HomeMy WebLinkAboutOrdinance 22652-04-2017 ORDINANCE NO.22652-04-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND IN THE AMOUNT OF $17,753.00, SUBJECT TO EXECUTION OF A COST REIMBURSEMENT AGREEMENT AND RECEIPT OF FUNDS, FOR THE PURPOSE OF FUNDING THE AGREEMENT WITH THE FEDERAL BUREAU OF INVESTIGATION TO PARTICIPATE IN THE FINANCIAL CRIMES TASK FORCE.; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Other Fund in the amount of$17,753.00, subject to execution of a cost reimbursement agreement and receipt of funds, for the purpose of funding the Agreement with the Federal Bureau of Investigation to participate in the Financial Crimes Task Force. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions, sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22393-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a Memorandum of Understanding with the United States Federal Bureau of Investigation to participate in the Financial Crimes Task Force; 2. Authorize the execution of a Cost Reimbursement Agreement with the United States Federal Bureau of Investigation to receive reimbursement funds for overtime expenses related to the City's participation in the Financial Crimes Task Force; 3. Authorize the acceptance of reimbursement funds for overtime expenses in the amount of$17,753.00; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Other Fund in the amount of$17,753.00, upon execution of the Memorandum of Understanding and Cost Reimbursement Agreement and receipt of funds. DISCUSSION: The United States Federal Bureau of Investigation (FBI) has established a Financial Crimes Task Force (FCTF) with the mission to build a specialized group of investigators responsible for the identification, investigation, prosecution, and forfeiture of all assets involved in the task force's investigations. The Fort Worth Police Officer assigned to the FCTF will seek to identify and develop new cases in the areas of corporate, securities, and commodities fraud; money laundering; bank fraud; mail and wire fraud; and other financial crimes with significant losses, local subjects, and forfeitable assets. There will be one Fort Worth Police Officer assigned to the FCTF. Pursuant to the Cost Reimbursement Agreement, the FBI will reimburse the City of Fort Worth for the Officer's direct overtime salary expenses up to $1,479.41 per month and $17,753.00 per year. Indirect expenses and benefits such as retirement, social security, and similar expenses are not eligible for reimbursement.
