HomeMy WebLinkAboutOrdinance 22641-03-2017 ORDINANCE NO. 22641-03-2017 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF WILDERMAN STREET, BELKNAP STREET, AND A PORTION OF AN ALLEY, ALL SITUATED IN THE REBECCA BRIGGS SURVEY, ABSTRACT NO. 116, TARRANT COUNTY, TEXAS AS SHOWN ON THE PLATS RECORDED IN VOLUME 56,PAGE 240 AND VOLUME 90,PAGE 516 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That portions of the Wilderman Street, a 50 foot public right-of-way, Belknap Street and a 15 foot wide alley lying between Wolcotts's Subdivision and Provine's Subdivision, all situated in the Rebecca Briggs Survey,Abstract No. 116, in Wolcott's Subdivision of Sam Evans Addition and Provine's Addition, City of Fort Worth, Tarrant County, Texas; as recorded Volume 56,Page 240 and Volume 90,Page 516 of the Plat Records of Tarrant County,Texas,and containing 0.811 acre or 35,314 square feet of land more or less,and as more specifically described in Exhibits"A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easements to the lands in the above-described vacated alley and street rights-of- way are hereby released and shall revert to the adjacent owner as provided by law. Adopt the attached ordinance vacating a portion of Wilderman Street, Belknap Street and a portion of an alley between Block 2, Wolcott's Subdivision of Sam Evans Addition and Block 2, Provines Addition for new railroad right-of-way for the new commuter rail line, TEX Rail; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: Stateside right-of-way, on behalf of the Fort Worth Transportation Authority, has requested the vacation of these portions of Wilderman Street, Belknap Street and the alley for new railroad right-of-way for the new commuter rail line, TEX Rail. The City Plan Commission recommended approval of this request at its meeting on February 22, 2017. The City Plan Commission also approved a waiver of the requirement to replat the vacated right-of-way with the adjoining property. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the street and alley. This project is located in COUNCIL DISTRICT 8, Mapsco 63T. This M&C does not request approval of a contract with a business entity.
