ORDINANCE NO . . An ordinance regulating the manner in which electric signs shall I be installed and supported and providing for permits to lssua there- for,and prescribing penalties for the violation of this act,and, re- pealing all ordinauces in corf lict therewith. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OV FORT WORTH:- Section ORTH:-Section 1. That before any electric sign illuminated or lighted by electricity, used for advertising purposes upon or along the streets or side-walks of the City of Fort ltor'th or attached to or connected with any awning or building,within the corper ate limits of said City &B installed, swung or displayed, a permit for same shall e be obtained from the City Bngineer of the City of Fort Worth,and a fee of One Dollar ($1.00) paid therefor by the applicant. Section 2. An application for such permit shall be made out and signed by the contractor or person installing such sign,and same shall state the name of the owner, the weight of the sign and the manner and means of supporting_samei the location of such signaAd. shall describe the building or buildings do which it is to be attached or in connection with which it is to be used,and the street number for such building or buildings. Section 3. That all electrical devices,wires, conductors and apparatus used in or about or connected with said sign,and the prop- er intulation thereof shall be installed,constructed and maintained in accordance with the ordinance relating to electrio wiring,as well as in accordance with the provisions of this ordinance. Section 4. The following regulations shall be observed and followed in relation to such electric sign . signs 'extending be- yond the side-walk shall be placed at a height of not less than fourteen(14) feet above the strect. Signs under awnings or on walls of butldings,where such signs do not project beyond the eidd- walk,shall be at a height of not less than eig4tJ8) feet above th4 side-walk. Where such sigp s are supported by awnings or walls of buildings, ornamental iron or steel brackets or chains sufficiently strong and durable to hold and maintain such sins shall be used. All signs shall be well and thoroughly sVpported,and such signs shall OutQ,,q ' be strong enough to sarry and sustain double the weight of the sign and braced in such an effl cient and adequate way as to withstand the stress of wind at a velocity of twenty miles per hour. Where signs are supported by walls of buildings, the supports must be so arranged and attached as not to weaken or impair the strength or equilibrium of such walls. Section 5. After said sign is installed and before the same shall be permitted to be used, it shall be inspected by the city electrieian,who shall be notified to do so by the ov,ner or agent of such owner,and a fee of One Dollar(#1.00) shall be charged for such iaspeat-los sad paid by the per.;ou,firm or corporation XQr whom such inspection is made. In the event it should be found b y such elec- trician that such sign or the supports thereof• are not in conformity with orAinJviolation of the provisions of this ordinance, then he shall instruct the person,firm or corporation respon®ible therefor, f e —3- or his ,its or their agent, to take down said sign, or to brace and support the same, as the conditions may require,in acoordance with the provisions of this ordinance. m �r�y Section 8 . Any person,firm or corporation violatingt74640- A visions of this ordinance shall xpax zmmztat1& x:kJ=#wf be deemed guilty of a misdemeanor ,and upon conviction thereof shall be fined in any sum not less than five ($5.00) Dollars and no more than Ten($10.00)Dollars,and each day in which said vVdlation is con- tinued shall be deemed a separate and distinct offense ,and punish- able as such. Section 9. it is further provided that if persons or proper- ty are injured or damaged by reason of the violations of this ordi- nance on the part of the owner of said sign or his agent or em ployee by reason of which the City of Fort Worth should be im- pleaded or made a yarty to any puit or cause of action in any of the courts of the State of Texas,that the said City of Fort Wcr th shall in the event of judgment agLinst said city,have JudEpent over and against such offending or negligent person,firm or corporation so responsible therefor. Section 10. All ordinances and parts of ordinances in conflict herewith be and the same are hereby repokled. Section 11. This ordinance shall take effect and be in force from and after its passage and publication as prescribed by law.
