AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $228,362,
SUBJECT TO RECEIPT OF THE FISCAL YEAR 2008 EDWARD BYRNE
MEMORIAL JUSTICE ASSISTANCE GRANT FROM THE U.S. DEPARTMENT
OF JUSTICE, A PORTION OF WHICH WILL BE EXPENDED TO PURCHASE
LAW ENFORCEMENT STAFFING SOFTWARE AND RADIOS FOR USE BY
THE CITY OF FORT WORTH, AND THE REMAINDER OF WHICH WILL BE
DISBURSED BY THE CITY OF FORT WORTH, AS THE COGNIZANT FISCAL
AGENCY WITH REGARD TO APPLYING FOR AND DISBURSING FUNDS IN
CONNECTION WITH THE GRANT, TO TARRANT COUNTY AND THE CITY OF
ARLINGTON PURSUANT TO AN INTERLOCAL AGREEMENT; PROVIDING A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That, in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 and in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Grants Fund in the amount of $228,362 subject to receipt of the Fiscal Year
2008 Edward Byrne Memorial Justice Assistance Grant from the U.S. Department of Justice, a
portion of which will be expended to purchase law enforcement staffing software and radios for
use by the City of Fort Worth, and the remainder of which will be disbursed by the City of Fort
Worth, as the cognizant fiscal agency with regard to applying for and disbursing funds in
connection with the grant, to Tarrant County and the City of Arlington, pursuant to an interlocal
agreement.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

to Serve as the Cognizant Fiscal Agency; and Adopt Appropriation Ordinance

RECOMMEfVDAT10N:
It is recommended that the City Council:
1. Conduct a public hearing regarding the application for the Fiscal Year 2008 Edward Byrne Memorial
Justice Assistance Grant to allow the public an opportunity to comment as required under the grant
application;
2. Authorize the City Manager to apply for and accept, if awarded, a grant from the United States
Department of Justice, Office of Justice Programs, Bureau of Justice Assistance for Fiscal Year 2008
Edward Byrne Memorial Justice Assistance Grant, not to exceed $228,362.00;
3. Authorize the City Manager to Execute an Interlocal Agreement to have the City of Fort Worth serve as
the cognizant fiscal agency for the purpose of administrating this grant; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $228,362.00, subject to receipt of the grant.
DISCUSSION:
The Edward Byrne Memorial Justice Assistance Grant Program allows state and local governments to
support a broad range of activities to prevent crime and to improve the criminal justice system. The City of
Fort Worth, along with City of Arlington is required to negotiate with Tarrant County to develop a program
budget and strategy. All funds must be pooled, a spending plan must be developed and one agency must
serve as the cognizant jurisdiction to apply for and disperse funds. A committee of all impacted law
enforcement agencies developed an application strategy and the City of Fort Worth was selected to serve
as the cognizant fiscal agency as it has for the past three years in connection with Justice Assistance
Grants.
A total of $228,362.00 is available to be shared among Fort Worth, Arlington and Tarrant County and will
be distributed in the following manner:

City of Fort Worth $120,902.00 Purchase Law Enforcement Staffing Software and Eight
Radios for Ministers Against Crime/Clergy and Police Alliance
No matching funds are required. Fort Worth is responsible for submitting the full grant application and will
upon receipt of the grant funds, distribute funding to Tarrant County and Arlington, as agreed among the
three entities.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the recommendations, and adoption of the attached
appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the
Grants Fund.
