HomeMy WebLinkAboutResolution 3204-05-2005A Resolution No 3aD~-bs-a.~5 CLARIFYING THE INTENT OF THE LEGISLATIVE AMENDMENT TO HB 304 PROPOSED BY THE CITY OF FORT WORTH AFFECTING VACATION AND SICK LEAVE TIME FOR POLICE OFFICERS WHEREAS, the City Staff at the direction of the Fort Worth City Council sought passage of a legislative amendment to Section 143 3015 of the Local Government Code affecting vacation and seek leave time for police officers and WHEREAS, the amendment to state law was sought in order to allow the Police Department to implement a 4 day 10 hour work week for police officers without creating inequities in vacation days and sick leave granted to officers working different work weeks and shifts and WHEREAS, the amendment as adopted by the Legislature supercedes the provisions of Sections 142 0013 143 045 and 143 046 of the Local Government Code and effectively allows the City to grant and compute vacation and sick leave time in hours instead of days and WHEREAS, the intent and effect of the change in law will grant police officers the same number of vacation hours and sick leave hours earned under current law and administered under current practice by the City' and WHEREAS, in seeking this legislation, the City is not attempting to reduce benefits to police officers but rather it is attempting to clarify law to allow the flexibility to implement a 4-day 10 hour work week an option that both police officers and the Police Department administration would like to attempt and WHEREAS, after adoption of the amendment it was discovered that a technical error exists regarding the monthly accrual rate of sick leave hours although the total number of 120 hours credited each twelve months is consistent with current practice and WHEREAS, in review of the amendment as adopted including the technical error identified the City Attorney's Office of the City Fort Worth believes that the City can maintain the same number of vacation and sick leave hours for police hours as currently provided and that a 4 day 10 hour work week can be implemented without creating inequities in hours granted NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS That the City Council supports the amendment to HB 304 that adds a new Subsection (i) to Section 143 3015 of the Local Government Code that affectively changes the minimum accrual of vacation and sick leave time for police officers from 15 days to 120 hours per year and That the City Council and City Manager recognize that due to a technical error the biweekly accrual rate of 4 61 hours to attain 120 hours of sick leave per year was stated instead of the correct numerical monthly amount often hours to accrue 120 hours sick leave per year and That the City Council affirms that the intent of the legislation is not an attempt to reduce benefits to police officers but rather an attempt to clarify law to provide the flexibility to implement a 4-day 10-hour work week for police officers and That the City Council and City Manager recognize that upon passage of the legislative amendment police officers shall continue to be entitled to accrue a minimum of 120 hours of sick leave per year as they currently do and That the City Council and City Manager despite the technical error relating to monthly accrual of sick leave hours intend to recognize and honor the 120 hour yearly minimum accrual of this type of leave as administered by the City today and as required by the language of the proposed legislative amendment and That the City Council directs City staffto work with the Texas Legislature to seek a technical amendment if possible to correct the error so as to remove any doubt of the uitent of the law Adopted this 17th day of May 2005 ATTEST Marty~,Hendrix, City Secretary .~_,~.,,~ `d v ~^ • ,, h ,~ ~, TM _ A W 2 ~ n, ,+,~. ~, ./ v~ ~ ~; r ~ '~ ~ ' v~k r ~ ~~ ,,, ,. ~ 'ti ,,.~- 1~ z^*, i l~ 1q1 APPROVED CITY COUNCIL MAY 1 7 2005 City Sec~of the City of Fort Worth, Tesas
