HomeMy WebLinkAboutContract 33440 CITY SECRETARY THE STATE OF TEXAS CONTRACT NO. 11-� s KNOW ALL BY THESE PRESENTS COUNTY OF TARRANT INTERLOCAL AGREEMENT This Agreement is made and entered into this �7`� day of 2006, by and between the County of Tarrant, acting herein by and through is governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort Worth, hereinafter referred to as CITY,both of Tarrant County, State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority of Sections 791.001- 791.029, Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the common interest of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this Agreement-, and WHEREAS, each governing body agrees to share in the cost of the services described below. NOW THEREFORE, the COUNTY and CITY agree as follows: 1. The COUNTY agrees to provide the labor and equipment necessary to provide for rehabilitation of the following roadways: (a) Golden Triangle Boulevard , from IH 35W to Harmon Road for a distance of 2,027 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HN AC surface. (b) Harmon Road, from Golden Triangle Boulevard to Keller Hicks Road for a distance of 3,216 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. (c) Katy Road, from Keller Hicks Road to Caylor Road West for a distance of 5,160 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. NFIC! , TEX. (d) Keller Haslet Road (1) from Caylor Road North to US 377 (excluding the County's section) for a distance of 3,216 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. (e) Keller Haslet Road (2) from Alta Vista Road to Caylor Road North for a distance of 3,057 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. (f) Keller Hicks Road, from Harmon Road to IH 35W (excluding the County's section) for a distance of 2,835 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. (g) Blue Mound Road, from US 287 to FM 156 (excluding the County's and Haslet's sections) for a distance of 10,926 linear feet. The work will include reclaiming and recycling the existing roadbed, adding 4 inches of limestone base, incorporating cement stabilization, reshaping, and placing a two-inch HMAC surface. 2. The CITY agrees, at its sole option, to either deliver to the COUNTY all of the materials necessary and required for the rehabilitation of the roads, as described in paragraph 1. of this agreement, or to pay for the actual cost of the materials as incurred by the COUNTY including any delivery or freight costs. The CITY will provide a purchase order and will be billed directly by the material supplier. The COUNTY may accumulate and bill the CITY for incidental material cost. The estimated cost of the materials for the rehabilitation of the roadways (described in 1.) is as follows: (a) Golden Triangle Boulevard , from IH 35W to Harmon Road — an amount not to exceed $112,630. (b) Harmon Road, from Golden Triangle Boulevard to Keller Hicks Road—an amount not to exceed $80,225. (c) Katy Road, from Keller Hicks Road to Caylor Road West — an amount not to exceed $114,616. (d) Keller Haslet Road (1), from Caylor Road North to US 377 (excluding the County's section)—an amount not to exceed $98,143. (e) Keller Haslet Road (2), from Alta Vista Road to Caylor Road North—an amount not to exceed $81,553. v1��vlc-.1 (f) Keller Hicks Road, from Harmon Road to IH 35W (excluding the County's section) —an amount not to exceed$28,797 . (g) Blue Mound Road, from US 287 to FM 156 (excluding the County's and Haslet's sections) —an amount not to exceed$80,681. 3. The CITY agrees to provide the water necessary for these projects and to waive the cost of the deposit for the hydrant meter. The CITY is responsible for the adjustment of all manholes, valves and utilities. The CITY is responsible to coordinate and disconnect any existing traffic signal loops and will be responsible for the replacement of all signal related devices if necessary. The CITY agrees that if the CITY deems that removal of roadbed material necessary, the CITY will contract with a milling sub-contractor to remove the material. The milling costs are not part of this contract and will be the responsibility of the CITY. 4. The City agrees to pay for the cost of providing traffic control, and other incidentals and contingencies estimated in amounts not to exceed as follows: Golden Triangle Boulevard - $22,505 Harmon Road- $19,377 Katy Road- $31,913 Keller Haslet Road(1) - $10,181 Keller Haslet Road(2) - $18,913 Keller Hicks Road- $3,020 Blue Mound Road- $8,371 5. The CITY agrees to the closing of the road for through traffic for the duration of the project, or as deemed necessary by the COUNTY. 