A RESOLUTION CONCERNING THE CITY OF FORT WORTH'S FINANCIAL
POLICY FOR THE SOUTHWEST PARKWAY
WHEREAS, the Southwest Parkway (SH 121) is necessary to alleviate congestion, enhance regional
mobility sustain economic development, enhance air quality and it shall be designed, constructed, and
operated to protect existing and future Fort Worth neighborhoods and natural assets adjacent to the
Southwest Parkway in the urban environment, and
WHEREAS, on December 8 1998 the Fort Worth City Council .authorized the negotiation and
execution of an agreement with the North Texas Tollway Authority (NTTA) and the Texas Department
of Transportation (TxDOT) concerning the development of the Project, and
WHEREAS, on November 28 2000 (M&C C 17178 Contract 26411) the City of Fort Worth (City)
entered into an agreement with NTTA and TxDOT (2000 Tri Party Agreement) concerning the funding
for the Project, as well as the rights and obhgat~ons of the City NTTA and TxDOT (Project Partners) for
the design, construction and operation of the Project, and
WHEREAS, on June 2, 2004 (M&C C 20112, Contract 30547) the City Council approved Amendment
#1 to the 2000 Tri Party Agreement, which detailed North Central Texas Council of Governments
Regional Transportation Council s authorization of $60 000 000 in funding to aid the City in acquisition
of right of way and
WHEREAS, on December 7 2004 (M&C C 20435 Contract 31117) the City Council approved
Amendment #2 to the 2000 Tri Party Agreement, by which the parties mutually established (i) design
guidelines specifically for the Southwest Parkway (ii) a process for the development of a Corridor
Master Plan, which will be integrated into final Plans, Specifications and Estimates (PS&E) for the
construction of the parkway (iii) the right of the City to approve PS&E before construction commences
and (iv) specific mitigative measures that are an integral part of the project as reviewed in the NEPA
process though the record of decision, and
WHEREAS, the Federal Highway Administration (FHWA) issued a Record of Decision (ROD) on June
13 2005 clearing the parkway environmentally for final design and construction, and declaring that the
Corridor Master Plan `will be a crucial element m the project's eventual final design and construction and
WHEREAS, and the City TxDOT and the NTTA have seen their respective project financial
obligations significantly increase since the original 2000 Tri Party Agreement according to NTTA s
most recent cost estimates, and

WHEREAS NTTA s Regional Mobility Partnership Plan Task Force is working through a process to
determine an increased toll. rate structure to support the design, construction, maintenance and operation
of existing system projects proposed projects currently under consideration (including the Southwest
Parkway) and the NTTA s ability to aid in the estimated fifty five billion dollars of regional
transportation needs and
WHEREAS the City has not received a comprehensive report of the revenue operation, maintenance,
and debt financing assumptions that are being used to generate a differential toll rate structure as
presented to the Fort Worth City Council on December 13 2005
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
1) The City supports the NTTA s Regional Mobility Partnership Plan Task Force alternative
four only as it relates to establishing an adequate and equitable per mile toll rate, annual rate
increase, and reset period for all NTTA system projects.
2) The City supports a uniform rate for all projects fn the NTTA system. Increased project costs
on the Southwest Parkway or any urban NTTA system project that result from specific
additions and improvements necessary to protect and enhance the surrounding community
should be supported by the overall NTTA system. The City states that this is in the spirit of
Amendment #2 to the tri party agreement and as entered as part of the environmental
clearance process.
