Eisen, its duly authorized City Manager, hereinafter referred to as HALTOM CITY, and the City of Fort Worth, acting herein by and through Mike Groomer, its duly authorized Assistant City Manager, hereinafter referred to as FORT WORTH, both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001- 791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, each governing body agrees to share in the cost of services described below. NOW THEREFORE, HALTOM CITY and FORT WORTH agree as follows: HALTOM CITY agrees to contribute a total of $179,250, in three payments, as described below, for the installation of three (3) traffic signal systems for the following intersections with the stated associated costs: North Beach Street and Fossil Creek Boulevard: $49,250 North Beach Street and Springdale Road: $70,000 North Beach Street and Stanley Keller Road: $60,000 FORT WORTH shall notify HALTOM CITY in writing at least sixty (60) days before it begins installation of each of the traffic signals, and HALTOM CITY shall pay the above- �����a�C� °;� G���C��� �; 0� �����G?���� U �o V�u �� C:'�V� �L7Wo listed amount for the signal that FORT WORTH is installing at least thirty (30) days before FORT WORTH begins the installation. 2. HALTOM CITY shall be responsible for the monthly power cost for the above traffic signal systems. FORT WORTH shall be responsible for maintenance and any other operational expenses regarding these systems and their associated equipment. 3. FORT WORTH agrees to purchase the equipment, install, own, operate and maintain the traffic signal systems, exclusive of power costs, in accordance with the state law and to contribute a total sum of $89,250 for installation of three (3) traffic signal systems for the following intersections with the stated associated costs: North Beach Street and Fossil Creek Boulevard: $49,250 North Beach Street and Springdale Road: $10,000 North Beach Street and Stanley Keller Road: $30,000 FORT WORTH shall complete installation of the traffic signal at North Beach Street and Fossil Creek Boulevard by no later than June 30, 2001. FORT WORTH shall complete installation of the traffic signal at North Beach Street and Springdale Road; and North Beach Street and Stanley Keller Road by no later than December 31, 2001. � Nothing in the performance of this Agreement shall impose any liability for claims against either party hereto other than claims for which the Texas Tort Claims Act may impose liability. 5. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. Can��nun�cA�ian DATE REFERENCE NUMBER LOG NAME PAGE 4/17/01 **C-18555 20TRAFFIC 1 of 2 SUBJECT ADOPTION OF APPROPRIATION ORDINANCE AND INTERLOCAL AGREEMENT WITH HALTOM CITY FOR THE INSTALLATION OF TRAFFIC SIGNAL DEVICES AT THREE LOCATIONS ON BEACH STREET RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements Fund in the amount of $179,250 from increased revenues from Haitom City; and 2. Authorize the City Manager to enter into an Interlocal Agreement with Haltom City for the installation of three new traffic signal systems at the intersections of Beach Street/Fossil Creek Boulevard, Beach Street/Springdale Road, and Beach Street/Stanley Keller Road. DISCUSSION: This agreement will allow Haltom City to participate by providing an estimated total of $179,250, in three payments, for the construction of three new traffic signai systems at the intersections listed below. The total estimated construction cost is $268,500, with cost distribution as follows: Haltom Citv • North Beach Street and Fossil Creek Boulevard $ 49,250 • North Beach Street and Springdale Road $ 70,000 • North Beach Street and Stanley Keller Road 60 000 $179,250 City of Fort Worth $49,250 $10,000 30 000 $89,250 Haltom City is participating in this project because the three intersections are located in Haltom City and Fort Worth. Since the City of Fort Worth will be responsible for maintaining the signals, Haltom City agreed to pay a higher percentage of the total cost (67%). The Transportation and Public Works Department will be responsible for the collection and deposit of funds from Haltom City under this agreement. These three locations were approved for traffic signals based on requirements in the Manual on Uniform Traffic Control Devices. The Transportation and Public Works Department proposes to install fully actuated traffic signals. All three locations are located in COUNCIL DISTRICTS 4, Mapsco 50A, 50S, and 64E.