6. The CITY agrees that if a Storm Water Pollution Prevention Plan is required, the CITY will be responsible for the design/development of the Plan. The COUNTY will be responsible for the implementation and maintenance of the Plan during the duration of the project. The CITY further agrees to pay for all costs associated with the implementation and maintenance of the Plan. 7. The CITY agrees to notify the COUNTY within thirty days of the completion of a specific project of any complaint the CITY has with the project. 8. Nothing in the performance of this Agreement shall impose any liability for claims against the COUNTY other than claims for which liability may be imposed by the Texas Tort Claims Act. 9. Nothing in the performance of this Agreement shall impose any liability for claims against the CITY other than claims for which liability may be imposed by the Texas Tort Claims Act. 10. Nothing contained in this Agreement is intended by the parties to create a partnership or joint venture between the parties, and any implication to the contrary is hereby expressly disavowed. It is understood and agreed that this Agreement does not create a joint enterprise, nor does it appoint any party as an agent of any other party, for any purpose whatsoever. 11. The parties to the Agreement do not intend for any third party to obtain a right by virtue of this Agreement. 12. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. 13. This Agreement shall automatically terminate upon completion of the projects or one (1) year from the date of this agreement, whichever is first. Authorize the transfer of $73,264.50 from the Water & Sewer Operating Fund to the Water Capital Projects Fund; 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriation in the Water Capital Projects Fund in the amount of$73,264.50 from available funds; and 3. Authorize the City Manager to execute an Interlocal Agreement with Tarrant County for the overlay of a) Golden Triangle Boulevard from IH 35 W to Harmon Road for a distance of 2,027 linear feet; b) Harmon Road, from Golden Triangle Boulevard to Keller Hicks Road for a distance of 3,216 linear feet; c) Katy Road, from Keller Hicks Road to Caylor Road West for a distance of 5,160 linear feet; d) Keller Haslet Road East from Caylor Road North to US 377 (excluding the County's section) for a distance of 3,216 linear feet; e) Keller Haslet Road West from Alta Vista Road to Caylor Road North for a distance of 3,057 linear feet; f) Keller Hicks Road from Harmon Road to IH 35 W (excluding the County's section) for a distance of 2,835 linear feet; and g) Blue Mound Road, from US 287 to FM 156 (excluding the County's and Haslet's sections) for a distance of 10,926 linear feet for a total cost to the City not to exceed $710,925. DISCUSSION: At the request of City staff, Tarrant County has agreed to enter into an Interlocal Agreement to overlay the following portions of City streets within the outlying areas of the City: STREET LIMITS Golden Triangle Blvd from IH 35W to Harmon Road Harmon Road from Golden Triangle Blvd. to Keller Hicks Road Katy Road from Keller Hicks Road to Caylor Road W Keller Haslet Road East from Caylor Road N to US 377 (excluding the County's section) Keller Haslet Road West from Alta Vista Road to Caylor Road N. Keller Hicks Road from Harmon Road to IH 35 W(excluding the County's section) Blue Mound Road from US 287 to FM 156 (excluding the County's & Haslet's section) Under this agreement, Tarrant County will provide all the necessary labor and equipment to perform this work. By agreement between the City and Tarrant County, the City agrees, at its sole option, to either deliver all of the materials necessary and required for the rehabilitation of the roads or to pay for the actual http://www.cfwnet.org/council_packet/Reports/mc_print.asp 4/25/2006 Page 2 of 2 cost of the materials as incurred by the County including any delivery or freight costs. The City will provide a purchase order and will be billed directly by the material supplier. The County may accumulate and bill the City for incidental material cost. The cost of pavement rehabilitation on Katy Road is $146,529, and will be shared 50/50 between Transportation Public Works and the Water Department. The City agrees to pay for the cost of providing materials, traffic control and other incidentals and contingencies at a total project cost not to exceed $710,925. Additionally, the City agrees to the closing of each road to through traffic for the duration of the project or as deemed necessary by Tarrant County. This project is located in COUNCIL DISTRICT 2 and 7. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Projects Fund and of the Contract Street Maintenance Fund.
