ADOPTING THE THIRTEENTH AMENDMENT
TO THE CITY OF FORT WORTH'S ANNEXATION PLAN
WHEREAS on December 14 1999 the City Council approved Resolution No 2598 adopting
an annexation plan for the City of Fort Worth m accordance with Section 43 052 of the Local
Government Code•
WHEREAS, on October 29 2002, the City Council approved Resolution No 2884 adopting the
third amendment to the City's annexation plan identif}nng approximately 7 744 acres referred to as the
287 Zone;
WHEREAS the City Council approved Ordinance No 15389 annexing the 287 Zone for
limited purposes on January 7 2003
WHEREAS, pursuant to Section 43 052(g) of the Local Government Code, the Crty may annex
the 287 Zone for full purposes dunng the 30-day penod beginning October 29 2005
WHEREAS the 1 71 acre portion of Wagley Robertson Road nght of way is m Area A of
the 287 Zone included in the third amendment to the City's annexation plan.
WHEREAS, the City Council established a timetable for the proposed annexation of the 1 71
acres on September 6, 2005 (Mayor and Council Communication PZ 2611), providing for institution
and consideration of approval of the annexation on October 25 2005 m accordance with Chapter 43
Subchapter C 1 of the Texas Local Government Code;
WHEREAS It is necessary that the City remove the 1 71 acre portion of right of way from the
City's annexation plan so that the area can be annexed on October 25 2005 or as soon thereafter as
practicable as an exempt annexation pursuant to the procedures set out in Chapter 43 of the Local
Government Code, Subchapter C 1
WHEREAS Section 43 052(e) provides that a municipality may amend rts annexation plan at
any time to remove an area proposed for annexation,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH.
That the City's annexation plan is hereby amended to remove approximately 1 71 acre tract of
land situated in the E. H. ELKINS SURVEY Abstract No 487 and the H. ROBERTSON SURVEY
Abstract No 1259 and being that certain portion of Wagley Robertson Road (County Road Project No
4108), Tarrant County Texas as shown on Exhibit A and described in Exhibit `B

SITUATED in Tarrant Gounty Texas, and being a #ract of land in the E. H. ELKINS SURVEY Abstract No. 487
and the H. ROBERTSON SURVEY Abstract No. 1259 and being that certain portion of Wagley-Robertson
Road (County Road Project No. 4108) lying between the common lines of said Elkins and Robertson
Surveys (west lines) and the John Hibbins Survey Abstract No. 639 and the Heirs of Benjamin Thorhas
Survey Abstract No. 1497 and the east fine of said road as described in City of Fort Worth Annexation
Ordinance No. 6390, and said road portion being mare fully described as follows:
BEGINNING at the northeast corner of that certain 1st Tract conveyed #o Todd Group, Ltd. recorded in
Volume 10768, page 1290, of the Tarrant County Deed Records, in said road, said point being by
description 3893.33 feet sautheriy along the east line of said Hibbins Survey and the west line of the said
Robertson Survey from the northeast corner of said Hibbins Survey
THENCE north 89 degrees, 59 minutes, 20 seconds East in said road, 24.5 feet to a point in said east line
of road as described in said Ordinance No. 6390;
THENCE South 0 degrees, 49 minutes, 20 seconds West with said east line of road as described in
Ordinance No. b390, 3034.78 feet;
THENCE North 88 degrees, 57 minutes West in said road, 24.5 feet to the northeast corner of that certain
Tract D described in deed to Texas Electric Service Company recorded in Volume 6937 Page 1547 of
said Deed Records in the common line between said Elkins and Thomas Surveys and in the east line of
said Todd Group 1 ~+ Tract;
• THENCE North 0 degrees, 49 minutes, 20 seconds East with said east line of Todd Group 1 ~ Tract and with
said common between Elkins and Thomas Surveys and continuing with the common survey line
between said Robertson and Hibbins Surveys, in pfl 3034.33 feet to the PLACE OF BEGINNING, and
containing 1 71 acres.

RECOMMENDATION
It is recommended that the City Council approve the attached resolution amending the City's annexation
plan to remove an approximately 1 71 acre tract of land situated in the E H Abstract No 487 and the H
Abstract No 1259 and being that certain portion of Wagley-Robertson Road Tarrant County from the plan
DISCUSSION
On October 29 2002 (M&C PZ 2420R) the City Council adopted the third amendment to the City's
annexation plan to add approximately 7 744 acres, referred to as the 287 Zone Under state law the City
Council can annex the 287 Zone for full purposes beginning on October 29 2005 On January 7 2003
(M&C PZ 2483) the City Council annexed the 287 Zone for limited purposes.
Rick Sorenson of McDonald Sanders representing Todd Group Ltd has requested the voluntary full
purpose annexation of 350 4 acres of land in Tarrant County located north of Business Highway 287 and
west of Wagley-Robertson Road The annexation of the Wagley-Robertson Road right of way is associated
with that voluntary request. On September 6 2005 (M&C PZ 2611) the City Council approved the timetable
for the city initiated full purpose annexation of this property
All of the 1 71 acres are currently annexed for limited purposes The property is part of the 287 Zone that
was added to the City's municipal annexation plan on October 29 2002 and is currently scheduled for full
purpose annexation during the 30-day period beginning October 29 2005
M&C PZ 2623 for adoption of the full purpose annexation of the 1 71 acres of the Wagley-Robertson Road
right-of-way will be presented to the City Council after the City Council considers this proposed plan
amendment.
The property is contiguous to COUNCIL DISTRICT 7
