HomeMy WebLinkAboutResolution 3186-04-2005A RESOLUTION No ~f!~~` o~ -~OQ~ WHEREAS, on August 24 2004 the Crty Council authorized the Crty to receive and consider bids for gas well development on City-owned property located near Alliance Airport and at the Gateway Quanah Parker and Tandy Hills parks, and WHEREAS, due to the technical nature of oil and gas drilling leases and the bid process related to gas drilling on city owned property this project requires the expertise of someone specialized in the field of oil and gas drilling; and WHEREAS, the firm of Kelly Hart & Hallman have extensive experience m the area of oil and gas drilling and related legal issues. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the engagement of the law firm of Kelly Hart & Hallman as outside legal counsel be confirmed pursuant to Section 3 Chapter VI of the City Charter in order to provide legal consultation to the City Attorney's Office concerning the review of gas leases and the bid documents related to gas drilling on crty owned property 2 That the Crty Manager be authorized to compensate the law firm of Kelly Hart & Hallman m the amount not to exceed $10 000 00 which represents payment in full for such service. It is recommended that the City Council• 1 Retain Don C Plattsmier and the law firm of Kelly Hart and Hallman as outside counsel pursuant to Chapter VI Section 3 of the City Charter to provide consultation services and bid document review with regard to oil and gas leases within the city limits, 2 Adopt the attached resolution fixing in advance as far as practicable that the sum to be paid to Kelly dart and Hallman shall not exceed a total sum of $10 000 00• and 3 Authorize the City Manager to execute a Professional Services Contract with Kelly Hart and Hallman for a sum not to exceed $10 000 00 DISCUSSION On August 24 2004 the City Council authorized the City to receive and consider bids for gas well development on city-owned property located in Gateway Quanah Parker and Tandy Hills Parks and near Alliance Airport. Due to the technical nature of oil and gas leases and the bid process related to gas drilling on city-owned property this project requires the expertise of legal counsel specialized in the field of oil and gas leases. Don Plattsmier and the law firm of Kelly Hart and Hallman have extensive experience in the area of oil and gas drilling and related legal issues and will assist the legal staff in reviewing the bid forms and gas leases for the City On January 5 2005 the City Council authorized a gas well development lease for the three east side parks, resulting in lease bonus revenues that will be used to fund these legal services.
