HomeMy WebLinkAboutContract 43361-A5 CITY SECRETARY AMENDMENT No. 5 CONTRACT NO. � - TO CITY SECRETARY CONTRACT No. 43361 WHEREAS, the City of Fort Worth (CITY) and URS Corporation, (ENGINEER) made and entered into City Secretary Contract No. 43361, (the CONTRACT) which was authorized by M&C No. C-25611 on the 15th day of May, 2012 in the amount of $485, 932 . 58; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $28, 660. 00 which was administratively authorized on the 7th day of January, 2013; and Amendment Number 2 in the amount of $74, 500. 00 which was authorized by M&C C-26487 on the 7th day of October, 2013; Amendment Number 3 in the amount of $125, 500 . 00 which was authorized by M&C C-27095 on the 11th day of December, 2014; Amendment Number 4 in the amount of $104, 077 . 95 which was authorized by M$C C-27677 on the 12th day of April, 2016; and WHEREAS, the CONTRACT involves engineering services for the following project: GARDEN ACRES BRIDGE PHASE II; and WHEREAS, it has become necessary to execute Amendment No. 5 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 13, 2016, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $114,035. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $932, 705. 53. City of Fort Worth Transportation & Public Works Department 1000 Throckmorton Fort Worth, Texas 76102 RE: Garden Acres Bridge Phase II —City Project No. 01802, DOE #6749 Additional Construction Phase Services Dear Ms. Smith: During the initial engineering contract negotiations construction phase services were thought to require minimal support from the design team. As requested at our September 16, 2016 meeting, URS and its sub-consultants have evaluated the construction phase services fee originally proposed for the project, the construction phase services more explicitly defined at the meeting and the estimated construction schedule. The design team has identified the following items as additional scope of services for the construction phase of the project. Preconstruction Meeting The design team will attend the preconstruction meeting. The scope of services for one design team sub-consultant did not originally include attendance at this meeting. Construction Proaress Meetings As discussed at the meeting, the design team has been requested to attend bi-weekly progress meetings. It is estimated there will be twenty-eight progress meetings throughout the construction period. URS/AECOM will attend all applicable construction progress meetings. Design team sub- consultants will not attend all construction progress meetings but will attend as needed when the sub-consultant's portion of the design is under construction. Submittal, Shop Drawing and Request for Information Review Originally, the scope of services did not include improvements/modifications to the existing Garden Acres Bridge. However, during the course of the design, TxDOT requested new railings, illumination and pedestrian facilities be added to the existing bridge structure and that a dedicated right-turn lane on the southbound service road be added to the project. The existing landscape feature in the median of McPherson Boulevard west of IH35W was required to be relocated and was not originally anticipated to be included in the design package. Also, cathodic protection of the proposed water line improvements was not in the original scope of services. These additional design items will require more submittals, shop drawings and contractor requests for information for the design team to review and provide responses. The design team sub-consultant's original scope of services did not include submittal, shop drawing and contractor request for information review. December 13, 2016 Page 2 Site Visits The anticipated construction schedule is approximately 278 days or 14 months. The initial scope of services included three (3) site visits for the prime design consultant and one site visit for one of the design team sub-consultants. It is estimated that one site visit per month may be necessary for the prime design consultant and three (3) site visits for the design team sub-consultants during the construction of their design facilities. Therefore, an additional eleven (11) site visits for the prime design consultant and site visits for design sub-consultants not previously included have been incorporated into this amendment. Record Drawings The drawings required for the additional design services cited under Submittal, Shop Drawing and Request for Information above will require efforts beyond those included in the original negotiations for preparation of record drawings. Only one design team sub-consultant efforts were included in the original negotiations for preparation of record drawings. The estimated additional effort for the prime design consultant and the design team sub-consultants to prepare record drawings is included in this amendment. Monthly Reports/Pay Application Review The consultant shall prepare twelve (12) monthly reports required for the project grant. The consultant shall perform a review up to twelve (12) of the Contractor's monthly pay application requests. The supplemental fee is proposed to be performed on a time and materials basis with a maximum amount not-to-exceed of$114,035.00 without prior written authorization. (CPN 01802) DISCUSSION: Under Amendment No. 5, URS Corporation (URS) (n/k/a AECOM) will perform Construction Phase Services as necessary, including periodic site visits during construction, approval of material submittals, contractor pay estimates and other construction related activities. The table below recites the contract and amendment history.
