AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
WILDERMAN STREET, BELKNAP STREET, AND A PORTION OF AN
ALLEY, ALL SITUATED IN THE REBECCA BRIGGS SURVEY,
ABSTRACT NO. 116, TARRANT COUNTY, TEXAS AS SHOWN ON THE
PLATS RECORDED IN VOLUME 56,PAGE 240 AND VOLUME 90,PAGE
516 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That portions of the Wilderman Street, a 50 foot public right-of-way, Belknap Street and a
15 foot wide alley lying between Wolcotts's Subdivision and Provine's Subdivision, all situated
in the Rebecca Briggs Survey,Abstract No. 116, in Wolcott's Subdivision of Sam Evans Addition
and Provine's Addition, City of Fort Worth, Tarrant County, Texas; as recorded Volume 56,Page
240 and Volume 90,Page 516 of the Plat Records of Tarrant County,Texas,and containing 0.811
acre or 35,314 square feet of land more or less,and as more specifically described in Exhibits"A"
and "B" attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easements to the lands in the above-described vacated alley and street rights-of-
way are hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
RIGHT-OF-WAY VACATION FOR WILDERMAN STREET
AND A PORTION OF BELKNAP STREET
BEING 0.811 acre of land located in the REBECCA BRIGGS SURVEY, Abstract No. 116, Fort
Worth, Tarrant County, Texas, and being more specifically all of the 50 foot wide strip of land
dedicated for Wilderman Street, on the plat of Wolcott's Subdivision of Sam Evans Addition,
according to the plat recorded in Volume 56, Page 240, of the Plat Records of Tarrant County,
Texas, and also Provine's Addition, to the City of Fort Worth, Tarrant County, Texas, according
to the plat recorded in Volume 90, Page 516, of the Plat Records of Tarrant County, Texas,
along with a portion of the 15 foot wide alley lying between said Wolcott's Subdivision and
Provine's Addition, and also a portion of Belknap Street. Said 0.811 acre of land being more
particularly described by metes and bounds as follows:
BEGINNING at a '/" iron rod marked "Brittain & Crawford" set, at the Northeast corner of Lot 8,
Block 1, of said Wolcott's Subdivision, and said POINT OF BEGINNING also being the
intersection of the West right-of-way line of Wilderman Street and the South right-of-way line of
Peach Street, and said POINT OF BEGINNING also having Texas State Grid Coordinates
Northing: 6,963,277.22 and Easting: 2,330,480.01;
THENCE N 190 07'46" W 60.98 feet, crossing said Peach Street, to a point in the
North right-of-way line of said Peach Street;
THENCE N 600 34' 540 E 50.82 feet, along the North right-of-way line of said Peach
Street, to a point at the intersection of the East right-of-way line of said Wilderman Street
and the existing West right-of-way line of the Union Pacific Railroad;
THENCE along the existing West right-of-way line of the Union Pacific Railroad and the
East right-of-way line of said Wilderman Street, as follows:
1. S 190 07'46" E 206.58 feet,to a point;
2. S 189 01'21m E 412.60 feet, to a point in the existing North right-of-way Gne of
Belknap Street(an 80 foot wide public right-of-way);

said Belknap Street, to a point;

THENCE N 59"44' 10" E 50.01 feet, along the Southeast boundary line of said Lot

SUBJECT:
Adopt Ordinance Vacating a Portion of Wilderman Street, Belknap Street and a Portion of an Alley in
Between Block 2, Wolcott's Subdivision of Sam Evan Addition and Block 2, Provines Addition for a Future
Railroad Right-of-Way for the New Commuter Rail Line, TEX Rail (COUNCIL DISTRICT 8)
RECOMMENDATION:
It is recommended by the City Plan Commission that the City Council:
1. Adopt the attached ordinance vacating a portion of Wilderman Street, Belknap Street and a portion of
an alley between Block 2, Wolcott's Subdivision of Sam Evans Addition and Block 2, Provines Addition for
new railroad right-of-way for the new commuter rail line, TEX Rail; and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Stateside right-of-way, on behalf of the Fort Worth Transportation Authority, has requested the vacation of
these portions of Wilderman Street, Belknap Street and the alley for new railroad right-of-way for the new
commuter rail line, TEX Rail. The City Plan Commission recommended approval of this request at its
meeting on February 22, 2017. The City Plan Commission also approved a waiver of the requirement to
replat the vacated right-of-way with the adjoining property.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting
process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the
rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance
with the City's policy regarding street and alley vacation transactions approved by the City Council on
March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair
market value or any portion thereof of purchase price of the right-of-way easements for the street and
alley.
This project is located in COUNCIL DISTRICT 8, Mapsco 63T.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on
City funds.
