SECTION VII. The City of Fort Worth, Texas, shall not in any manner be liable for payment of the sums hereby assessed against any prop- erty or the owners thereof, but the said Texas t3itulithic Company, or its assigns, shall look solely to such property and the owners thereof for the payment of such assessments, but the City of Fort Worth shall exercise all of its lawful powers to aid in the enforcement and collection of said liens and sums and personal obligations. SECTION VIII, The total amount assessed against the respective parcels of abutting property, and the owners thereof, is in accordance with the proceedings of the City relating to said improvements and assessments therefor, and is less than the proportion of the cost allowed and permitted by the law in force in the City. SECTION IX. Although the aforementioned charges have been fixed, levied and assessed in the respective amounts hereinabove stated, the City Council does hereby reserve unto itself the right to reduce the aforementioned assessments by allowing credits to certain property owners where : (1) curb and/or gutter or paving presently exists, (2) property in commercially zoned areas is occupied by owner as his residence (this creditto be such that the maximum cost to the property owner per front foot, after allowing such credit, shall not exceed $5.50 per front foot for curb, gutter and paving) , (3) property abuts on the street to be improved, but actually fronts on another street (this credit to be such that the cost to the property owner, after allowing such credit, shall not exceed the amount of the assessment against a residential lot which fronts 100 feet on the street to be improved) , and (4) property abuts on that portion of Unit A.o. 4 which will be occupied by the railroad after its relocation (this credit to be at the rate of one square yard of pavement per linear foot of street and to be apportioned between property owners on each side of the street in relation to the area occupied by the railroad on each side of the center line of the street) . Notwithstanding the City Council has herein reserved the right to issue credits as hereinabove provided, it shall not be required to issue such credits, and will not do so, if same would result in any inequity and/or unjust discrimination. CITY `$ FT. \U M, ILL Honorable Mayor and Members of the City Council Re: Paving Streets at Six City of Fort Worth Locations (AP 59 18) Project No. 94-B4-8 Mrs. McKnight and Gentlemen: On February 5, 1960, the City Council adopted Ordinance No. 4240 awarding the contract to Texas Bitulitic Company for Assessment Paving at Six Locations. These six-Ucations are: Unit No. I - Bryan Street, from Ripy Street to Butler Street Unit No. 2 - Bryan Street, from Butler Street to Dickson Street Unit No. 3 - South Grove, from Ripy Street to Bowie Street Unit No. 4 - Trinity Street, from West Freeway to Rutledge Street Unit No. 5 - Montgomery Street, from Seventh Street to Camp Bowie Unit No. 6 - Ellis Ave. , from NW 23rd Street to NW 25th Street On August 5, 1960, Ordinance No. 4337 was adopted setting August 26th for the date of the Benefit Hearing. It is recommended that an ordinance be adopted closing all of the hearing save and except that portion of the hearing set aside for the allowance of credits to reduce the cost to certain property owners where additional valid credits become apparent during the construction of the project.
