WHEREAS, the City of Fort Worth Transportation and Public Works Department, has requested
that the City Council approve the closing of a portion of Oscar Avenue in the J.M. Moody subdivision,
adjacent to Lots 2 & 3 Block 34 and Lots 10 & 11 Block 33 being approximately 75 ft 'long and 60 ft
wide and containing 4,500 square feet, from a point 160 ft south of NE 32nd Street to a point 235 ft
south of NE 32nd Street; and
WHEREAS, this street closure is required to eliminate this low water crossing for public safety
reasons; and r�'"�

WHEREAS, the Plan Commission reviewed the request on May 25 2005 and recommends that
the request be approved,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS
That of a portion of Oscar Avenue in the J.M. Moody subdivision, adjacent to Lots 2 & 3 Block
34 and Lots 10 & 11 Block 33 being approximately 75 ft long and 60 ft wide and containing 4,500
square feet, from a point 160 ft south of NE 32nd Street to a point 235 ft south of NE 32nd Street, as
more particularly described in the attached Exhibit A & `B" be physically closed subject to the
following:
1) Access into the closed street shall be allowed for maintenance of water sewer electric, cable, and
• telephone utility facilities, unless other satisfactory arrangements are made, including relocation at the
applicant s expense; and
2) The right -of -way be physically closed with an acceptable barricade or other satisfactory arrangements
approved by the City of Fort Worth Department of Transportation and Public Works; and
3) A minimum 11 foot drive access shall remain unobstructed to serve adjacent lots.
The City shall retain title to the public nght -of -way in said street and all easements for existing and
prospective utilities, and retai nng the right of access at all tunes for the purpose of maintaining existing and
prospective utility facilities and for emergency access:
In addition, the City reserves the right, at the sole discretion of the City Council, to reopen by
resolution the aforesaid streets and alleys at any time by directing the removal of any barricade or other
means of closure.

Oscar Avenue Riaht -of -Way Closure
BEGINNING at point 160 0 feet South of the intersection of the western right -of way
line of Oscar Avenue and the southern right -of way line of NE 32nd Street,
THENCE East a distance of 60 0 feet to the eastern right -of way line of Oscar Avenue,
THENCE South along the eastern right -of way line of Oscar Avenue a distance of 75 0
feet,
THENCE West a distance of 60 0 feet to the western right -of way line of Oscar Avenue
THENCE North along said right -of way lane a distance of 75 0 feet.

RECOMMENDATION
It is recommended that the City Council approve the physical closure of a portion of Oscar Avenue in the
J M Moody subdivision adjacent to Lots 2 & 3 Block 34 and Lots 10 & 11 Block 33 being approximately
75 feet long and 60 feet wide and containing 4 500 square feet, from a point 160 feet south of NE 32nd
Street to a point 235 feet south of NE 32nd Street, subject to the following
1) Access into the closed street be provided for maintenance of water sewer electric cable and telephone
utility facilities unless other satisfactory arrangements are made including relocation at the applicant's
expense
2) The right -of -way be physically closed with an acceptable barricade or other satisfactory arrangements
approved by the Department of Transportation and Public Works and
3) A minimum 11 foot drive access shall remain unobstructed to serve adjacent lots.
DISCUSSION
The Transportation and Public Works Department (T /PW) of the City of Fort Worth is requesting the
physical closure of a portion of Oscar Avenue between Vera Cruz Street and 32nd Street in order to
eliminate this low water crossing for public safety reasons It is anticipated that the physical closure of this
low water crossing will contribute to public safety by reducing attempts to cross during periods of flood
conditions
The Engineering Department has evaluated this project and finds that: the street will be short enough to
require barricades rather than a cul -de -sac type treatment; the existing traffic volumes are sufficiently low to
allow the closing of the street and the proposed closure is not anticipated to impact transit service
Reviewing City Departments expressed no issues with this request and recommended approval to the City
Plan Commission who in turn recommended approval at its public hearing held on May 25th 2005
This request is located in COUNCIL DISTRICT 2.
