AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF
IMPROVING THE FOLLOWING STREET AND PORTIONS THEREOF,
TO-WIT s
EAST SECOND STREET FROM THE WESTERLY
LINE OF ELM STREET TO THE EASTERLY LINE
OF CALHOUN STREET, SAVE AND EXCEPT THE
INTERSECTION OF JONES STREET, KNOWN AS
UNIT NO. 3,
IN THE CITY OF FORT WORTH, TEXAS : AUTHORIZING AND
DIRECTING THE EXECUTION AND ISSUANCE OF SPECIAL
ASSIGNABLE ASSESSMENT CERTIFICATES TO BROWN & ROOT,
INC. THE CONTRACTOR PERFORMING SAID WORK AND
PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT
IMMEDIATELY UPON ITS PASSAGE AND APPROVAL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH?
TEXAS , DULY ASSEMBLED:
SECTION I:
That the work of improving the following street and
portions thereof in the City of Fort Worth, Texas, to- wit:
EAST SECOND STREET FROM THE WESTERLY
LINE OF ELM STREET TO THE EASTERLY LINE
OF CALHOUN STREET, SAVE AND EXCEPT THE
INTERSECTION OF JONES STREET, KNOWN AS
UNIT NO. 3,
by raising, grading, filling, widening, paving, repaving, or
repairing same, and by constructing, reconstructing or realigning
combined concrete curbs and gutters where determined necessary by
the Director of Public Works, and by constructing or reconstructing
such other drains, drainage structures, incidentals and appurtenances
thereto as deemed necessary and adequate by the Director of Public
Works, and as provided for by the plans and specifications for such
improvements; said paving consisting of the construction or recon-
struction of a six (6) inch reinforced concrete base on an adequate
foundation course, and the construction thereupon of a wearing
surface of one and one-half (1j) inch hot mix asphaltic concrete
surface course and further, the construction or reconstruction in
or under all the area between and under the rails, tracks , double
tracks , turn-outs and switches of all railways using, occupying,
or crossing said street by improving and paving with what is known
as the City of Fort Worth Tract Section, consisting of a six (6) inch
reinforced concrete sub-base, six (6) inches of ballast, and the
construction thereon of a nine (9) inch reinforced, concrete pave-
ment, all of the materials, types and widths as shown on and pro-
vided for in the plans and specifications , and all of said improve-
ments having been performed and completed in full accordance with
all the terms and provisions of the contract dated April 7, 191+81
between the said City of Fort Worth, Texas, and Brown & Root, Inc. ,
approved by ordinance of the City Council of said City dated April 7,
1948, and said plans and specifications therein contained; and said
Director of Public Works having measured, examined, and caused to
be tested the finished improvements by the means and in the manner
provided by the terms of said contract and the plans and specifica-
tions therein contained, and said Director of Public Works having
found that such improvements have been constructed and completed
in full compliance with all provisions of said contract and said
plans and specifications , and said Director of Public Works having
approved and accepted said work and improvements, and having hereto-
fore issued his Certification of Completion and Final Acceptance,
and so certified to the City Manager and to said City Council and
recommended that said City Council accept and receive said work and
the improvements as constructed and completed by said Brown & Root,
Inc. , and said work and improvements having been found by the City
Manager of said City of Fort Worth, Texas, to have been performed
and completed in full compliance with said contract and said plans
and specifications therefor, and having been accepted by said City
Manager, said work and improvements are hereby found by said City
Council to have been performed and completed by said Brown & Root ,
Inc. in full compliance with the terms and provisions of said con-
tract and said plans and specifications therefor, and same are
hereby accepted and received by said City Council of the City of
Fort Worth, Texas.

SECTION II:
That the Mayor and City Secretary of the City of Fort Worth,
Texas, are hereby authorized and directed to execute and issue to
Brown & Root, Inc. special assignable assessment certificates evidenc-
ing the assessments levied against the properties improved abutting
upon the above described street and against the real and true owners
thereof, which, by the terms of said contract, the City of Fort
Worth, Texas, has agreed and obligated itself to issue and deliver
to said Brown & Root, Inc. in accordance with the provisions of
the Final Assessment Ordinance and other proceedings heretofore had
and adopted by said City Council; said Special Assessment Certifi-
cates shall be executed in the name of said City by its mayor and
City Secretary, and impressed with the seal of said City, and dated
as of the date hereof, and such officers are hereby authorized and
directed to execute said certificates in their official capacities
on behalf of said City, and deliver same to said Brown & Root, Inc.
SECTION III:
This Ordinance shall take effect and be in full force
from and after its passage.
