hereto and incorporated herein, by reference be and the same are vacated and extinguished. SECTION 2. That the fee to the land in the above-described street right-of-way is released and shall revert to the adjacent owner as provided by law. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. Adopt the attached ordinance vacating a portion of Schadt Street and an alley to be replatted with the adjoining property to provide room for additional storage space for materials on site for the existing development; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Yazel Peebles and Associates, LLC, on behalf of Vicente Paulin, has requested the vacation of this portion of Schadt Street and an alley to be replatted with the adjoining property for additional storage space for materials on site for the existing development. The City Plan Commission recommended approval of this request at its meeting on December 16, 2016. An acceptable final plat (FS-16-245) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting process. The City does not possess any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way in fee or by easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the street and alley. This project is located in COUNCIL DISTRICT 9, Mapsco 62Y. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
