HomeMy WebLinkAboutOrdinance 18230-08-2008Ordinance No. 18230-08-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $125,000 AND DECREASING UNAUDITED, UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE REPLACEMENT AND REPAIR OF CURRENT FOOD AND BEVERAGE EQUIPMENT AT THE FORT WORTH CONVENTION CENTER; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various Gity departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture and Tourism Fund in the amount of $125,000 and decreasing unaudited, unreserved, undesignated fund balance by the same amount for the replacement and repair of current food and beverage equipment at the Fort Worth Convention Center. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. 18230-OS-2008 DATE: Tuesday, August 26, 2008 LOG NAME: 250MN12008 REFERENCE NO.: **C-22985 SUBJECT: Authorize Execution of Amendment to Contract with Omni Hotels Management Corporation for Exclusive Food, Beverage and Alcoholic Beverage Services at the Fort Worth Convention Center to Revise the Term and Adopt Supplemental Appropriation Ordinance in the Amount of $125,000.00 for Equipment Replacement and Repair RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an Amendment to the Contract with Omni Hotels Management Corporation for Exclusive Food, Beverage and Alcoholic Beverage Services at the Fort Worth Convention Center to: 1. Revise the term to be effective December 1, 2008, and expire November 30, 2018; and 2. Adopt the attached ordinance increasing appropriations in the Culture and Tourism Fund in the amount of $125,000.00 and decreasing unaudited, unreserved, undesignated fund balances by the same amount for the replacement and repair of current food and beverage equipment. DISCUSSION: On April 27, 2005, the City and Omni Hotels Management Corporation (Omni) executed City Secretary Contract No. 31742, the Contract for Exclusive Food, Beverage and Alcoholic Beverage Services for a term of ten years to be effective six months after the Omni Fort Worth Hotel opens for business (M&C 20619, March 29, 2005). At the time the documents were executed, it was anticipated that the Omni would require six months after the hotel opened to assume the food, beverage and alcoholic operations. Omni has requested permission to begin concession and alcoholic beverage services on December 1, 2008 and exclusive catering operations on January 1, 2009. The existing agreement with Tarrant County Concessions, L.L.C., d/b/a Aramark for concessions and alcoholic beverage services will expire on November 30, 2008. All catering agreements at the Fort Worth Convention Center will expire on December 31, 2008. In addition, under the agreement between the City and Omni Hotels Management Corporation the City committed to spend $125,000.00 toward the replacement and repair of current equipment in the concession premises on or before the commencement of the term. The process to purchase the equipment must begin in the current fiscal year in order to satisfy the terms of the contract and meet purchasing guidelines. The Fort Worth Convention Center is located in COUNCIL DISTRICT 9 and serves the entire City. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the Logname: 250M1~tI2008 Page 1 of 2 attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the unaudited, unreserved, undesignated fund balance of the Culture and Tourism Fund will be $4,404,852.05.
