WHEREAS, the City of Fort Worth (City) and Freese and
Nichols, Inc. (Engineer) made and entered into City Secretary
Contract No. 33426, (M&C C-21385) in the amount of $67,880 .00 (the
Contract) which was executed by the City Manager on the 18 day of
April 2006; and
WHEREAS, the Contract involves engineering services for the
following project: Historic Handley Urban Village, Project No.
01834;
WHEREAS, it has become necessary to execute Amendment No. One
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1 .
Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated April 2, 2013, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $6,740 .00.
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $74, 620 .00 .

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Re: Contract Modification Proposal for expanded Handley Urban Village Scope
Dear Ms. Newton,
This letter is written to summarize the expanded scope of services for the rain garden
design on the Handley Urban Village project. Our original contract included conventional
landscaping and irrigation design services. The rain garden concept requires additional
effort for coordination, detailing,and development of special TxDOT specifications.
Revised Proiect Scone
The original contract scope for landscaping and irrigation design was based on a
conventional landscaping and irrigation plan. The rain garden concept required additional
coordination with conceptual detain development for meetings with TxDOT and City
Parks department. Phone conference meetings where held with the Parks department on
February 22d and March 29th. In addition a TxDOT coordination meeting was held at the
District office on March 70h. The final recommended design concept includes four linear
rain gardens along the south side of Lancaster Avenue and the north side of the roadway
will include planter pots. The proposed rain garden design will include development of
special rain garden details and preparation and coordination to obtain TxDOT approval
on special rain garden specifications. The north side design concept will include
preparation of details and specifications for the proposed planter pot design at the north
island Our team prepared a memorandum that included an evaluation of the rain gardens
for both the north and south sides of the roadway.
Compensation
Freese and Nichols request lump sum contract fee modification of$6,740.00 for a total
project contract amount of$74,620.00. Refer to the Compensation summary below for a
detailed breakdown of the requested fee modification.
