SHALL AT ALL TIMES HAVE THE PRIVILEGE OF A RIGHT OF WAY BEDTWOUC �EOVIICLOSED ICOTED CAD ONITHOUTCHARGE- fiHSIDIN)2TE SHALL BX 6ME EFFECTIVE MU I ATELY FROM AND AFTER THE DATE OF ITS PASSAGE. 1 1 +,AS, it appearing to the City Council of the City of Fort North, Texas, that the alleyway now existing between the sout of Beddell Street and the north line of Kerfoot Street„,Hubbard Highlands Addition to said City, is not now being used as a public thoroughfare and never has been used as such, that it constitutes a nuisance and that the interest of the public will be best subserved and that the public necessity and convenience demand such alley- way be closed, said alleyway being more particularly describ- ed as follows, to-wit: -1- BEGINNING at the northeast corner of Lot 6 Block 11 Hubbard Highlands Addition to the Cit of Fort Worth arrant County Texas; THENCE east along the north line of Lot 7. Block 11 Hubbard Hi hlands Addition to tie Citi of Port 7orth or a distance of 12t- THE NCE south parallel with said west line of Lot 7, said block and addition, for a distance of 1401 = THEME West along the south line of said Lot 7 said addition and block, for a distance of 12t• THEME north 1401 along the east line of Lots 4 5 and 6 Block 11 Hubbard Highlands Addition to said City, to the pace of BEGINNING; and WHEREAS, it is desired by the abutting property owners, in said addition, to open and dedicate an alleyway between the east line of Lot 7, the west line of Lot 8, Block 11, Hubbard Highlands Addition to the City of Fort Porth, Tarrant County, Texas, the south line of Beddell Street and the north line of Kerfoot Street, in said City, and it is deemed to be for the public good and benefit to accept such dedication, said alleyway to be opened being more particularly described as follows, to-wit : BEGINNING at the northwest corner of Lot 8 Block 11 Hubbard Highlands Addition to the City_'of Fort `�7orth Tarrant County, Texas• THENCE west along the south line of Bedell Street 12 to a point ; THELE south 1301 to apoint- THENCE in a south- westerly direction 111 to a point in the north alley line of Block 11 and 40t from the east line of Lot 4, Block 11; THENCE east 221 to the southwest corner of Lot 8• THENCE north 140t to the place of BEGINNMG; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT 10RTH: SECTION I That the following described sections and portions of an alleyway within the corporate limits of the City of Fort Worth be and the same is hereby declared to be permanent- ly closed, abandoned and forever vacated for use as a public street, highway or thoroughfare, to-wit : -2- BEGINNING at the northeast corner of Lot 6 Block 11 Hubbard Highlands Addition to the Cit of Fort 'Forth Tarrant County Texas; THENCE east along the north line off` Lot 7 Block 11 said addition or a distance of 121 ; THEtC E south parallel with said west line of Lot 7, said block and addition for a distance of 1401 ; THENCE west along the south line of said Lot 7 said addition and block, for a distance of 121 • THENCE north 1401 along the east line of Pots 4, 5 and 6, Block 11, Hubbard Highlands Addition to said City, to the place of BEGINNING. SECTION II That the permanent closing, vacating and abandon- ing of the above described alleyway is hereby declared to be a public necessity and the continuation thereof as a public highway or thoroughfare declared to be a public men- ace and nuisance, and this ordinance shall operate as a quit claim deed from the City of Fort North to the abutting property owners, resigning and discharging any and all claims of the City of Fort North to use the same as a pub- lic highway and thoroughfare, but the privilege of using same for right of way purposes at any time is hereby ex- pressly reserved by said City, for use of publics utilities. SECTION III That the opening and dedication by the abutting property owners, in said addition, of an alleyway between the east line of Lot 7, the west line of Lot 8, Block 11, Hubbard Highlands Addition to the City of Fort Forth, the south line of Beddell Street and the north line of Kerfoot Street, in said City, is deemed and considered to be for the public good and benefit and should be in all things accept- ed by said City, said alleyway to be opened and dedicated being more particularly described as follows, to-wit : BEGINNING at the northwest corner of Lot 8 Block 11, Hubbard Highlands Addition to tAe Cit yy��of�� Fort Worth, Tarrant County, Texas- THr'�TCE west along the south line of Beddeil Street 121 to a point ; THENCE south 1301 to a point; THENCE in a southwesterly direction 111 to a point in the north alley line of Block 11 and 40t from the east line sof ou 4t Block 11f VlFgTEttothe oescorner '�C1 , to the place of BEGINNING. -3- SECTION IT That this ordinance shall become effective im- mediately from and after its passage.
