HomeMy WebLinkAboutOrdinance 22662-04-2017 ORDINANCE NO.22662-04-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $29,500.00, IN THE SPECIAL DONATIONS CAPITAL PROJECTS FUND, FOR THE PURPOSE OF FUNDING FINAL DESIGN,FABRICATION,INSTALLATION AND CONTINGENCIES FOR ARTWORK IN ROCKWOOD PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the amount of$29,500.00, in the Special Donations Capital Projects Fund, for the purpose of funding Final Design, Fabrication,Installation and Contingencies for Artwork in Rockwood Park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions, sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a final design and commission Agreement with Nonstop, Inc., in an amount of $50,000.00 for final design, fabrication, installation, and contingencies for artwork in Rockwood Park, 748 Rock Cress Drive; and 2. Adopt the attached appropriation ordinance increasing appropriations in the Special Donations Capital Projects Fund in the amount of$29,500.00, from available funds, to allow the donation from Arnold and Harriette Gachman on behalf of Gamtex Industries, LP d/b/a Gachman Metals and recycling to be allocated towards the Rockwood Park artwork. DISCUSSION: As a commemoration of its centennial, Gamtex Industries, LP d/b/a Gachman Metals and Recycling (Gachman Metals) located at 2600 Shamrock Avenue, Fort Worth, TX., partnered with Fort Worth Public Art to commission an artist to create an artwork to be installed in Rockwood Park, located at 748 Rock Cress Drive, Fort Worth, TX. The artwork will consist of a cast bronze sculpture approximately six to seven feet tall, and will celebrate the 100 year history of Gachman Metals in Fort Worth. The abstract artwork will be closely based on a form generated as part of Gachman Metals' recycling processes and will be cast from recycled bronze donated by the company. On September 15, 2014, the City of Fort Worth entered into a contract with Nonstop, Inc., to develop a preliminary artwork design for a site in Rockwood Park (Fort Worth City Secretary Contract No. 45934). Art Commission Action: On November 9, 2015, the Fort Worth Art Commission (FWAC) approved the artist's preliminary design and recommended the artist be placed under a final design and commission contract. Under this final design and commission contract, the artist will finalize the aesthetic design and provide structural engineering. Upon approval of the final design by the FWAC, the artist will fabricate, deliver, and install the artwork per the approved final design. This project is included in the Fort Worth Public Art Fiscal Year 2017 Annual Work Plan, adopted by the Fort Worth City Council on October 25, 2016, Mayor and Council Communication (M&C G-18667). FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds in the amount of$20,500.00 are available in the Public Art Fund for the Rockwood Park Public Art project. Existing appropriations in the project are $30,500.00 of which $10,000.00 has been expended, leaving a balance of$20,500.00. The Gamtex Industries, LP, donation in the amount of$29,500.00 brings the available project balance to $50,000.00.
